JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7LX20R0151
DLA Land & Maritime Justification for Other Than Full & Open Competition
(FEB 2017)
them. Product Specialist (PS) reviewed the items on 3/25/2020. This information is documented in the technical data certification on file.
Based on the AMC/AMSC codes discussed above, this acquisition will be solicited with other than full and open competition under the authority of 10 U.S.C 2304(c)(1), as implemented by FAR 6.302-1(a)(2). As of the most recent technical review on 3/25/2020, all means to obtain a technical data package adequate for manufacture of the item have been exhausted.
Efforts to ensure that offers are solicited from as many sources as practicable are:
- The Government published a sources sought on the beta.SAM.gov website during five business days from 5/18/2020 to 5/26/2020.
- The acquisition will be synopsized on beta.SAM.gov.
- Solicitation will be posted on the DLA Internet Bid Board System for a minimum of 30 days.
6. I hereby determine that the anticipated cost to the Government will be fair and reasonable. This solicitation is being issued I/A/W FAR Part 15, Contracting by Negotiation. The Government will require Certified Cost & Pricing Data. The Contracting Officer will ensure that contract terms, conditions, and prices are commensurate with the Government’s need. The Contracting Officer will determine that the contract award prices are fair and reasonable in accordance with FAR Subpart 15.4.
7. Market Research/Efforts to Obtain Competition:
DLA Land and Maritime conducted various forms of market research and efforts to improve competition, which are summarized below. The market survey presented questions pertaining to item commerciality, availability of price lists, electronic data interchange (EDI) capabilities, production capacity, raw material used, certified cost and pricing data, quantity price breaks, delivery time and current interest in a Long Term Contract (LTC). Based on the market research, all vendors that responded are willing to engage in a LTC. The Contracting Officer expects multiple offers in the procurement. All vendors who responded to the survey have good status in SAM.
A Sources Sought was issued on Beta SAM from 5/18/2020 to 5/26/2020. No responses were received. The
Contracting Officer sent market surveys on 5/20/2020 to approved sources Oshkosh Defense (75Q65) and Grove US DBA Manitowoc (12361), and to the last awardee Lockheed-Martin (02769). On 6/8/2020, the Contracting Officer sent additional market surveys to three dealers that have quoted on previous buys: small business Ruta Supplies (0NJT4), small business Melton Sales (4X8W5) and large business Kirby-Smith (0BAH3). In addition to contact the vendors through the email, the Contracting officer also reached them by phone. Details on calling dates and point of contact reached are in the chronology sheet on file.
All vendors replied except Lockheed-Martin. Based on the market research, both large business approved sources
Grove and Oshkosh, one large dealer Kirby-Smith and small dealers Ruta Supplies and Melton Sales are interested in engaging into a long-term contract and will send a proposal.
Results of the Market Research All five vendors below have previously supplied these items to DLA. Market surveys are on file.
awarded to them, contract number SPE7L3-18-C-0027, dated 12/21/2017. No recent quotes were found. It is not clear why Lockheed-Martin has item 2520-01-188-5129 in its FASI contract SPE7M118D0002. The NSN is not sourced through them, and they did not show interest on the current procurement.
The vendors responding to the market survey all indicated that the items are not commercial. The Contracting Officer conducted internet searches using the part number to search. Google and Amazon searches resulted in no viable sources to indicate this item is commercial or of a type. Market research did not yield any readily available published catalog price lists, schedules or other form of commercial pricing that are regularly maintained and updated by a manufacturer or vendor that are available to the general public for inspection nor is there evidence of sale prices at which sales were made to a significant number of buyers constituting the general public. General public is interpreted as individuals using such parts in a non-governmental or military capacity. Results of market survey did not indicate that this item is commercial. Items are specially made components for the HEMTT. The design of the HEMTT (tactical heavy truck), and the nature of its missions demonstrate additional requirements beyond commercially available items. Based on the market research, the most recent Technical Review, current AMC/AMSC, and quotes receive in contract history, there is no indication the items are commercial or commercial of a type.
On 3/25/2020, the Product Specialist issued a technical certification, which has been cited above and is in file. The PS indicated the items are reviewed and suitable for a long-term contract.
As of 6/22/2020, none of the items are listed in the General Services Administration (GSA) Advantage website.
8. Additional facts supporting other than full and open competition are:
[ X ] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government. Based on the limited data the Government possesses and the zero access to the complete data package, only the approved sources can meet the Government’s minimum needs for these items.

Based on the procurement history and technical reviews by the Product Specialists, the solicitation will be solicited with Other Than Full and Open Competition under the authority of 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2). The Contracting Officer evaluated the opportunity to set-aside the procurement for small businesses. In accordance with FAR 19.502-2, DoD Class Deviation 2020-O0008 Rev 1, Total Small Business Set-Asides, the requirement for over SAT procurements is to have two or more small business concerns to provide a product from a domestic small business manufacturer. The procurement in solicitation SPE7LX20R0151 does not meet the criteria for a small business set aside because there are no small businesses that are approved sources to manufacture the items in reference. This same reason precludes a partial set aside, as stated in FAR 19.502-3(4).

11. The following actions are being taken to identify additional sources:
[X] Solicitation contains DLA Procurement Notes, M06 Evaluation of Offers for Part Numbered Items and L04 Offers for Part Numbered Items. The following clauses related to Subcontracting Plans are included in the solicitation, in case an other-than-small-business firm submits an offer: FAR 52.219-8 (required even for SB), 52.219-9, & 52.219-16. Because this is a consolidation, the procurement includes a small business sub-contracting requirement.
The Government is taking action to familiarize large and small business concerns with the acquisition via sources sought and a synopsis. A list of the NSNs and their respective part numbers were posted on the beta.SAM.gov website in order to provide both large and small businesses with avenues to be able to participate in this acquisition. Additionally, market surveys were sent via email to six vendors. The solicitation requires a subcontracting plan from any large business submitting an offer. Vendors shall provide details of its proposed Subcontracting Plan in compliance with FAR 19.702(a)(1). For that purpose, the contract will include the following FAR clauses: 52.219-8, Utilization of Small Business Concerns; FAR 52.219-9, Small Business Subcontracting Plan; and FAR 52.219-16, Liquidated Damages Subcontracting Plan. This will allow small businesses to have an opportunity to perform on the subcontracting aspect of the acquisition. The Government will make all efforts to address subcontracting goals established by the DLA Small Business Office. In addition to the Subcontracting requirements, each contract line will be awarded in an all or none per NSN basis, to the best value offer for that line. This makes the solicitation more accessible to small business because dissects the consolidation in smaller portions suitable for small business.
The Contracting Officer tried to obtain previous J&As, including the one on the most recent long-term contract SPE7M118D0002. For contracts with an award date between 2017 and 2020, which also have an existing record in Records Management, there was no J&A filed. The Contracting Officer contacted the buyer of the most recent LTC SPE7M118D0002 (Hope Hunt). A copy of the previous J&A was not located. NSN 2520-01-188-5129 does

have a large purchase awarded on contract number SPE7L318C0027. The J&A of this procurement is attached.
The other awards listed in contract history are auto-awards (identified by “V” in the ninth position of the award number) or purchase orders issued under the Simplified Acquisition Threshold (identified in contract history above by the letter “P” in the ninth position of the contract number).
