DLA Land & Maritime Justification for Other Than Full & Open Competition (May 2018)

[X] ORIGINAL

[ ] ADDENDUM (attach copy of original J&A for add-ons or revisions)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than a full and open competition basis.

3. The supplies required to meet the using activity’s needs are described as follows:

Identify end item, weapon system, or class of item:

ESTIMATED BASE VALUE: two year base

ESTIMATED TOTAL VALUE (BASE + OPTIONS): (two year base, no options)

MAXIMUM CONTRACT VALUE:

4. The statutory authority permitting other than full and open competition is:

10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.

All past buys have been under SAT; therefore there are no previous J&As in Records Management.

5. If restricted to the only source(s) of supply, include source(s) and CAGE code:

Manufacturer CAGE Code Part Number Snowbird Technologies, Inc. 0V5R4 ES 71242512

The Product Specialist, , certified the technical information on 11 Nov 19.

This direct current motor is used in environmental control units for consolidated ground support equipment. In other words, it provides power to the unit that heats or cools facilities such as tents or conexes. Snowbird Technologies is the only company that has the technical data necessary to manufacture this part. Snowbird Technologies is the only manufacturing source specified on the source control drawing and suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources. Although the Government has the drawing, it is a source-controlled drawing. Because the Government does not have full rights to the drawing, the drawing cannot be used to provide full and open competition.

The use of the authority cited below:

AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

The use of the authority cited is based on:

AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

Efforts to ensure that offers are solicited from as many sources as practicable are:

A sources sought notice was published on the Beta.SAM website on 21 Jan 20; two responses were received. One was from Potomac Electric Corporation and the other was from LGS Global, LLC. After responding to their questions, they expressed no further interest in this acquisition. On 13 May 20, the guidance on submitting an alternate offer or source approval request was sent to Potomac Electric and LGS Global in case they are interested in pursuing the manufacture of this motor.

The pre-solicitation notice/synopsis for this procurement was posted on the Beta.SAM website on 08 May 20.

6. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Based on market research, multiple dealers are expected to provide proposals for this item.

Other than certified cost or pricing data or similar item analysis may be used to determine that the offered prices are fair and reasonable. This NSN will be solicited with quantity ranges and allow for escalation in prices for year 2 of the LTC.

7. Market Research/Efforts to Obtain Competition:

Market Survey [10 U.S.C. 2304(f)(3)(D)]:

A market survey was conducted on/during 14 Aug 17-13 May 20.

Total number of vendors contacted: Four

Names of vendors contacted and responding: On 22 Jan 20, the market research questionnaire was sent to Snowbird Technologies, R&M Government Services, Kampi Components and First Coast Spares. First Coast Spares responded that they are not interested in providing a proposal for this procurement. Snowbird Technologies responded that they will not be providing a proposal; they cannot meet the packaging requirements.

Kampi Components called the buyer/KO on 30 Jan 20 to discuss this procurement. Kampi explained that they are the exclusive stocking distributor for Snowbird and later provided a letter from Snowbird stating that. They said this item would have been a good candidate for an LTC in the past

On 23 Mar 20, Linda Kelly, the SAPD Deputy Director, called of Snowbird Technologies.

Kampi stated that this is not a commercial motor and was designed by Snowbird specifically for use by the US Military.

Kampi Components and R&M Government Services responded to the market research request and their responses are below.

Techniques used to conduct survey: Emails were sent to the only approved source and dealers who have provided this item in the past. Phone calls were also made to Snowbird, Kampi, and R&M Government Services.

Types of information requested: Contact information, business size, interest in an LTC and structure of the LTC, commerciality, minimum and maximum quantities and values, delivery times and quantities, ability to obtain and provide certified cost or pricing data.

8. Additional facts supporting other than full and open competition are:

Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

9. A listing of sources, if any, indicating an interest in the acquisition is: Kampi Components and R&M Government Services.

10. The following actions are being taken to identify additional sources:

[X] Solicitation contains DLA Procurement Note, L22, Restriction of Alternate Items for Source Controlled Items

I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief.
