About this file

This is a Justification for Other Than Full and Open Competition (J&A) for a federal procurement under FAR 6.302-1, issued by the Defense Logistics Agency (DLA) Land and Maritime for solicitation SPE7LX25R0068.

The acquisition involves the procurement of Cell, Battery (NSN 6140-01-521-8584) as spare parts for the C17A Globemaster III Airlifter, Special Common Ground Equipment, and MIDS JTRS AN/USQ190 weapon systems. The contract is structured as an Indefinite-Delivery/Quantity contract with a firm-fixed price and a total duration of 5 years, comprising a 3-year base period and 2 option periods. The estimated contract values are redacted, but the current supplier, MarathonNorco Aerospace (CAGE 74025), holds a predecessor contract (SPE7LX22D0084) with pricing for NSN 6140-01-521-8584 ranging from $789.00 to $914.00 per unit depending on quantity tier and contract year. The justification is approved based on AMC 3 (acquisition for the second or subsequent time directly from the manufacturer) and AMSC D (data for competitive acquisition is not physically available and adequate specifications cannot be drafted). The Government conducted a market survey from June 3 to July 31, 2025, contacting four vendors but receiving a response only from MarathonNorco Aerospace. A Sources Sought Notice posted on SAM.gov on June 2, 2025, for seven business days generated expressions of interest from BHPE (9SWS7) and ECI Defense (3SDB5), though neither ultimately responded to the market survey. The solicitation will be synopsized on September 15, 2025, for 15 days and posted to the DLA Internet Bid Board System for a minimum of 30 days. The justification includes DLAD Procurement Note L04 permitting alternate offers and technical acceptability evaluation for future procurements. The contract was approved by the Contracting Officer on September 4, 2025, and by the Competition Advocate on September 15, 2025, as the estimated value exceeds $750,000 but does not exceed $15,000,000.
