Scope: In addition to the NSNs specified in the solicitation, the scope of the contract includes Department of Defense (DoD) products for which Dana Commercial Vehicle Manufacturing (9R200) is the sole approved source. If items are later identified for an add-on project, they may be added in accordance with Procurement Note L27- Addition/Deletion of Items.

4. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1.

5. The Government requires spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The acquisition is restricted to the following source(s) of supply, which are the only source(s) known to have the capability of furnishing the required supplies and the only source(s) currently approved by the design control activity.

The use of the authority at 10 U.S.C. 3204(a)(1) is based on:

[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.

[ x ] AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

[X] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.

[X] AMSC R. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

For the NSNs identified with AMSC B, Dana Commercial Vehicle Manufacturing (9R200) is the only approved manufacturing source specified on the source control drawing. The limited availability of sources for an item coded with an AMSC of “B” indicates the item(s) is identified with an increased level of criticality therein requiring a high degree of production and manufacturing fidelity. The AMSC code is subsequent technical direction to acquire this item directly from the manufacturing source(s) specified on the source control drawing. This does not preclude offers from dealers; it means the manufacturing sources are restricted to the approved sources on the source-controlled drawing.

For the NSNs identified with AMSC D and R, the Government does not have the data or rights to the data, and it is not economical for the Government to obtain or otherwise develop the data. For these NSNs, only Dana Commercial Vehicle Manufacturing (9R200) possesses the complete technical data for the items; therefore, they are the only source uniquely qualified to manufacture these items and the only approved source listed for these NSNs.

On October 2 , 2025, the Product Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes. A copy of the technical certification is located under Attachment #1- Tech Cert.

6. The following efforts are being taken to ensure that offers are solicited from as many sources as practicable:

[X] A sources sought notice was issued on SAM.gov. for a minimum period of five business days.

[X] The acquisition will be synopsized on SAM.gov one day prior to the solicitation opening.

[X] Dealers of the manufacturer will be solicited.

[X] The solicitation will be posted the DLA Internet Bid Board System (DIBBS) for a minimum period of 15 days to allow any offeror the opportunity to submit a quote.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. A price analysis will be conducted based on a comparison of proposed prices received in response to the solicitation and/or a comparison of proposed prices to historical prices paid. Certified cost or pricing data, when required by FAR 15.403-4, and data other than certified cost or pricing data, will be requested and obtained as necessary to establish a fair and reasonable price, and a cost analysis may be performed on the data submitted.

8. Market Research/Efforts to Obtain Competition:

Sources Sought Notice: A Sources Sought Notice was posted to Contract Opportunities on SAM.gov from October 28, 2025, to November 3, 2025. Companies were asked to complete the attached market survey and NSN spreadsheet. The market survey/spreadsheet asked for information such as willingness to quote a three-year base period and priced option years, provide stock delivery, state if the items are quantity sensitive, and state if the items are commercial, etc. This notice yielded the following results:

Market Research: On October 28, 2025, an email was also sent to the approved source and all the sources in the procurement history, except Longhorn International as they are no longer doing Government business and inactive in System for Award Management (SAM).

The market survey/spreadsheet asked for information such as willingness to quote a three-year base period and priced option years, provide stock delivery, state if the items are quantity sensitive, and state if the items are commercial, etc. The following responses were received:

10. The following actions are being taken to overcome barriers to competition before any subsequent acquisition is made:

For the items identified with AMSC B, the solicitation contains DLAD Procurement Note, L22 Restriction of Alternate Offers for Source Controlled Items, which describes the process for offeror to submit their product for approval with the design control activity to get added to the list of approved sources.

For the remaining items, the solicitation contains DLAD Procurement Note, L04 Offers for Part Numbered Items, which describes the process for submitting an alternate offer on the current procurement and requesting evaluation of an alternate product’s technical acceptability for future procurements of the same item. DLA Weapons Support (Columbus) encourages vendors that may be interested in becoming an approved source, even if there is not an active solicitation, to contact the DLA Weapons Support (Columbus) Source Approval Monitor at DSCCAO-SAR@dla.mil for additional information on the steps required to submit a Source Approval Request Package for evaluation.

11. In accordance with DFARS PGI 206.303-2, the Contracting Officer was able to locate a previous procurement’s J&A for NSNs 4720014532027, 4820015229935, and 4820015636888; see attachment #2- Previous J&A. The remaining NSNs had a previous procurement under the Simplified Acquisition Threshold (SAT); therefore, a prior justification is not available.

I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief. If not exceeding $900,000, this signature serves as the approval.
