Justification and Approval (J&A)
1. Defense Logistics Agency (DLA) Troop Support, Industrial Hardware Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements using other than full and open competition basis.
3. Following are the supplies required to meet DLA’s needs:
National Stock Number (NSN): 5340-01-173-7993 Item Description: Bracket, Double Angle Quantity: 2,500 pairs Unit Price: $190.00 Total Price: $475,000.00
4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), FAR Part 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. The use of the authority cited is necessary because Tampa Brass and Aluminum is the only contractor approved to make this item. The Government does not possess complete unrestricted technical data to develop an item description or specifications for purposes of full and open competition. This item is not commercial. It is used on several different weapon systems.
This requirement also has a Product Verification Testing that must be passed before delivery. There are no known alternate items that will satisfy the military services’ requirements unless otherwise tested, evaluated, and approved by the cognizant Government ESA. The item is coded Acquisition Method Code (AMC) 3 and Acquisition Method Suffix Code (AMSC) C – The Government does not own the data or the rights to the data needed to purchase this part from additional sources.
6. A solicitation will be issued and posted to DIBBS to ensure that offers are solicited from as many potential sources as is practicable in future procurements. In addition, this justification will be made available for public inspection, with the solicitation, in accordance with FAR 6.305(c).
7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on price analysis, including comparison to previous prices paid for the same item.
8. A market survey was conducted, and it revealed that there are no other manufacturers that are currently capable of supplying the required item. Tampa Brass and Aluminum were contacted during market research and advised that they are interested in quoting this item. In addition, a source sought notice was issued on 04/27/21 and closed on 05/27/21.
No additional manufacturers expressed an interest in quoting on this item. As a result of market research, it is determined that there are no other known manufacturers that are currently capable of supplying the required item. The drawings required to produce these items are proprietary and are not possessed by the Government. The data needed to acquire this part competitively is not available.
9. Tampa Brass expressed an interest in the proposed acquisition.
10. Actions to remove or overcome any barriers to competition before any subsequent acquisition for the supplies and to encourage the submission of offers for alternate products will include periodic screening of the AMC/AMSC codes assigned to the item by a Product Specialist and the inclusion of Procurement Note L04 - Offers for Part Numbered Items (SEP 2016) to encourage the submission of offers for alternate products.
Technical data packages for alternate items will be sent to the Government ESA for evaluation and potential approval.
