About this file

This document is a Justification for Other Than Full and Open Competition (J&A) for a solicitation (SPE7LX-24-R-0002) by the Defense Logistics Agency (DLA) Land and Maritime for a 5-year IDIQ contract to acquire NSN 6140-01-476-8945 (Battery, Storage). The solicitation is limited to a single source, Concorde Battery (63017) under part number RG24-15A1, as this item is determined to be a commercial product of a type customarily used for non-governmental purposes. Market research indicated no other approved sources, and the government does not possess sufficient technical data or rights to the data to allow for full and open competition. The estimated total contract value is $13,225,132.02. The contract will have a 3-year base period and two 1-year option periods to support CONUS/OCONUS demands. The anticipated award date is July 29, 2024.

SOLICITATION SPE7LX-24-R-0002

SOURCE SELECTION INFORMATION – SEE FAR 2.101 AND 3.104 / CUI

The use of the authority cited is based on:

[ X ] AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

Per the approved manufacturer parts list for this NSN in SAP (as received from the Defense Logistics Information Service), the following CAGE is the only source that has been identified as having the proper complete technical data and manufacturing expertise to supply these items to DLA and the using military services. Concorde Battery (63017) is the sole manufacturing source specified on the source control drawings for these items and possess the rights to the technical data/drawings and/or the data itself necessary to produce the required item.

DLA Land & Maritime SAPD Product Specialist reviewed the project NSN on 07/11/2023 who certified the supporting data, including the AMC/AMSC codes and approved sources, are complete and accurate. On 04/08/2024 SAPD Product Specialist advised that the Government does not possess the data needed to acquire this NSN on a full & open basis nor does it possess adequate salient characteristics to permit an “equal item” based acquisition in accordance with FAR 52.211-6, Brand Name or Equal. On 03/14/2024 Quality Assurance Specialist updated the item description and provided his concurrence that this item falls under the definition commercial “of a type” provided in subparagraph (3)(ii) of the commercial item definition in FAR 2.101and not COTS. The SAPD Technical Certification is included as J&A Attachment #1.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

(x) The acquisition will be synopsized fifteen days on sam.gov prior to solicitation opening. At the completion of the synopsis period, this Request for Quote will be solicited on the internet for 30 days via the DLA Internet Bid Board System (DIBBS). All vendors may submit a quote, which shall be considered by the agency.

(x) The item contained in this procurement is limited to approved code and part numbered items, award is not limited to the manufacturer, and dealers can also receive the award.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

The basis for the Government’s fair and reasonable price determination is anticipated to be PPI based price analysis and/or the analysis of other than cost or price data such as informal cost break-downs and/or material invoices with final negotiated pricing reviewed in comparison with recent past reasonable purchases (adjusted for passage of time and quantity sensitivity), in addition to comparison to commercial market prices for potentially similar items, to support a reasonableness determination.

8. Market Research/Efforts to Obtain Competition:

A Sources Sought Notice was posted to www.sam.gov on 10/04/2023 and closed 10/11/2023 with no responses received. On 01/04/2024 the Contracting Officer was advised by of DLA Land & Maritime Value Management (VE) there are no new approved sources for this NSN currently that should hold back this acquisition.

Market research has been conducted prior to solicitation: A formal market survey was initiated by DLA Land & Maritime-ZAA Branch Sourcing Specialists who sent surveys 07/23/2023 to Battery Outlet (0FGN2), CHARG LLC (7WJJ0), and Concorde Battery (63017). Responses were only received from CHARG LLC and Concorde Battery. Other market research efforts included Contracting Officer review of the purchase history and internet market research. A review of the GSA Schedule website (GSAadvantage.gov) showed that the approved part number and NSN were not listed.

Summary of survey information received:

(1) Concorde Battery (63017) – Small Business Manufacturer

- Located in West Covina California with approximately 250 employees.

- Considers item “of a type” they sell commercially

- er

(2) CHARG LLC (7WJJ0) – Small Business Distributor

- Located in Elburn, Illinois with 10 employees.

- Considers item commercial.

Commercial Determination: NSN 6140-01-476-8945 (Battery, Storage) is designated a Class IX spare part utilized for electrical power on various military ground support equipment (AFF), AN/USQ190 MIDS Tactical Radio System (AGF), AN/TRN-26 Portable TACAN (HMF), and Tactical Quiet Generator (WWA). The approved material is a 24-volt sealed acid storage battery supplied by Concorde Battery (63017) under part# RG24-15A1 with standard SAE sized terminals which is a modified version of Concorde’s commercially available RG24-15 sealed lead acid 24-volt storage battery which has common commercial type cable ends. The project’s 24-volt storage battery shares the same form, function and characteristics as commercial storage batteries used to start cars, marine engines, and civilian aircraft. The components of this item are not military specific and these batteries are manufactured using commercially available components using the same production equipment and testing as their commercial equivalents. The terminal modifications are of a type customarily available in the commercial marketplace as required.

