DLA Land & Maritime Justification for Other Than Full & Open Competition (Jan May 2018)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. The supplies required to meet the using activity’s needs are described as follows:

Contract will be an IDIQ with a 3 year base and two one-year option periods.

Identify end item, weapon system, or class of item:
80A – Truck, Vehicle System, 1 1/5-TON (HMMWV)
This NSN is a Rotary Switch. It’s a switch actuated by a definite angular rotation of the switch shaft about its axis.
The specific application of the item on the weapon system is unknown. Review of the item indicated that this NSN is a Critical Application Item, but not a Critical Safety Item.

4. The statutory authority permitting other than full and open competition is:

The use of the authority cited below:

The use of the authority cited is based on:
[X] AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
The Contract Specialist verified the AMC/AMSC for this procurement with Product Specialist on September 15th, 2020. The Product Specialist stated the AMC/AMSC coding was 3/B, with no recent changes and the last full review being conducted on 8/20/2020. Item of supply is procured to source controlled drawing 12506826 (19207) which is not coded as proprietary. The top drawing is an Army drawing with unlimited rights. Only the approved source listed has the rights to manufacture the item of supply at this time. UCOM, Inc. (0ZSM8) is cited as the approved source. UCOM, Inc. is currently the only source known to possess the requisite data to manufacture this item.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
The acquisition was synopsized on November 9, 2020 prior to the solicitation opening. At the completion of the synopsis period, this PR will be solicited for 30 days via the DLA Internet Bid Board System (DIBBS).
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
Formal C/P Data will not be required because the current estimated contract price is below the price threshold of $2,000,000 (FAR 15.403-4 and 10 U.S.C. 2306(a)). Offerors may be required to provide additional information for determining reasonableness of price. The buyer only intends to award this NSN when a fair and reasonable price determination can be made. The Contracting Officer will conduct price analysis by reviewing historical pricing, usage of the Producer Price Index (PPI), and learning curve analysis. The acquisition specialist may ask for assistance from the DLA Land and Maritime pricing office if necessary. Negotiations may take place in an effort to comply with DoD Material Cost Reduction Initiative. An option quantity will not be used for this procurement. Based on the above techniques, the Contracting Officer hereby determines that the anticipated cost to the Government will be fair and reasonable.
8. Market Research/Efforts to Obtain Competition:
Market Survey [10 U.S.C. 2304(f)(3)(D)]: A market survey was conducted on/during: October 5, 2020. A Sources Sought notice was posted to the FBO on October 5, 2020. The Sources Sought notice had a response date of October 12, 2020.

9. Additional facts supporting other than full and open competition are:
[X] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
10. A listing of sources, if any, indicating an interest in the acquisition is: UCOM, Inc. (0ZSM8).
11. The following actions are being taken to identify additional sources:
(X) The solicitation will be posted for 30 days.
12. The recent past buy history for this item consisted of simplified acquisitions, so there was no prior J&A available to attach IAW DFARS PGI 206.303-2(b)(i)(B).
