This document is a Justification for Other Than Full and Open Competition (J&A) for an Indefinite Delivery Contract with the Defense Logistics Agency (DLA) Land and Maritime. The contract is for eye guards (optical instrument) with National Stock Number 6650014441229, specifically part number CMI525-ITT-001 manufactured by Rubbercraft Corporation of California. The annual demand quantity is 11,096 units, intended for the Ticonderoga Class CG (47) weapon system, with a 5-year base period contract.

The procurement is being conducted as a sole source acquisition under 10 U.S.C. 3204(a)(1), with Rubbercraft Corporation identified as the only approved source. DLA conducted market research, including a Sources Sought Notice on SAM.gov and outreach to potential vendors like AAR Supply Chain, Inc., but found no alternative sources. The solicitation will be synopsized on 12 May 2025, posted to the DLA Internet Bid Board System for at least 10 days, and includes a procurement note encouraging vendors interested in becoming an approved source to contact DLA Land and Maritime's Source Approval Monitor.

5. The Government requires spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The acquisition is restricted to the following source(s) of supply, which are the only source(s) known to have the capability of furnishing the required supplies and the only source(s) currently approved by the design control activity.

Rubbercraft Corporation of California (77969) p/n CMI525 ITT 001

The use of the authority at 10 U.S.C. 3204(a)(1) is based on:

[ x ] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.

[ x ] AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

On 4 March 2025 the Product Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes. A copy of the certificate is attached. Note, the original technical data supporting limited sources for this project included NSNs 5330000821045 and 5330011153764, which were removed from the original project on 28 April 2025, but were not removed from the technical data supporting limited sources as it is digitally signed and the Contracting Officer did not think it was necessary to have the Product Specialist rework the technical data supporting limited sources.

6. The following efforts are being taken to ensure that offers are solicited from as many sources as practicable:

[ x ] The acquisition will be synopsized on or about 12 May 2025 for a period of five days.

[ x ] Dealers of the approved source(s) will be solicited.

[ x ] The solicitation will be posted to the DLA Internet Bid Board System for a minimum of 10 days.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

A price analysis will be conducted based on a comparison of proposed prices received in response to the solicitation and/or a comparison of proposed prices to historical prices paid. Certified cost or pricing data, when required by FAR 15.403-4, and data other than certified cost or pricing data, will be requested and obtained as necessary to establish a fair and reasonable price, and a cost analysis may be performed on the data submitted.

8. Market Research/Efforts to Obtain Competition:

Sources Sought Notice:

[ x ] A Sources Sought Notice was posted to Contract Opportunities on SAM.gov on 4 March 2025 for a period of five business days, but there were no responses received.

[ x ] A general internet search for potential manufacturing sources other than those listed above Section 5 above yielded the following results: None.

9. A listing of sources, if any, indicating an interest in the acquisition is (If none, so state):

CAGE: 1Y249

COMPANY NAME: AAR Supply Chain, Inc.

10. The following actions are being taken to overcome barriers to competition before any subsequent acquisition is made:

[ x ] The solicitation contains DLAD Procurement Note, L22 Restriction of Alternate Offers for Source Controlled Items, which advises Offerors who are interested in qualifying their product for purposes of future acquisitions that they must contact the design control activity specified on the source control drawing.

DLA Land and Maritime encourages vendors that may be interested in becoming an approved source, even if there is not an active solicitation, to contact the DLA Land and Maritime Source Approval Monitor at DSCCAO- SAR@dla.mil for additional information on the steps required to submit a Source Approval Request Package for evaluation.

In accordance with DFARS PGI 206.303-2, [ x ] A copy of the previous justification from contracts SPE7LX23D5013 (SPE7LX22RX046) and SPE7LX20D5027 (SPE7LX19RX019) attached.

I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief.
