Justification for an Exception to Fair Opportunity (JEFO)

This document is a JEFO submitted by the Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, supporting Solicitation SPE2D1-15-R-0001 and Contract SPE2D1-17-D-0002. The acquisition requires ten (10) NSN 6525017226464 Anesthesia Acute Care Configuration point-of-care ultrasound systems for the USNS Mercy (T-AH-19) hospital ship. The systems will provide bedside maneuverability in crowded trauma bays and operating rooms. The delivery order will be issued under the basic Long-Term contract SPE2D1-17-D-0002 (valid through October 31, 2026) and administratively processed through ECAT Contract SPE2D117D7001. Unit price is $50,826.27 per system for a total acquisition value of $508,262.70.

The contracting officer justified the single-source procurement under FAR 16.507-6(b)(2) (DOD Class Deviation 2026-O0045, March 2026), citing that only one awardee is capable of providing the required supplies at the necessary quality level because the supplies are unique and highly specialized. Market research confirmed that only the Sonosite Anesthesia Acute Care Configuration Ultrasound meets all Government minimum requirements, with the key discriminator being the mandatory requirement for listing on the Naval Operating Forces' Authorized Medical Allowance List (AMAL). Additional critical requirements include on-device Artificial Intelligence for clinical decision-making, Voice Assist options for maintaining sterile fields during anesthesia procedures, and compact system design. Competing systems from other vendors fail to meet these essential requirements, particularly the AMAL listing and Voice Assist features. Contract pricing was previously determined fair and reasonable through commercial pricing comparison. The contracting officer certified the justification's accuracy and completeness.

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (JEFO)

SOLICITATION: SPE2D1-15-R-0001

CONTRACT: SPE2D1-17-D-0002

(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment

Division, is the contracting activity.

(2) The action submitted for approval is a JEFO supporting the acquisition Ten (10) NSN 6525017226464 Anesthesia Acute Care Configuration of ten (10) point-of-care ultrasound systems. The ultrasound systems will be used for bedside maneuverability in crowded trauma bays and operating rooms aboard the USNS Mercy (T-AH-19). In support of this acquisition, the order will be placed under basic Long-Term contract SPE2D1-17-D-0002 which is valid through October 31, 2026. For ordering purposes, this delivery order will be issued under

Administrative DLA Electronic Catalog System (ECAT) Contract SPE2D117D7001 This JEFO will allow an order to be placed against. This JEFO will allow an order to be placed against without following the fair opportunity process.

(3) Description: NSN 6525017226464 PX Anesthesia Acute Care Configuration ultrasound

Unit Price: $50,826.27

Quantity: 10

Total dollar value of this action: $508,262.70.

(4) The authority for waiving the fair opportunity requirements is Revolutionary FAR Overhaul (RFO)

FAR 16.507-6(b)(2) (as implemented by DOD Class Deviation 2026-O0045 (MAR 2026) only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

Market research confirms that only one product, the point-of-care ultrasound system manufactured by , can meet all of the Government's minimum requirements. The key discriminator is the mandatory requirement for the system to be listed on the Naval Operating Forces’ Authorized Medical Allowance List (AMAL).

Page | 2

USNS Mercy has a requirement to procure ten (10) point of care ultrasound systems. The primary and

a) critical requirements include:

b) Listing on the Naval Operating Forces’ Authorized Medical Allowance List (AMAL).

c) On-device Artificial Intelligence (AI) to accelerate bedside clinical decision-making.

d) Voice Assist options that respond to voice commands for maintaining a sterile field

e) during anesthesia procedures and nerve blocks.

f) Compact system for bedside maneuverability in crowded trauma bays and operating

g) rooms.

The Anesthesia Acute Care Configuration Ultrasound meets all requirements, including the following:

a) It is listed on the Naval Operating Forces’ Authorized Medical Allowance List (AMAL).

b) It has on-device Artificial Intelligence (AI) to accelerate bedside clinical decision-making.

c) It includes Voice Assist options that respond to voice commands for maintaining a sterile field.

d) It is a compact system designed for bedside maneuverability.

Market research identified as other providers of point-of-care ultrasound systems. However, these systems fail to meet the Government’s critical needs. All three competing systems fail the primary requirement, as none are listed on the AMAL. Furthermore, the systems from also lack the required Voice Assist features. This makes them unsuitable for the operational environment and fails to meet the Government's mandatory requirements to ensure compliance and functionality for the USNS Mercy.

Therefore, is the only source capable of providing a system that satisfies all of the Government's essential technical and functional requirements.

(5) The contract pricing on ECAT Contract SPE2D1-17-D-0002 has previously been determined fair and reasonable via comparison with commercial pricing and data other than certified cost or pricing data. The undersigned contracting officer has determined that the anticipated cost to the Government will be fair and reasonable.

(6) Market research was conducted to identify commercially available point-of-care ultrasound systems.

This research confirmed that while multiple vendors manufacture these systems, only Anesthesia Acute Care Configuration Ultrasound produces a system with the unique combination of being listed on the AMAL while also meeting the technical requirements for AI and Voice Assist.

Direct comparison with offerings from confirmed that their systems do not meet this critical compliance requirement. This makes Sonosite the only identified source capable of meeting the agency's needs.

(7) In an effort to remove barriers to fair opportunity on subsequent acquisitions, DLA will continue to perform market research to locate other sources for any future procurements of point-of-care

Source Selection Information - FAR 2.101 and 3.104 ultrasound systems. Furthermore, DLA Troop Support will continue to monitor the market. The results of the current market research indicate Sonosite is the only known vendor that can meet the requirements of the USNS Mercy.

(8) As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief.
