About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for Solicitation SPE7L124Q0364 issued by the Defense Logistics Agency (DLA) Land and Maritime.
The JOFOC states that the required beadlock spacer kits are a commercial item of a type that is only available from Hutchinson Industries Inc. as the sole known source. Market research was conducted, including a Sources Sought notice, but no other responsive vendors were identified. The item is critical for combat vehicle operations, as it is designed to maintain vehicle mobility and control at speeds up to 20 mph when the tire is damaged. Commercial equivalents do not have the same performance characteristics. The JOFOC cites FAR 13.5 Simplified Acquisition Procedures and determines the pricing to be fair and reasonable based on previous procurement history. A firm-fixed price contract will be issued as a result of this JOFOC.

CUI
DLA Land & Maritime Justification for Other Than Full & Open Competition
(October 2020)
8. Market Research/Efforts to Obtain Competition:
Market research consisted of review of past procurements, market surveys received from interested parties, Market surveys were sent to Hutchinson Industries Inc 62161, BRIGHTON CROMWELL LLC, AM GENERAL LLC on 02.29.24 with a respond by date of 3.12.24. A follow up email was sent to try and facilitate communication, no response occurred. Total number of vendors contacted: 3. Names of vendors contacted and responding: 0
Procurement history:
The most recent buy for this NSN was on 12.07.234. PO# SPE7L324F1167 was awarded to Hutchinson Industries Inc 62161 at 222.85 per unit. This price was determined Fair and Reasonable based on comparison to purchase history and was coded BG. There have been 10 purchases for this NSN since 10.23.2018. Previous purchases have all been extremely varied in quantity from 62 to 10,000 each. Per unit prices have been relatively stable with a mean price of $197.00 each over a 6 year span. Ranging from $134 for a total order quantity of`10,000 to a higher per unit price of $222 for a 62 total order quantity. Using the more stable price of per unit. It is determined since 2020 the price per unit increased 8.3% per year. This is a DLA direct item. In order to determine the cost as fair and reasonable, Price Analysis will be calculated using past procurement history, a Learning Curve and PPI. If additional analysis is needed for the fair and reasonable determination, support will be sought from the Pricing Office. Negotiations procedures may be used pending price analysis results and competition. A firm-fixed price contract will be issued.
Commercial Determination:
The Product Specialist for previous procurement SPE7L519P0685P00002 stated that combat vehicles runflats for which this assembly is utilized are designed from a proprietary blend of rubber, polymers, and a Kevlar cable inside to prevent it from separating or breaking apart when damage is caused by a road hazard or a ballistic attack.
These characteristics are essential to end users in order to maintain control of the vehicle and to ensure that the vehicle can operate at speeds not to exceed 20 mph (32 kph) so that personnel can depart from dangerous or desolate areas. No other commercial item meets these essential requirements based on this item initially being developed for the U.S. Military for combat operations. The Government cannot pursue a Brand Name or Equal specification based on salient characteristics that are readily available in the commercial marketplace since this item was specifically designed for the military performing combat operations. This is a critical item that is designed and tested to maintain certain speeds and distances that are present in combat situations and it is weapon system coded to multiple applications. Commercial equivalents include cash transit armored vehicles, ambulances, fire trucks, armored sedans or SUVs. The commercial and military beadlocks consist of the exact same rubber compound and Kevlar cable and the beadlock is designed to increase the mobility of a vehicle operating in a soft terrain. The beadlock ensures the clamping of the tire beads on the rim at lowered or zero pressure which creates a larger footprint of the tire in the soft terrain such as sand, mud, or snow. The only difference between the commercial version and the military version is the weight of the beadlocks. The Product Specialist further stated that the military version has been tested to perform in combat related situations that will likely not be experienced by the comparable vehicles. Therefore, this item is considered to be commercial of a type. Hutchinson is the only known source with proven knowledge to manufacture this item to meet the needs of the Government at this time.
Therefore, based on prior commercial item determination and Product Specialist verification, the Contracting Officer determines this item is commercial of a type in accordance with FAR 2.101(1)(i) “Commercial of a Type”.
The Government is utilizing FAR Part 13.5 procedures. The solicitation shall be issued pursuant to Simplified Acquisition Procedures.
A sources sought notice was posted on SAM.gov from 2/28/2024 to 3/8/2024. No responses from sources sought.
