(1) By submitting a quotation or offer, the contractor agrees that, when the contractor is not the manufacturer of the item, it is confirming that it currently has or will obtain before delivery and shall retain documented evidence (supply chain traceability documentation) that the item is from the approved manufacturer and conforms to the technical requirements. The retention period is five years after final payment under this contract.
(2) At a minimum, the supply chain traceability documentation for the item shall include: basic item description, part number and/or national stock number, manufacturing source, manufacturing source’s Commercial and Government Entity

(CAGE) code, and clear identification of the name and location of all supply chain intermediaries between the manufacturer to the contractor to item(s) acceptance by the Government. The documentation should also include, where available, the manufacturer's batch identification for the item(s), such as date codes, lot codes, or serial numbers.
(3) Examples of acceptable supply chain traceability documentation can be found at:
http://www.dla.mil/LandandMaritime/Business/Selling/Counterfeit-Detection-Avoidance-Program/
(4) The contractor shall immediately make available documentation upon request of the contracting officer. The contracting officer determines the acceptability and sufficiency of documentation. If the contractor fails to retain or provide the documentation or the contracting officer finds the documentation to be unacceptable, corrective action may be taken including, but not limited to, cancellation of undelivered orders or rejection of delivered supplies.
Section 833 of the National Defense Authorization Act for Fiscal Year 2006 added language to 10 U.S.C. 2533a requiring that all articles or items of “clothing”, including the materials and components thereof, purchased by the Department of Defense be grown, reprocessed, reused, or produced in the United States, other than sensors, electronics, or other items added to, and not normally associated with, clothing (and the materials and components thereof).
THE DEPARTMENT OF DEFENSE IS PROHIBITED BY THE PROVISIONS OF THE BERRY AMENDMENT FROM PROCURING END PRODUCTS OR COMPONENTS THE HAVE NOT BEEN GROWN OR PRODUCED IN THE UNITED STATES OR ITS POSSESSIONS. This include, but not limited to, synthetic fabric and coated synthetic fabric, including all textile fibers and yarns that are for use in such fabrics. PROVISIONS INCORPORATED BY REFERENCE HEREIN.
(End of Addendum to 52.212-1)
ADDENDUM TO FAR 52.212-2, EVALUATION – COMMERCIAL ITEMS.
The Government anticipates award of a firm-fixed-priced contract. Award will be made using the Lowest Price Technically Acceptable source selection process defined in FAR 15.101-2.
The Government intends to award without discussions. However, the Government reserves the right to conduct discussions if determined necessary. Therefore, offerors are advised that quotes submitted should include best and final pricing.
All non-price factors shall be evaluated on an acceptable/unacceptable basis. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in an overall rating of “unacceptable” and the offeror will be ineligible for award. Award will be made on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for non-cost factors. The following ratings shall be used to evaluate quotes:
FACTOR I – PRICE: Price does not receive an adjectival rating. The Government will evaluate each price using various techniques found in FAR 15.404-1 to determine that the price quoted is fair and reasonable.
Factor II – TECHNICAL CAPABILITY: Technical Capability Ratings Acceptable: Quote clearly meets the requirements of the solicitation without any exceptions.
Unacceptable: Quote does not meet the requirements of the solicitation and is taking exceptions.
FACTOR III - PAST PERFORMANCE: Relevant past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires. In terms of relevancy, contracts must be completed in full ("in-progress" contracts will not be evaluated), please include the contract number and monetary value, point of contacts and a brief description of items for the past three years. It shall be evaluated in accordance with FAR 15.305 and DFARS 215.305.
Past Performance Ratings Acceptable: Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (See note below).
Unacceptable: Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
NOTE: Offerors are authorized to provide information on any problems encountered on the identified contracts as well as any corrective action taken. The Government may obtain past performance information from sources other than the references provided. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)).
Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
