JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7LX-16-R-0014

X ORIGINAL

1. The contracting activity is the DLA (Defense Logistics Agency) Land and Maritime Strategic Acquisitions Programs Directorate (SAPD).

2. The action being approved is the acquisition of Connector – Switch Assemblies. CLIN 0001 supplies this assembly for the Marine AAVC7A1 (Assault Amphibious Vehicle (Command)).

The Government will be using full and open competition after exclusion of sources. The data rights, manufacturing knowledge or data are not economically available to the Government.

3. The supplies required to meet the using activity's needs are described as follows:

4. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1)

Ulysses, Inc. (54432), Technical Systems, Inc. (33128), S.W. Electronics & Manufacturing (23302) and Autodyne Manufacturing, Co. (05584) are listed as approved sources of supply.

Additionally, approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part.

The use of the authority cited is based on:

(X) AMC 1. Suitable for competitive acquisition for the second or subsequent time.

(X) AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

(X) The acquisition will be synopsized at least two weeks prior to solicitation.

7. The end item is a code and part numbered with specialized drawings. The singular CLIN is for a Connector - Switch Assembly used in the AAVC7A1, an amphibious command vehicle that is both tracked and armored and used by the Marines as a mobile communications unit during an amphibious assault.

8. Market survey was conducted on/during January 21, 2015.

Total number of vendors contacted: 5.

Names of vendors contacted and responding:

Alektronics, Inc. (0DR48), Autodyne Mfg. Co. (CAGE 05584), Edel Engineering Development Co. (CAGE 00QR4), G.S.E. Dynamics, Inc. (CAGE 29183) and S. W. Electronics & Manufacturing (CAGE 23302) were contacted and asked to complete a market survey. Vendors that are approved sources or previous awardees were among those contacted with market survey requests. Alektronics, Inc. (0DR48) declined to complete a market survey, stating they are unable to be competitive on the part. A market survey response was received from one manufacturing source on January 22, 2015: S.W. Electronics & Manufacturing (23302), a small business and previous awardee. Past buy history shows S.W. Electronics & Manufacturing is the only vendor having supplied this NSN for the past 7 years.

Techniques used to conduct survey:

Market Research form was emailed to the above-stated vendors.

Vendors were contacted electronically and by phone.

A sources sought was posted on FedBizOpps on October 9, 2015 with a response date of

October 23, 2015. The sources sought posting resulted in no additional companies expressing interest in proposing on this acquisition.

Reviewed previous buys.

Types of information requested: The market survey requested that vendors provide their estimated delivery days, state if the item is quantity sensitive, state if the item is commercial, indicate the amount of option years they would be willing to quote; asked if destination zones impacted pricing, whether they could provide the required marking for packaging, and if FOB Destination and Inspection/Acceptance at Origin would be acceptable if required. The Market Survey addressed fixed pricing; however, the Contractor had the option to not accept fixed pricing and to state why with their response to the Market Survey.

Summary of information received:

One response was received on January 22, 2015:

S.W. Electronics & Manufacturing (23302), a domestic, small-business manufacturing source, is interested in providing a proposal for a long-term contract for this item The Contractor stated this item is not commercial per FAR 2.101(b).

**FOOTNOTE: ** FOB Origin, in lieu of FOB Destination, will be the method of shipping in accordance with the Government First Destination Transportation and Packaging Initiative.**

Information received regarding the commerciality of the item: On the market survey, S.W.

Electronics & Manufacturing (23302) stated this item is not commercial. Further, the buyer researched SAP and the material master, and confirmed this item is not considered commercial.

9. I hereby determine the anticipated cost to the Government will be fair and reasonable. Cost or pricing data, per FAR 15.403-4 (a)(1)(iii), will not be required as the acquisition is estimated to be below the $750,000 threshold. The buyer will utilize price analysis based upon previous buy price history, Producer Price Index (PPI) and learning curve analysis to establish Government Targets. By using the above techniques, the Contracting Officer anticipates that the costs to the Government will be fair and reasonable. This requirement is being solicited as a three-year base with the potential for two option periods.

10. Additional fact supporting other than full and open competition are:

(X) Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

11. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state) S.W. Electronics & Manufacturing (23302).

12. In addition to the specific actions being taken by Technical Support personnel to overcome barriers to competition before any subsequent acquisitions or recertification of class determination are made, this item is subject to the following methods of locating additional sources:

(X) Other: A sources sought notice was posted on FedBizOpps on October 9, 2015 with a response date of October 23, 2015. No inquiries were received as a result of this notice.
