About this file
This is a Justification for an Exception to Fair Opportunity (JEFO) document submitted by the Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, in support of Solicitation SPE2D1-15-R-0001 and Contract SPE2D1-20-D-0007. The JEFO authorizes a single-source procurement without conducting a competitive fair opportunity process.
The acquisition concerns a Nuclear Medicine Gamma Camera—specifically a Dedicated Cardiac Single Photon Emission Computed Tomography (D-SPECT) camera—for cardiac imaging at Portsmouth Naval Medical Center. The equipment will be used for nuclear cardiac stress test imaging of patients and beneficiaries. The order will be placed under basic Long-Term Contract (LTC) SPE2D1-20-D-0007, valid through June 13, 2029. The exception to fair opportunity is justified under FAR 16.507-6(b)(2) on the grounds that only one awardee is capable of providing supplies or services of the required quality because they are unique or highly specialized. Critical technical requirements include a Cadmium Zinc Telluride (CZT)-based imaging system with parallel hole detector collimation, imaging capability in seated upright and supine positions, reduced acquisition time up to two minutes, elimination of the need for CT acquisition for attenuation correction, open gantry design with compact footprint to fit existing facility space, and accommodation for patients with mobility and weight restrictions. Market research confirmed that only one vendor produces a system meeting all mandatory requirements, particularly the ability to image patients in seated positions while accommodating patients with physical limitations. Contract pricing has been previously determined fair and reasonable through comparison with commercial pricing. The contracting officer has certified that the anticipated cost to the Government will be fair and reasonable.

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY (JEFO)
SOLICITATION: SPE2D1-15-R-0001
CONTRACT: SPE2D1-20-D-0007
(1) Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.
(2) The action submitted for approval is a JEFO supporting the acquisition of Nuclear Medicine Gamma Camera;
specifically, Dedicated Cardiac Single Photon Emission Computed Tomography camera (D-SPECT) for cardiac imaging. The gamma camera will be used for nuclear cardiac stress test imaging of patients and beneficiaries of Portsmouth Naval Medical Center. In support of this acquisition, the order will be placed under basic Long-Term Contract (LTC) SPE2D1-20-D-0007, which is valid through June 13th, 2029.
The Nuclear medicine D-SPECT gamma camara provided by is the only product that meets all requirements under Contract SPE2D1-20-D-0007. This JEFO will allow an order to be placed against contract without following the fair opportunity process.
(3) The total estimated dollar value of this action is
(4) The exception to fair opportunity is justified under the authority of FAR 16.507-6(b)(2): Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. Portsmouth Naval Medical Center has a requirement for a Nuclear Medicine Gamma Camera for cardiac imaging as their current system has reached end of life.
The primary and most critical requirements include:
o A Nuclear Medicine Gamma Camera that performs Cardiology imaging.
o Cadmium Zinc Telluride (CZT) based imaging system with parallel hole detector collimation o The ability to have higher sensitivity and energy resolution specification than conventional SPECT cameras.
o Reduced acquisition time up to 2 minutes to achieve increased throughput and access-to-care to patients.
o Eliminates the need for CT acquisition for attenuation correction which significantly decreases the radiation exposure to patients.
o Must imagine patients in a seated position.
o Must have the flexibility to image patients seated in both upright and supine positions o Allow patients with mobility restrictions as well as weight limitations to undergo imaging comfortably.
o Reduces footprint of the camera to fit in the existing cardiac stress test room without extensive remodeling o Must have an open gantry design.
o Must eliminate acquisition collision, pinch points or claustrophobia caused by enclosed space of the camera’s gantry aperture.

c. Patient Imaging Position:
It allows for imaging in both upright and supine seated positions, accommodating patients with varied physical needs.
o Must have the flexibility to image patients seated in both upright and supine positions o Allow patients with mobility restrictions as well as weight limitations to undergo imaging comfortably.
o Reduces footprint of the camera to fit in the existing cardiac stress test room without extensive remodeling
d. Gantry: Must have open gantry design and compact footprint meet the facility and patient safety requirements provides a Nuclear Medicine Gamma Camera for cardiac imaging, however, it cannot meet all minimum requirements:
• meets the requirement to provide a Gamma Camera that performs Cardiology imaging.
• meets the requirement to provide Cadmium Zinc Telluride (CZT) based imaging system.
• oes not meet the requirement to image patients in a seated position. unit is attached to a bed which hinders patients with mobility restrictions as well as weight limitations.
• meets the requirement to have an open gantry system.
(5) The contract pricing on ECAT Contract SPE2D1-20-D-0007 has previously been determined fair and reasonable via comparison with commercial pricing and data other than certified cost or pricing data. The undersigned contracting officer has determined that the anticipated cost to the Government will be fair and reasonable.
(6) Market research was conducted to identify commercially available Nuclear Medicine Gamma Cameras. This research, detailed in the attached memorandum, confirmed that while multiple vendors manufacture gamma cameras, only produces a system with a unique combination of CZT detectors and one of the minimum requirements that no other vendor can meet. The D-SPECT Cardio 8010120-01 is the only gamma camera system that has the ability to image patients in a seated position in both upright and supine positions; allows patients with mobility restrictions as well as weight limitations to undergo imaging comfortably; and reduces footprint of the camera to fit in the existing cardiac stress test room without extensive remodeling thus can accommodate patients with mobility restrictions as well as weight limitations.
Page | 3 as another provider of CZT-based nuclear medicine cameras. However, the fails to meet all minimum requirements. While is a CZT-based system with an open gantry, it is integrated with a bed and cannot image patients in a seated position. This design limitation makes it unsuitable for patients with mobility or weight restrictions, failing to meet the Government's mandatory requirement to ensure access for all patient beneficiaries at NMC Portsmouth. A direct comparison with offerings confirmed that system does not meet this critical functional requirement.
Therefore, is the only source capable of providing a system that satisfies all of the Government's essential technical and functional requirements.
(7) In an effort to remove barriers to fair opportunity on subsequent acquisitions, DLA will continue to perform market research to locate other sources for any future procurements of Nuclear Medicine Gamma Camera. Furthermore, DLA Troop Support will continue to monitor the market. The results of the current market research indicate is the only known vendor that can meet the requirements of the Portsmouth Naval Medical Center.
(8) As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief.
