The Parata Max 2 robots will replace end-of-life units, and the pricing has been determined fair and reasonable. The Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain is the contracting activity and will continue market research to identify potential future sources.

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (JEFO)

Parata Max 2 Vial Filling Robots

1. Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.

2. The action submitted for approval is for the acquisition of five (5) Parata Max 2 Vial Filling Robots required by four (4) pharmacies at the following Defense Health Agency (DHA) Military Treatment Facilities (MTFs): Naval Medical Center San Diego (NMCSD) (2), Ft. Liberty Womack Army Medical Center (WAMC) (1), Ft. Liberty Robinson (1), and Ft. Liberty Clark (1). In support of this acquisition, an order will be placed under Parata Systems Patient Monitoring and Capital Equipment (PMCE) contract SPE2D1-22-D-0009, valid through April 1, 2027.

3. This acquisition is for the purchase of a total of five (5) Parata Max 2 Robots.

4. The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(B) and FAR 16.505(a)(4)(i), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. Brand-name Parata is essential to the Government’s requirements, and market research indicates other companies’ similar products and services do not meet and cannot be modified to meet the Government’s needs.

5. The use of this authority is necessary because four (4) locations: Naval Medical Center San

Diego (NMCSD), Ft. Liberty Womack Army Medical Center (WAMC), Ft. Liberty Robinson, and Ft. Liberty Clark have a requirement to replace end-of-life units. The generation one units being replaced are reaching end of life and will no longer be maintained and serviced. This update is needed to maintain the systems Authority to Operate There are ten (10) Parata Max 2, three (3) Parata Mini’s, two (2) Parata Servers, and three (3) Parata AIM Server Systems that will remain and not be replaced within the identified locations. The items to be acquired must be compatible with the existing equipment and with the central server or central automation interface module (AIM).” Parata Max 2 and Parata Mini Vial Filling Robots are complete vial filling automation that can count, label, cap, sort, and dispense oral dosage form medications.

Only Parata (automation) robots can connect to the Parata Workflow system software currently in use at the MTFs. To ensure prescriptions are properly processed and dispensed, each robot must be connected and integrated with the central Parata server/AIM system. This integration is necessary for the automation to receive the requisite personal health information from the Electronic Health Record, MHS GENESIS, to process the prescription. Without this integration the Parata Max units would not have the necessary information to count or label the prescription safely and in accordance with federal prescription labeling laws.

Only one source, Parata, can provide the required equipment capable of connecting to the existing AIM Server System. The AIM server system is a centralized server that contains all data and business logic, to operate the Max 2 robots, which can be accessed both on site and remotely. The equipment required by the Pharmacy Departments at the four (4) identified locations is only available from Parata Systems.

Parata Systems is the only company on the market providing dispensing Units that are compatible with the current Central Server or Central Automation Interface Module (AIM).

Only the Parata Systems Max 2 robots can interface and are compatible with the AIM server.

6. The Max 2 robots are available on Parata’s PMCE contract SPE2D1-22-D-0009. The contract pricing has previously been determined as fair and reasonable via comparison with commercial pricing, the subject procurement represents the best value to the Government.

7. There are no other facts supporting the use of this JEFO.

8. In an effort to overcome barriers to fair opportunity on subsequent acquisitions, DLA will continue to perform market research to locate other sources for any future procurements of pharmacy automated cabinets. Current vendors in the PMCE program have the opportunity to add new products that fall within scope of the contract at any time throughout the year, enhancing competition for future acquisitions. Furthermore, DLA Troop Support will continue to monitor the market. In the event that another vendor outside of the PMCE program offers systems technology which are compatible with the customers’ requirements, DLA Troop Support will encourage any such vendor/manufacturer to seek a contract under the PMCE program.
