SPE4AX-24-R-0026-0005

Questions & Answers – Updated 03 DEC 2024

Q1. Section H-900 Pricing and Payment states that “material priced at time of award represents the fixed commodity price for a 6-month period. The RFP due date is 2024 Nov 07 at 3:00PM EST, how long after the due date will the award be made?

A1. The USG intends to award the contract by July 31, 2025.

Q2. In the SOW, section 8.0 American Innovation and Manufacturing ACT, it mentions that 22 MCMEU NSN’s can be requisitioned exclusively for military units within the drawdown limits.

Q2.a. Does this mean that the DoD will be providing allowances for these materials?

A2.a. The DoD will provide allowances for the MCMEU NIINs only, as required.

Q2.b. Will the DoD provide allowances for all HFC’s procured by this contract?

A2.b. No, the DoD will not provide allowances for all HFC NIINs. Amendment 0003 Clarification: Allowances will be provided for MCMEU HFC NSNs, but not non-MCMEU HFC NSNs.

Q3. Is there a minimum order quantity for each NSN per order?

A3. The minimum order quantity for each NIIN is one (1).

Q4. Can you provide a bid tabulation from the last solicitation?

A4. No, this information will not be provided.

Q5. On page 3 of the solicitation document, it mentions a link where the project is posted but that link takes you to the “Chemicals and Petroleum Project”, can you provide a new link?

A5. Updated – Corrected link is https://www.dla.mil/Aviation/Offers/Commodities/Gases-and-Cylinders-Project/

Note: The GPE (www.sam.gov) is the posting location of record for the most up-to-date solicitation information; there may be minor delays with updates to the website above.

Q6. Can you provide a list of ship to locations?

A6. No, possible ship-to locations include any location (CONUS or OCONUS) that has U.S. Military, U.S. Government Agencies, or Foreign Military Sales.

Q7. Can you provide a historical monthly order quantity by NSN over the last contract?

A7. No, all offerors should be based upon the estimated annual demands provided in the RFP.

Q8. When will the solicitation be available in WICAP so that an eCAP can be prepared? (SF1449 L19, page 53 of 55)

A8. The solicitation is now available in WICAP.

Q9. Will the Government allow foldout pages (up to 11 x 17) for detailed graphics? (Section L 4.4.2, page 6 of 15)

A9. No, the page size limit is 8.5” x 11” IAW Section L, 4.4.2.

Q10. Will the Government allow the "certification or appropriate documents demonstrating compliance with required standards" to be provided outside of page count in an Appendix to Volume 1?(Section L 5.1, page 7 of 15).

A10. Per Section L, Table 1, representations and certifications can be provided in Volume VII and do not have a page limit.

Q11. NSNs 5940-01-337-6770 and 2510-01-706-4186 appear to be outside the scope of this solicitation which is otherwise constrained to FSCs 6830 and 8120.

A11. These two NIINs have been removed from the requirement (Attachment 2)

Q12. Are the cylinders in use at customer sites and in transit included in the

80,855 cylinders in Attachment 4?

A12. No, the total number of cylinders in use fluctuates; the VMI table at Attachment 4 is provided as an approximation of what a vendor can expect to manage, which is also subject to change based on transfers and GFP purchases.

Q13. Given the importance and the depth and breadth of requirements in SF1 Quality Assurance, would the Government consider allocating an additional (10) pages to SF1 for the offerors to provide a more thorough response?

A13. Additional ten (10) pages has been approved; Section L, 4.2.4., Table 1 has been updated.

Q14. If there are any questions on specific quantities or other questions, who do we address them to?

A14. Jeremy Reeves (Jeremy.T.Reeves@dla.mil), Charles Hicks (Charles.Hicks@dla.mil), Patrick Finegan (Patrick.Finegan@dla.mil)

A15. Yes, they were attached to the meeting invite and attached to Amendment 0001.

Q16. Is there an end date for receipt of questions.

A16. Yes, we will entertain questions until October 24, 2024, two weeks prior to the closing date of November 7, 2024. Beyond that date, we will not entertain any other questions.

