JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Source Selection Information-- See FAR 2.101 and 3.104

AMC 1. Suitable for competitive acquisition for the second or subsequent time.

AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

5. In accordance with FAR 6.303-2(c) supporting data that is the responsibility of technical personnel has been certified as complete and accurate by the technical personnel. SAPD product specialist (PS), , did a technical review on 10/24/2021 confirming all technical data for these items is correct including the AMC/AMSC and certification is attached (See Attachment 1 – Technical Certification). The listed approved sources are the only sources that possess the technical data and/or data rights required to manufacture these items and the only source currently approved by the ESA.

There are no current 339s out for these items.

6. Efforts to ensure that offers are solicited from as many sources as practicable are: A sources sought was posted to the Government-wide Point of Entry (SAM.gov) on 3/9/2022 through of 3/16/2022, with no inquiries received. This acquisition will be synopsized for 15 days prior to the solicitation opening on.SAM.gov. At the completion of the synopsis period, the project will be solicited on the internet for 30 days, via the DLA Internet Bid Board System (DIBBS).

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. Competition is expected as both approved sources expressed capability and interest in this acquisition. Price analysis will be conducted for this acquisition to deem the prices fair and reasonable as required by FAR 15.403-

4. The price analysis will consist of utilizing the historical prices and adjusting them based on the PPI Index. The price will be adjusted utilizing learning curves to determine the Government low and high targets for this acquisition. This will be a five (5) year, firm fixed price, Indefinite Quantity Contract (IQC). The five-year period is inclusive of a three (3) year base period and two (2) year option periods.

In accordance with FAR 15.403-4 (a)(1), certified cost or pricing data will not be required since the maximum contract value of this acquisition is below $2 million. The offeror(s) may be requested to submit information other than cost and pricing data to determine price reasonableness.

8. Market Research/Efforts to Obtain Competition:

An initial Market Survey was conducted between 3/22/2021 through 3/29/2021 An additional market survey was conducted between 3/9/2022 through 3/16/2022 via a Sources Sought

Total Number of Vendors Contacted: 2 Names of vendors contacted and responding: Schroth Safety Products (CAGE 1EAW9) and Amsafe, Inc. (CAGE 35FB9)

11. This item is subject to the following methods of locating additional sources: The solicitation contains the procurement notes L04 titled Offers for Part Numbered Items and M06 titles Evaluation of offers for Part Numbered items.

12. Past history was reviewed in Records Management. The previous procurement for these items was an

LTC, SPE7LX16D0047, awarded utilizing FAR Part 15 procedures. The J&A for contract SPE7LX16D0047 is attached per DFARS PGI 206.303-2 (b)(i)(B).
