JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7LX-19-R-0079

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. This acquisition is to establish a firm fixed-priced, indefinite quantity contract for a base period of 3 years and 2 one-year option periods. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. This acquisition is to establish a firm, fixed-price contract for the following supplies. The supplies required to meet the using activity’s needs are:

These items procured being are in support of the F-15 Eagle (19F) and A-10 Thunderbolt aircraft (24F).

The use of the authority cited is based on:
1. [X] AMSC . This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity’s procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to
DLA Land & Maritime Justification for Other Than Full & Open Competition (May 2018) qualify in accordance with the design control activity’s procedures, AMCs 1 or 2 are valid. The Product Specialist, , confirmed the source and AMC/AMSC on 2/25/2019.
This solicitation is necessary in order for Defense Logistics Agency (DLA) provide Shuttle Valves used in military aircraft. A Shuttle Valve is a type of valve which allows fluid to flow through it from one of two sources. Generally a shuttle valve is used in pneumatic systems, although sometimes it will be found in hydraulic systems. The basic structure of a shuttle valve is like a tube with three openings; one on each end, and one in the middle. A ball or other blocking valve element moves freely within the tube. When pressure from a fluid is exerted through an opening on one end it pushes the ball towards the opposite end. This prevents the fluid from traveling through that opening, but allows it to flow through the middle opening. In this way two different sources can provide pressure without the threat of back flow from one source to the other.
5. Efforts to ensure that offers are solicited from as many sources as practicable are:
[X] The acquisition will be synopsized on or about March 20, 2019.

6. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
Certified Cost and Pricing data is not required I/A/W FAR 15.403-1(b)(3), as this acquisition will be procured utilizing FAR Part 15 procedures but is not over the TINA threshold of $2m and competition is not expected. These items will be solicited as Unrestricted Other Than Full and Open Competition. The buyer only intends to award the NSNs if fair and reasonable price determinations can be made. Therefore, I hereby determine the anticipated price/cost will be fair and reasonable based on price analysis and subsequent negotiations. Also it is anticipated that final, negotiated prices will be in line with pricing received under the past contracts.
7. Market Research/Efforts to Obtain Competition:
a. Market Survey was completed on February 19, 2019.
b. A Sources Sought notice was posted on February 12, 2019 and closed on February 19, 2019. No responses were received.
c. Total Number of Vendors Contacted: 1
d. Names of Vendors Contacted: SAF Industries (CAGE 26044)
e. Names of Vendors that responded in writing to the Market Survey and expressed interest in proposing on requirement: SAF Industries (CAGE 26044)
Types of information requested: The following includes some of the information requested on the Market Survey: Interest in Long Term Contract and number of years preferred, commerciality per FAR 2.101(b), business type (large, small, SDVOSB, WOSB), would an offeror be willing to provide Cost and Pricing Data, estimated delivery, whether an item is quantity sensitive, among other questions.
f. Summary of information received: A detailed response was received from the approved sources and a dealer/distributor, see synopsis below:
SAF Industries (CAGE 26044): of SAF responded that they are a small business manufacturer.
This item is not commercial.
g. Information received regarding the commerciality of the item: The Market Survey respondent stated that this item is not commercial. Based on the market research responses and buyer’s Internet research, the Contracting Officer has determined that this item is not a commercial item.
8. Additional facts supporting other than full and open competition are:
[ X] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