Q17. What percent of the orders is domestic and what percentage is international today?

A17. Amendment 0002 Update – Over the past five years of procurement history, 82% of orders were CONUS and 18% were OCONUS.

Q18. What is approximate cylinder population today?

A18. See Q12/A12 above; at the time of this posting there were approximately 80,855 cylinders being managed by the vendor. Total cylinder population is subject to change.

Q19. How many DODAACs are covered in this requirement?

A19. See Q6/A6 above, potential DoDAACs include any location (CONUS or OCONUS) that has U.S. Military, U.S. Government Agencies, or Foreign Military Sales.

Note: The following changes have also been made:

1. Updated SOW Section 7.7.4.1 to clarify firebox requirement

2. Addition of oxygen fireboxes to attachment 2.

3. Updated AIM Act verbiage in SOW Section 8.0

4. Update to regulation language in SOW Section 7.7.4.1.B

5. Updated PID Data Attachment 16

Amendment 0002 Update:

Q20. What percentage of the bid is domestic vs international supply?

A20. Based on five years of procurement history, 82% of orders were CONUS and 18% were OCONUS.

Q21. Is there a database we can gain access to for a larger description of the NSNs?

A21. Yes, DLA PUB LOG provides additional NSN information.

PUB LOG® - Public Logistics Data > Defense Logistics Agency > PUB LOG®: Public Logistics Data (dla.mil)

Q22. Could you offer a cross-reference sheet with more information regarding cylinder size, specific gas type, quantity, etc.?

A22. A cross-reference sheet of this type will not be provided.

Q23. Is there list of Ship To’s that you can provide?

A23. See Q6/A6 above.

Q24. What is the total cylinder count in use today?

A24. See Q12/A12 above.

Q25. How do we ensure we are qualified to bid on this RFP?

A25. It is the offerors’ responsibility to verify their ability to submit an offer in accordance with all solicitation requirements.

Amendment 0004 Update:

Q26. Section L, 3.3 and 4.2.3 – Section L instructions 3.3 and 4.2.3 seem to overlap on instructions for marking confidential and/or proprietary information. Any content in the proposal that proposers would want to protect under 4.2.3 would also need to be protected under 3.3 and vice versa. Is it the Government's intention that the footer of each page of the proposal that contains sensitive information has both sets of disclosures ("Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal." AND "SOURCE SELECTION INFORMATION SEE FAR 2.101 and 3.104", respectively)? Or should one be used in lieu of the other?

A26. Yes, both disclosures are required.

Q27. Section L, 8.0 – Does DLA have specific SB/socio-economic goals that they expect vendors to meet?

A27. No, there are no specific SB/Socio-economic goals for this requirement.

Q28. Attachment 21 – Attachment 21, Cross-Reference Matrix states that requirement 7.6 should be addressed in Volume II, Subfactor 1, however, we see no explicit requirement 7.6. The SOW numeration goes from 7.5 to 7.6.1. Can the Government please clarify what requirement should be addressed in the aforementioned volume and/or update the SOW to re-number the requirements?

A28. SOW updated to add Section 7.6 header/title; no further numbering updates.

Q29. Section L, Table 1 – Given the imbalance of SOW requirements to be addressed within a specific Subfactor (for example, Technical Subfactor 1 only has one requirement to be addressed, whereas Subfactor 2 has eleven, yet Subfactor 1 has twice the page allocation), will the Government consider removing the Subfactor page allocation requirements and allow vendors to allocate pages within the Volume-wide page restriction (40 for both Volumes I and II) as they see fit?

A29. Section L updated – Volume I & II Subfactor page limitations removed to allow vendors to utilize overall factor page limit at their discretion.

Q30. Section L, 7.0.3 – Regarding Volume III, Section L (7.0.3) states, "narrative shall detail the Offeror's performance in relation to… [Factor] 3 (Past Performance)", which seems to be a circular reference as Factor 3 has no bearing on performance to the actual contract. Please provide clarity on how vendors should complete this section and/or consider an alteration to the instructions to remove Factor 3.

