Summary of Justification for Other Than Full and Open Competition
This is a Justification and Authorization (J&A) document for an other than full and open competition procurement by the Defense Logistics Agency (DLA) Land and Maritime division. The solicitation number is SPE7MX-25-R-0005, and it concerns the acquisition of Motor Operated Pilot Valves (MOPV), part number 285034-0004, manufactured by Marotta Controls, Inc. (CAGE code 99657). The procurement is justified under 10 U.S.C. 3204(a)(1) and FAR 6.302-1(a)(2), which permits acquisition from only one or a limited number of sources when property or services are available from only one responsible source and no other type of property will satisfy agency needs.
The contract will be awarded as an eight-year Firm Fixed Price, Indefinite Delivery/Indefinite Quantity (IDIQ) agreement consisting of a four-year base period and two two-year option periods. The valve is a critical component of the Arleigh Burke-class destroyer fire suppression system (AFFF) and will support Navy ship refits over the next eight years, with an estimated annual demand of 460 units. Marotta Controls is the sole approved source due to proprietary manufacturing processes, design control requirements, and exclusive data rights; the Government lacks adequate technical data to enable competition. Market research identified one interested source (BHPE, LLC) but revealed no viable alternative suppliers. The Government will conduct continued market research and include a Source Approval Request clause for potential future competition. Certified Cost or Pricing Data will be required, and price analysis will be conducted using historical acquisition data and producer price index forecasts. The acquisition will be synopsized for 15 days, followed by 30 days of solicitation via the DLA Internet Bid Board System.

5. If restricted to the only source(s) of supply, include source(s) and CAGE code:
Marotta Controls, Inc. (99657), Part Number 285034 0004
The use of authority cited above is supported by the following Acquisition Method Code (AMC) and Acquisition Method Suffix Code (AMSC):
AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
AMSC Q. The Government does not have adequate data, lacks rights to data, or both needed to purchase this part from additional sources. The Government has been unable to economically buy the data or rights to the data, although the part has been undergoing full screening for 12 or more months. Breakout to competition has not been achieved, but current, continuing actions to obtain necessary rights to data or adequate, re-procurement technical data indicate breakout to competition is expected to be achieved. This part may be a candidate for reverse engineering or other techniques to obtain technical data. All AMSC Q items are required to be reviewed within the timeframes cited in 2-203(b). If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
Marotta Controls, Inc. (99657) is the only known source authorized to manufacture the item. Marotta owns the rights to use the data needed to purchase this part from additional source(s). Because the rights to use the data are not owned by the Government, item cannot be purchased, developed, or otherwise obtained from additional sources. Marotta (99657) has the engineering expertise to perform all efforts required to provide the supplies identified. Therefore, Marotta (99657) is uniquely qualified to supply these items.
Quality Assurance Specialist, , confirmed the following on April 26, 2024:
Certified that the technical information is complete and accurate. All means to obtain a technical data package adequate for manufacture of the items have been exhausted. Technical certifications are included as Attachment 1, titled Technical Certifications. Marotta Controls has a proven track record of successfully manufacturing these specific valves to meet the Government’s precise technical and operational requirements and uses proprietary manufacturing processes and equipment not readily available to other suppliers, which are critical to achieving the required specifications.
The AMC code describes to the Contracting Officer and other Government personnel the results of a technical review of a part and its suitability for breakout, and the AMSC code provides the contracting officer and other Government personnel with engineering, manufacturing, and technical information.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
The acquisition will be synopsized for 15 days prior to the solicitation opening. At the completion of the synopsis period, the Purchase Request (PR) will be solicited on the internet for 30 days via the DLA Internet Bid Board System (DIBBS).
7. The Contracting Officer hereby determines that the anticipated cost to the Government will be fair and reasonable.
Certified Cost or Pricing Data I/A/W FAR 15.403-4 will be required because this is a non-commercial based item.
Proposed prices will be reviewed for fair, reasonable, and realistic pricing in accordance with FAR 15.404-1(b), using price analysis based upon comparison of the offer received with the past acquisition history and the movement of the producer price index. Although unlikely, should more than one offer be received, proposed prices will be compared among all offers to determine if price competition exists. The contract is firm-fixed price with a contract length of one four-year base period and two option periods of two years each (for a total of eight
(8) years) that will be exercised at the Government’s discretion. A price analysis for future contract years will be