During market research the Contracting Officer found several online Concorde Battery dealers selling the commercial version of this project’s 24 volt battery (RG24-15) including www.skygeek.com for $940.08 and www.pilotjohn.com $904.99. A review of the COTS field in the material master for this NSN in SAP shows an entry of “Y”. This designates that a commercial recommendation by the technical community has been made that the item is commercial “of a type” and/or commercial off-the-shelf. DLA Land & Maritime SAPD Quality Assurance Specialist was consulted regarding the commerciality of NSN 6140-01-476-8945 and after review of the item and its technical requirement, the Quality Assurance Specialist concurred with the Contracting Officer’s determination that this item is considered “of a type” sold commercially with modification as called-out by FAR 2, Subpart 2.1, Section 2.101 and is not a commercial-off-the-shelf (COTS) item.

The project NSN meets the definition of commercial found in FAR 2.101 “Any item, other than real property that is of a type customarily used by the general public or by non-governmental entities for purposes other than governmental purposes”. It is also found that these items also meet multiple “Potential indicators of commerciality” found at DLAD 12.102. the item was determined commercial on a previous acquisition, under contract SPE7LX-20-D-0078, and the Contracting Officer sees no reason to overturn that previous determination.

The 24-volt sealed acid storage battery contained on this acquisition has been determined by the Contracting Officer to be a commercial item I/A/W FAR 2.101 and therefore FAR 12 - Acquisition of Commercial Items procedures will be utilized.

9. Additional facts supporting other than full and open competition are: Based upon the technical certification on file in DLA Land and Maritime – VEP technical data for NSN 6140-01-476-8945 is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

10. A listing of sources, if any, indicating an interest in the acquisition is: CHARG LLC (7WJJ0) and Concorde

Battery (63017).

11. These items are subject to the following methods of locating additional sources:

[X] The solicitation contains DLAD Procurement Note L22, Restriction of Alternate Offers for Source- Controlled Items.

[X] The Government will continue to conduct market research to ascertain if changes occur in the marketplace that would enable future actions for this item to be competitive.

12. The Contracting Officer searched the most recent previous award SPE7LX20D0078 listed in the contract history for NSN 6140-01-476-8945 in Records Management for a previous Justifications for other than full and open competition (J&A) as required by Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI) 206.304, and was able to locate the J&A for SPE7LX20D0078 for the applicable NSN contained on this successor project and is included for the approving authority.

In accordance with DFARS PGI 206.304(a)(S-70)(i), the following planned actions to remove any barriers to competition have been completed:

In the past, DLA Land and Maritime has hosted Captains of Industries to bring in industry leaders for particular commodities or weapon systems to help decrease barriers for companies looking to become sources of supply.

A Sources Sought Notice has been issued on www.sam.gov for a minimum period of five business days.

MEMORANDUM FOR RECORD

SUBJECT: Technical Data Supporting- Limited Sources for Solicitation

This memorandum serves as the technical certification required by FAR 6.303-2(c) for the subject solicitation .

The approved source and item of supply for NSN_______________ is CAGE_ ____ Part number _______ __________________________ _.

Multi-NSN Evaluation (see attachment)

The item(s) has the following AMC Code(s):

The item(s) has the following AMSC :

A The Government’s rights to use data in its possession are questionable.

B Acquisition of this part is restricted to source (s) specified on a Source Control and, Altered Item or A Selected Item drawings/documents.

C This part requires engineering source approval by the design control activity in order to maintain the quality of the part. An alternate source must qualify in accordance with the design control activity’s procedures, as approved by the cognizant Government engineering activity.

D The Government physically does not have in its possession sufficient, accurate or legible data to purchase this part from other than current source(s).

L The Government physically does not have in its possession sufficient, accurate or legible data to purchase this part from other than current source(s)

K This part must be produced from class 1A castings (e.g., class 1 of MIL-C-6021) and similar type forging(s). The part must be procured only from sources which use castings or forging(s) obtained from approved (controlled) source(s).

M Master or coordinated tooling is required to produce this part. This tooling is not owned by the Government or, where owned, cannot be made available to other sources.

N This part requires special test and/or inspection facilities to determine and maintain ultra-precision quality for its function or system integrity. Substantiation and inspection of the precision or quality cannot be accomplished without such specialized test or inspection facilities.

P The rights to use the data needed to purchase this part from additional sources are not owned by the Government and cannot be purchased

Q The Government does not have adequate data, lacks rights to data, or both, needed to purchase this part from additional sources

R The data or the rights to use the data needed to purchase this part from additional sources are not owned by the Government and it has been determined that it is uneconomical to purchase them.

U The cost to the Government to breakout this part and acquire it competitively has been determined to exceed the projected savings over the life span of the part.

V This part has been designated a high reliability part under a formal reliability Probability of failure would be unacceptable from the standpoint of safety of personnel and/or equipment. The cognizant engineering activity has determined that data to define and control reliability limits cannot be obtained nor is it possible to draft adequate specifications for this purpose.

Y The design of this part is unstable. Engineering, manufacturing, or performance characteristics indicate that the required design objectives have not been achieved. Major changes are contemplated because the part has a low process yield or has demonstrated marginal performance during tests or service use. These changes will render the present part obsolete and unusable in its present configuration. Limited acquisition from the present source is anticipated pending configuration changes.