A30. To better understand how a vendor should complete this requirement, please reference Section M, 3.6. It is the offeror’s responsibility to provide sufficient information regarding their performance on the previous/current contract submittals.

Q31. Attachment 3 – Are offerors required to provide pricing, Hazard Warning Labels, and SDSs on inactive NSNs as part of our offer or can this information be provided after award, based on a specific need for Attachment 3's inactive NSNs? Given that these NSNs are inactive, we recommend that they not be required for the initial submission, so that the government can focus their evaluation on items that are active and, therefore, most likely to be ordered.

A31. No; pricing, HWLs, SDSs, etc. are not required for inactive NSNs at time of award. If/when an inactive item becomes active, it will be subject to the requirements of active NSNs (price, HWL, SDS, etc.).

Q32. Attachment 1, 7.7.4.1 – Section 7.7.4.1 clearly states that the contractor should maintain an aggressive customer returns program. However, it does not specify whether the government or the contractor will be responsible for the freight costs associated with returns from non-DLA depot CONUS and OCONUS locations. Can the government confirm that offerors are not responsible to account for freight costs from non-DLA depot CONUS and OCONUS locations in their pricing?

A32. For CONUS orders, the Contractor is responsible for the transportation costs of returns. The Contractor is not responsible for these costs with OCONUS returns.

Q33. Attachment 1, 7.7.4.1 – Our interpretation of the SOW is that the contractor is not responsible for logistics costs and importation for excess material or government-owned material from OCONUS locations to CONUS. Can the government clarify that our interpretation is correct? If not, please provide clarity on who will be the importer of record and if the contractor is the importer of record, will the government provide any necessary allowances for any HFCs returned to CONUS?

A33. The contractor is not expected to be responsible for the logistics cost and importation of excess material or government-owned material from OCONUS locations to CONUS. The importer of record does not apply, as allowances are not required for DoD returned material. If reclaimed/recycled, it is no longer considered virgin, and allowances are not applicable.

Q34. Attachment 22 – Is there an NSN number or numbers (or other tracking mechanism) that is currently used for keeping track of the values related to cylinder refurbishment fees, transition fees, management fees, and disposal fees? This information is vital in permitting all contractors a fair and equal evaluation of pricing.

A34. No, this information is not publicly available. After contract award, a designated service CLIN will be utilized for payment of refurbishment, disposal, management, and transition fees.

Q35. Attachment 1, 6.1 – Does DLA have specific geographic boundaries for defining what areas of the United States can qualify as east and west coast hubs?

A35. No, there are no contractual requirements for the number and location of hubs, it is at the vendor’s discretion. Historically, at least one East and one West coast hub has been utilized to facilitate OCONUS returns.

Q36. Attachment 1, 7.7.4.1 – Our interpretation of the SOW is that the contractor is not responsible for direct shipment to OCONUS locations, rather, the contractor will ship products to DLA CONUS locations, which DLA will then ship to the OCONUS location. Is our interpretation correct? If not, please provide greater details on management of the import/export workflow for OCONUS shipments?

A36. The USG is responsible for freight forwarding to OCONUS locations if the ship-to is a CCP or POE. However, the contractor is responsible for direct shipment to OCONUS locations if a CONUS ship-to is not available. The contractor is responsible for all transportation to the ship-to locations.

Q37. Section M, 3.4.3 – In Section M 3.4.3, evaluation of cylinder refurbishment references the EAD average where there has been no EAD provided for cylinder refurbishment and related items. Can you please provide EAD for cylinder refurbishments per NSN?

A37. Section M, 3.4.3. does not reference EAD. EAD is only utilized to calculate the Total Evaluated Price (TEP) per Section M, 3.8.4. and is for price evaluation purposes only.

Q38. Section L, 6.2 – Section L, Subfactor 2 states that vendors must describe their approach to mitigating price storage risks. We are unfamiliar with the term price storage. Can the Government please define price storage so that vendors can accurately address its risk?

A38. In Section L, 6.2, a comma was inadvertently omitted; it has been updated to read: “…price, storage…”.

