JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than a full and open competition basis.

3. The supplies required to meet the using activity's needs are described as follows:

The subject solicitation is an IQC project for a 3 year base period with two options of one year each for the three (3) NSNs listed below with ADQs as listed. All items are managed by DLA Land & Maritime.

The contract maximum has been increased from as the original maximum value was inadequate to cover the contract period. Nothing has changed, other than the contract maximum. The original J &A is attached.

4. The statutory authority pennitting other than full and open competition is:

(x) 10 U.S.C. 2304(c)(l) -Available from only one or a limited number ofsonrces.

The use of the authority cited in other than 10. U.S.C. 2304(c)(2) above:

(x) AMC 1. Suitable for competitive acquisition for the second or subsequent time.

(x) AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer. Only Griswold Industries possesses the necessary data and legal rights to the data to manufacture this ESA approved item.

The use of the authority cited is based on:

(X] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.

[X] AMSC L. The annual buy value of this part falls below the screening threshold established by DoD components and field activities. However, this part has been screened for additional !mown sources, resulting in either confirmation that the initial source exists or that other sources may supply the part. No additional screening was performed to identify the competitive or noncompetitive conditions that would result in assignment of a different AMSC. This code shall not be used when screening parts entering the inventOJ)'. This code shall be used only to replace AMSC O for parts under the established screening threshold. If one source is available, AM Cs 3, 4, or 5 are valid. If at least two sources exist, AM Cs I or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

(x) The acquisition will be synopsized.

( ) Manufacturers of similar products identified in the market research will be solicited.

(x) Dealers of the manufacturer will be solicited.

Forecast information is available to all potential sources for both sole source and competitive items.

The DLA Supplier Requirements Visibility Application (SRVA) is a database that is available via the

DLA internet Bid Board System (DIBBS.) SRVA provides potential sources the opp01iunity to search for information on DLA's anticipated requirements based on updated monthly forecasts. Essentially it provides 24 months of sole source and competitive projected purchase order quantities. Potential alternate sources for current sole source items can easily see DLA's forecasted procurements and can contact the Value Management Unit to become approved sources for sole source and code and part number items.

The DLA Land & Maritime Value Management Unit continually seeks out sole source, limited competition, over-priced, low reliability and hard to buy items to improve their value and support posture. The DLA Land & Maritime internet website contains infonnation for all potential sources on how to challenge prices, how to submit a Value Engineering Change proposal, a link to DoD's Value Engineering program and the necessary contact info for both the DLA Value Engineering program and the DoD Value Engineering program.

7. I hereby detennine that the anticipated cost to the Government will be fair and reasonable.

- The basis for the Government's fair and reasonable price determination is anticipated to be price analysis and/or analysis of other than cost & pricing data and the review of past buy history completed during market research. Further, the contract length will be 4 years based on the information obtained during market research.

8. Market Research/Efforts to Obtain Competition:

Other market research efforts inclnde: A review of the purchase historv, coordination with the DLA Land and Maritime Small Business Office, and a review of the project data by DLA Land and Maritime-ZCC.

DLA Laud and Maritime Product Specialists reviewed the data prior to assignment and solicitation preparation. Although a Sources Sought notice posted to FEDBIZOPS on 9/25/2014, no responses were received.

9. Additional facts supp01iing other than full and open competition are:

(x) Based upon the technical ce1iification on file in DLA Land and Maritime-YEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Govermnent.

DLA Land and Maritime-VE was contacted on 09/01/15 by email. responded by e-mail on the same date, stating that there were no open projects on the NSNs contained on this project.

10. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state) Griswold Industries (86184)

11. In addition to the specific actions being taken by Technical Support personnel to overcome barriers to competition before any subsequent acquisitions or recertification of class determination are made, this item is subject to the following methods oflocating additional sources:

(x) The solicitation contains the provision entitled Conditions for Evaluation and Acceptance of Offers for Paii Numbered Items

A Sources Sought Notice was posted to \vww.fbo.gov on 9/25/2014 for these specific items. The posting remained open until 10/2/2014. A complete market survey questionnaire was also uploaded and attached to the notice. Sources interested in becoming approved sources for these NSNs were asked to submit the appropriate information to become approved as outlined in DLAD 52.217-9002, Conditions for Evaluation and Acceptance of Offers for Part Numbered Items. Sources interested in offering on this solicitation were also asked to complete the market survey questionnaire and return it to the buyer via email by 10/2/2014. No responses were received.

All sole source NSNs on this project with an estimated annual demand value greater than $ I 00,000 have been referred to the Value Engineering team for potential inclusion in the DOD Spare Parts Break-Out program per DF ARs Appendix E.

Per the DLA Land & Maritime Strategic Programs Directorate Product Specialist, "The subject NSN(s) is(are) identified as a Sole Source item. At the time ofLTC/Project review no other Sources or Adequate

Technical Data could be identified or located for competitive procurement of this NSN."

Market Research/ Survev

A detailed market survey was conducted with of Griswold Industries. The vendor's survey responses and follow-on emails were completed by 10/1/2014 and yielded the following information:

Griswold is a large domestic manufacturer with a staff of approximately 570 employees worldwide with no parent company as indicated her firm's interest in participating in a long-term contract with

DLA.

originally stated that that these items were commercial. However, in an e-mail dated 9/24/2014, she redacted that statement and stated that Griswold considers these items military specific for various US Naval warships.

NOTE: Buyer searched ECF for previous J&As, but was unable to locate a J&A for any of the NSNs contained on this project.
