DLA Land & Maritime Justification for Other Than Full & Open Competition (October 2020)

technical data necessary to manufacture the items coded AMSC C, which is not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part.
6. Efforts to ensure that offers are solicited from as many sources as practicable are: A Sources Sought and a Market Research Questionnaire were posted to SAM.gov from January 21, 2022 to January 28, 2022 looking for other sources of supply willing and able to produce these items, but no responses were ever received. The acquisition was synopsized on February 14, 2022 for 15 days prior to the solicitation opening. At the completion of the synopsis period, this acquisition will be solicited on the internet for 30 days via the DLA Internet Bid Board System (DIBBS).
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable: In accordance with FAR 15.403-4 (a) (1), Certified Cost or Pricing Data is not required because this acquisition is not expected to exceed the current threshold of $2,000,000. Offerors may be required to provide additional information for determining reasonableness of price. This data may consist of material cost or an explanation of their pricing approach. The Contracting Officer will determine whether the contract award prices are fair and reasonable in accordance with FAR Subpart 15.4. If other than certified cost or pricing data cannot be obtained, at a minimum, the Contracting Officer shall determine the prices fair and reasonable based on price analysis of the proposed prices to the historical prices paid for all items. Based upon the above techniques, the Contracting Officer hereby determines that the anticipated cost to the Government will be fair and reasonable.
8. Market Research/Efforts to Obtain Competition: Market research consisted of a sources sought notice, a formal market survey, a review of procurement/quote history, and a review of the results of recent market research undertaken to meet recent acquisitions of this item.
In accordance with 10 U.S.C. 2304(f)(3)(D) the market surveys on this project requested companies provide answers to general questions regarding their company size and status. The Long-Term Contract (LTC) questions included overall interest in the LTC, preferable length of contract, commerciality of the item and supporting documentation, delivery schedule, and the vendor’s ability to provide Certified Cost or Price Data. The vendors also had the opportunity to provide any additional information that they feel may be of assistance in building our Acquisition Strategy and possible solicitation development.
On July 7, 2021, the Sourcing Strategy Specialist (SSS) emailed market surveys to the following vendors:
Custom Control Sensors, LLC, FBC Enterprises, Seal Dynamics and Boeing. The project was assigned to the Contracting Officer with only one response from FBC Enterprises. The Contracting Officer followed-up with emails and phone calls to the three vendors previously contacted by the SSS on September 29, 2021.
The following is a summary of the information received:
Custom Control Sensors, LLC (CAGE 09049):
“I am so sorry that we have not responded to your request. Seal Dynamics is our valued partner, and we will not be quoting thru other vendors. Thank you so much for the follow up and please let us know if you have any questions.”
FBC Enterprises (CAGE 5ZD19):
FBC Enterprises, CAGE 5ZD19, serves as a SDVOSB channel partner to the DLA for Seal Dynamics, cage 5N582. Seal Dynamics operates as Custom Control Sensors sole military distributor.
