SOURCE SELECTION INFORMATION – SEE FAR 2.101 AND 3.104

FOR OFFICAL USE ONLY

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (JEFO)

INNOVATION ASSOCIATES INC.

CONTRACT SPE2D1-19-D-0017

1. Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, is the contracting activity.

2. This sole source justification is for the purchase of extended warranty maintenance coverage for automated pharmacy dispensing equipment on a sole source basis.

3. The required extended warranty maintenance coverage is for Innovation Associates, Inc.

(hereinafter referred to as “Innovation”) PharmASSIST Pharmacy Automation Dispensing System equipment installed at 75 Air Force Medical Treatment Facilities (MTFs). This purchase of extended warranty maintenance coverage is available on Innovation’s Patient Monitoring & Capital Equipment (PMCE) contract, SPE2D1-19-D-0017, which expires July 22, 2024 and if the option is exercised, would end July 22, 2029.

4. The authority waiving the competition requirements is FAR 16.505(b)(2)(i)(b), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

The PharmASSIST system is an automated medication dispensing system for oral and solid medications with linked and computerized quality assurance software. The PharmASSIST system is integrated with the Composite Health Care System (CHCS) using digital imagery and bar code technology incorporated into the entire paperless prescription filling process. The linked quality assurance software with digital images of medications provides a significant safety measure by verifying accuracy for all prescriptions filled at various CHCS-hosted pharmacy sites against the original scanned hard copy prescription.

Innovation is the only source for the maintenance services required on the PharmASSIST units because they are the original equipment manufacturer with the sole proprietary license for the operating software. The annual extended warranty maintenance coverage provided by Innovation consists of equipment repair and software updates. This requirement is essential and critical to the continuing functionality of all Air Force MTFs. Repairs of the PharmASSIST equipment often require interaction with the PharmASSIST proprietary operating software. No other entity is authorized to perform service on the PharmASSIST equipment other than Innovation.

5. DLA Troop Support has already determined the price of the PharmASSIST extended warranty maintenance coverage from Innovation to be fair and reasonable

This order represents the best value to the Government and results in the lowest overall cost alternative (considering price, special features and administrative cost.)

SOURCE SELECTION INFORMATION – SEE FAR 2.101 AND 3.104

FOR OFFICAL USE ONLY

6. Market research performed by DLA Troop Support has continually been conducted during the Electronic Catalog (ECAT) Program and PMCE acquisition planning from September 2013 through the present. The market research confirmed that Innovation possesses the sole ability to update the proprietary operating software for the PharmASSIST system and there are no other sources able to supply the extended warranty maintenance coverage.

7. There are no additional facts supporting this justification.

8. PMCE vendors have the opportunity to add products that fall within the scope of the PMCE solicitation at any time; however, currently there are no other known PMCE vendors that would be able to offer the extended warranty maintenance coverage for an existing PharmASSIST Pharmacy Automation Dispensing System.

9. As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief.
