1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. The supplies required to meet the using activity's needs are described as follows:

5. The product specialist has identified and verified that the sources below are the only known sources that possess the requisite data rights for this NSN with the capability to manufacture this part.

The use of the authority cited is based on:
[X] AMC 1. Suitable for competitive acquisition for the second or subsequent time
[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the

The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
(X) The acquisition will be synopsized on or about July 2016.
(X) Other (Explain): Will be posted to the DLA Internet Bid Board System (DIBBS).
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
The most recent buy for this item was from Kitco Inc. (34087) in April 2013 for 207 units at $5763 per unit and was determined fair and reasonable based on buyer analysis (BI). This NSN has been purchased 3 times by DLA in its history, from November 2005 to April 2013, and one cancellation in September 2011. The quantities purchased have varied from 6 units to 207 units, with pricing ranging from $3189 to $9144 per unit. The last buy was the only purchase directly from the manufacturer, as was the first procurement, while the other procurement was from a dealer.
DFARS PGI 206.303-2(B) requires a copy of the J&A from the last procurement to be provided.

Consistent with procurement history this will be a stocked item. Since the estimated price at the solicited quantity of 40 units will be under $750,000, price analysis will be used. In performance of price comparison, learning curves and the bureau of Labor Statistics PPIs will be applied to the main buy quantity to be bought and to each incremental pricing structured mid-point quantity (if applicable), allowing for time and quantity variances as compared to the most recent successful award price to establish minimum and maximum pricing. Other than cost and pricing data, along with the use of the resources available through the Pricing Office may be required (if applicable).
Since quantity price breaks up to 100 each will be requested, it is possible that the contract price will exceed $750,000, requiring certified cost and pricing data and $700,000, requiring a sub-contracting plan. Kitco has stated that they will submit certified price and cost data and a sub-contracting plan, if necessary.
Negotiations procedures may be used pending on price analysis results and competition.
Length of contract: A firm-fixed price contract will be issued.

8. Market Research/Efforts to Obtain Competition:
A Market Survey was sent to all the approved sources. Additionally, a Sources Sought notice was synopsized in the Federal Business Opportunities (FedBizOpps) to seek possible potential sources for this item that may possess the expertise, capabilities, and experience to meet the government’s requirements.
Market Survey [10 U.S.C. 2304(f)(3)(D)]:
A market survey was conducted on 5/26/2016 and a Sources Sought synopsis was posted in the FedBizOpps on 5/26/2016, closing on 6/9/2016.
Total number of vendors contacted: Four (4).
Names of vendors contacted and responding:
1) Kitco responded stating they intend to submit a proposal.
2) General Electric did not respond.
3) Aeronautical Components did not respond.
4) Avnet did not respond.