Q39. In Section L.9.6 (Throughput Charge), the Government asks for a single percentage to cover the throughput charges that vary with business volumes that are associated with transportation and warehousing charges. After we create the single percentage, will the Government want us to apply that percentage to the fixed unit prices for each CLIN in Attachment 2? Alternatively, would the Government create a separate CLIN for Throughput Charge that would be exercised with each individual order placed during the contract period?

A39. The throughput charge should be provided separately from the unit pricing. Price Evaluation of the offer will be conducted IAW Section M, 3.8.4. At contract award, throughput charges will be systemically applied to all contract line items.

Q40. The specified fill weights for the 8 products below (screenshot) exceed the DOT’s allowable fill weight limitations as per 49 CFR 173.301 (a)(8), specifically concerning the required outage to prevent the cylinder from being liquid full at 55 °C (131 °F). Accurate specifications are critical to the safe transport and handling of hazardous materials. Could the Government please confirm if the PID information provided is accurate, or will these fill weights be updated? Please confirm that you can view the table below.

A40. The PID data has been adjusted for the following items to reflect the current allowable fill weight limits as per 49 CFR 173.301(a)(8).

Q41. Per Attachment 1, Section 6.2E, the "Contractor shall maintain an aggressive customer return program that prevents/limits the number of returns into the DLA depot system". Can the Government please provide the criteria, circumstances, and/or use case from the existing contract that explains why a return from the DLA depot system to the one of Contractor's east or west coast hubs has been necessary? Further, can DLA provide an estimated % of returns that would go to the east vs. west coast hubs from the DLA depot system? Given that DLA is responsible for the logistics costs from DLA depots to the east and west coast hubs, it is important for all bidders to gain a better understanding of what % of returns are from DLA Hubs compared to returns directly from customers so that all bidders can evaluate return logistics costs equally.

A41. OCONUS customers are directed to return cylinders to a DLA depot. The cylinders will be returned through the Stock Transfer Order (STO) process from the applicable depot to contractor. DLA covers the costs of these returns since it is necessary to help maintain a healthy GFP pool. Hub locations are generally determined by the location of the depot where the cylinders are being returned. For example, if cylinders are being returned from DLA Depot Pearl Harbor, Hawaii (DDPH), they will be shipped to the vendor’s West coast hub location.

Q42. Notwithstanding Question [Q41] above, per Attachment 1, Section 7.7.4.1, the Contractor is required to cover the entire cost of return freight and logistics management for CONUS and OCONUS location returns. While we may assume the return rate is 100%, we are at an unfair competitive disadvantage, which does not allow us to accurately calculate an average loss rate for cylinders once shipped to the DLA. We respectfully request that the DLA to provide all bidders with the number of cylinders (by NSN#) that were returned by year from CONUS and OCONUS locations for the past 5 years.

A42. The five-year return history for CONUS and OCONUS is attached.

Q43. Per Amendment 2 Q&A, historical OCONUS orders were 18% of total orders. However, this information does not provide sufficient clarity to accurate price freight - we need a breakdown of how many of these OCONUS orders were shipped to CONUS POEs and CCPs vs. how many were actually shipped by the Contractor to the OCONUS destination. We respectfully request this data to determine how much of OCONUS order demand is being delivered by the Contractor to a CONUS POE or CCP. Additionally, can the Government verify that the Contractor's logistics costs and tracking responsibility end at the CONUS POE or CCP delivery points?

A43. At this point in the current contract, there have been no direct shipments to any OCONUS locations. That said, it is a contractual requirement should that situation occur during this follow-on effort.

Q44. We respectfully request that DLA provide historical data on the overall return rate for cylinders from OCONUS locations. While we anticipate that there is probably some amount of loss of GFP cylinders, it is impossible to accurately account for this cost element without more data. Again, this creates a distinct and unfair disadvantage to non-incumbent bidders. Since the Contractor is responsible for covering 100% of the logistics costs for OCONUS returns, it is necessary that all bidders are provided with sufficient data to understand how much of the cylinder fleet makes it back to the US.

