DLA Land and Maritime Justification & Approval for Other than Full and Open Competition (J&A) (April 2014)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than a full and open competition basis.

3. The supplies required to meet the using activity's needs are described as follows:

4. The statutory authority permitting other than full and open competition is:

(X) 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.

5. The product specialist has identified and verified that Polytronix is the only known source that possesses the requisite data rights for this NSN with the capability to manufacture this part for the AMC/AMSC codes below.

If restricted to the only source(s) of supply, include source(s) and CAGE code:

The use of the authority cited is based on:

[X] AMC 1. Suitable for competitive acquisition for the second or subsequent time

[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

(X) The acquisition will be synopsized on or about July 2016.

(X) Other (Explain): Will be posted to the DLA Internet Bid Board System (DIBBS).

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

The most recent buy for this item was from Polytronix Inc. (2Y126) in December 2015 for 14 units at $1737.50 per unit and was determined fair and reasonable based on competition among dealers or a dealer and a manufacturer offering parts from the same manufacturer (BB). This NSN has been purchased 4 times by DLA in its history, all between February 2011 and December 2015. The quantities purchased have varied from 1 unit to 16 units, with pricing ranging from $1000 to $2067.30 per unit. The last buy was the only purchase directly from the manufacturer; the other three procurements have been from dealers.

DFARS PGI 206.303-2(B) requires a copy of the J&A from the last procurement to be provided.

The previous procurement had a total contract value of $24,325. As the previous purchase was under the Simplified Acquisition Threshold, no J&A was provided or necessary.

Consistent with procurement history this will be a stocked item. As mentioned above, the previous purchases of this item were procured in lower quantities. However, starting with this purchase request, an increased need is forecasted. Since the estimated price will be under $700,000, price analysis will be used. In performance of price comparison, learning curves and the bureau of Labor Statistics PPIs will be applied to the main buy quantity to be bought and to each incremental pricing structured mid-point quantity (if applicable), allowing for time and quantity variances as compared to the most recent successful award price to establish minimum and maximum pricing. Other than cost and pricing data, along with the use of the resources available through the Pricing Office may be required (if applicable).

Negotiations procedures may be used pending on price analysis results and competition.

Length of contract: A firm-fixed price contract will be issued.

Quantity: 108 each (Quantity price breaks will be solicited from 50 each up to 200 each in anticipation of requirements increases).

8. Market Research/Efforts to Obtain Competition:

A Market Survey was sent to the approved source, Polytronix (2Y216). Additionally, a Sources Sought notice was synopsized in the Federal Business Opportunities (FedBizOpps) to seek possible potential sources for this item that may possess the expertise, capabilities, and experience to meet the government’s requirements.

Market Survey [10 U.S.C. 2304(f)(3)(D)]:

A market survey was conducted on 5/5/2016 and a Sources Sought synopsis was posted in the FedBizOpps on 5/5/2016, closing on 5/19/2016.

Total number of vendors contacted: One (1).

Names of vendors contacted and responding:

1) Polytronix responded stating they intend to submit a proposal.

a) See Market Research/Survey (attachment #1) for information requested.

b) Sources Sought notice contained general information pertaining to the item’s requirement and requested that interested parties submit information on their products/services, company, capability, company size/profile, and any other supportive information to the Acquisition Specialist.

Contractor responded they would be interested in submitting a proposal.

1) They are a small business manufacturer.

2) They prefer to deal directly with the government.

Information received regarding the commerciality of the item(s):

MM03 states this item is not commercial. A search on both Google and GSA Advantage found no listings. A search on Polytronix’s website did not find this part listed.

9. Additional facts supporting other than full and open competition are:

(X) Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