A44. Offerors should assume that all cylinders delivered will need to be picked up. That said, there may also be additional pickups; customers find additional cylinders and/or acquire them from commercial sources.

Q45-A. HFC phasedowns, under the Kigali Amendment to the Montreal Protocol, mandates that Article 2 countries (developed nations) reduce HFC use significantly. These countries began phasedown efforts as early as 2019, with a target of reducing HFC consumption to 15% of baseline levels by 2036. The primary regulatory bodies implementing these HFC reductions include the United States, Canada, the European Union, Japan, Australia, and New Zealand. There are previous DLA awards in 2023 and 2024 that show HFC shipments to Japan and Australia. These countries require allowances to import HFC products. Can the Government provide details and/or clarification for how current HFC shipments are accounting for these individualized HFC import regulations for each country/entity that are independent from the United States AIM Act? Does the DLA have a waiver that would not require the Contractor to have HFC allowances to import into these countries? If not, how does the DLA expect the Contractor to keep itself and DLA in compliance with a multitude of current and future individualized, HFC-import quota requirements?

Q45-B. Our interpretation of the SOW is that the contractor is not responsible for direct shipment to OCONUS locations, rather, the contractor will ship products to DLA CONUS locations, which DLA will then ship to the OCONUS location. Is our interpretation correct? If not, please provide greater details on management of the import/export workflow for OCONUS shipments?”

A45-A&B. OCONUS shipments (to include orders for HFCs) flow through the DLA Transportation system for final delivery to the end customer. To date, there have not been any direct deliveries to OCONUS customers. However, per SOW Section 7.7.4.1, the contractor must be prepared should requirements develop for direct OCONUS shipments. DLA has established Mission Critical Military End Use (MCMEU) NSNs for units authorized to receive HFC gas allowances. Non-MCMEU NSNs support will follow the American Innovation and Manufacturing (AIM) Act requirements.

Q46. 3M f/k/a Scott Technologies is the sole manufacturer of NIIN 016064638 and they have communicated that they refuse to sell it to anyone other than fire departments or the federal government directly. They will not give us a price or a written quote. We are confident we can work this out with the supplier prior to contract award with support from DLA. However, it is unlikely to be resolved prior to the proposal due date. How does DLA recommend bidders account for these isolated cases, in order to be compliant with Section L, 9.2.2, which states that we must provide a copy of a written quote or invoice at time of bid submission?

A46. This item has been removed from the requirement.

Q47. Norris Cylinder has informed us they no longer manufacture 8120-005370574 Oxygen Aviators breathing air cylinder and they are not aware of any other manufacturer of this cylinder. We are diligently continuing to source this item, however, if there is not a DOT certified manufacturer of this item anywhere in the US or World, how should bidders submit pricing for this item?

A47. This item has been removed from the contract.

Q48. For OCONUS shipments for which the contractor is responsible, what percentage would require utilizing air freight? Having historic data on this breakdown is necessary in estimating freight costs for which the Contractor would be responsible. The incumbent is the only party that has an understanding of this factor.

A48. To date, there have been no direct shipments to OCONUS locations under the current contract. Thus, there is no historical OCONUS air freight data to provide.

Q49. Based on our list of questions, there are a number of answers that directly impact our bid. Please consider an extension to the proposal deadline that would enable the Government to fully and completely answer these questions and give vendors time to adjust their proposals accordingly, thereby ensuring a level playing field for all bidders. We suggest that the deadline by extended two weeks from the time that the Government provides full and complete answers to all questions.

A49. Solicitation amendment 0003 extended the solicitation closing date from November 7, 2024, to December 6, 2024.

Q50. Could the Government please provide a volume report from your current supplier with their Part Numbers and annual volume? (If the Government has that correlated to NSNs that would be great, but current Part numbers are really necessary for us to provide a good quotation.)

A50. The USG requirement for this solicitation are the NSNs listed in Attachment 2, not vendor-specific part numbers. With regard to order volume, a procurement history report has been attached to this amendment to supplement the provided Estimated Annual Demand data for each NSN.
