4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(l), FAR Part 6.302-1 - Only One Responsible Source and No Other Supplies Will Satisfy Agency Requirements.

5. The use of this authority is necessary because Gentex Corporation (CAGE code 97427) owns the technical data rights and is the only known firm that has the technical capability, equipment and expertise to manufacture the 68/P Flyer's Helmet, 84/P Flyer's Helmet and associated components that meet the operational and safety requirements of the Navy and Marines Corps.

There are no Government owned specifications available; therefore, the Government does not possess the requisite technical data to solicit for competitive offers or to evaluate alternate proposals. Only Gentex Corporation owns the approved design data for these items that meet the Services' requirements for crew safety. Gentex originally funded the 68/P helmet development, while the development of the HGU-84/P was initially funded by the Navy over 20 years ago;

however, Gentex has invested their own funds into manufacturing tools and updating all the engineering drawings as the requirement for the Navy has been revised. Gentex, therefore, is the owner of all of the current revisions of the engineering drawings and qualification tests for both the 68/P Flyer's Helmet and 84/P Flyer's Helmet and associated components.

The HGU-68/P Tactical Air Helmet was designed by Gentex Corporation to meet the rigorous requirements of the U.S. Navy and U.S. Marines Corps in today's high-G environment. It incorporates advanced technology to provide improved helmet comfort, stability, retention and protection for aircrew personnel. This helmet is worn by aircrew members on all tactical fixed-wing aircraft (with ejection seats). The helmet is equipped with a single visor system that qualifies at 600 Knots Equivalent Airspeed (KEAS) in case of ejection in accordance with MIL-H-85047A and offers a cut-back frontal opening at the temple region to provide maximum peripheral vision. This helmet is designed to provide face, eye, aural, and head protection when properly assembled and fitted to the aircrew member. The helmet assemblies also house the communications components, allow for the use of the visor assembly or Night Vision Image Intensifier Set, and integrate with the MBU-21/P CBR Mask.

The HGU-84/P Rotary Wing Helmet was also developed by Gentex to meet the rigorous requirements of the U.S. Navy and U.S. Marines Corps. It has a dual visor helmet assembly integrating the latest advances in technology to provide superior protection, stability, retention and comfort in a lightweight, low-profile design. This helmet is worn by aircrew-members for rotary wing aircraft (i.e. helicopters or non-ejection type aircraft). Made of rigid Graphlon® this composite styrofoam energy absorbing liner is the primary impact attenuation medium and the custom liner - the ThermoPlastic Liner (TPL®) provides an easy, lightweight and comfortable fit. All of this provides face, eye, ear, and head protection, and also houses the communications ...,../ components, earphones, radio frequency cable assembly and a boom swivel mount for installation of a boom microphone. It also allows for various type visor assemblies (clear, neutral, special purpose) to easily attach or remove , depending on the conditions and requirements for each type visor. A major component of this helmet is the earcup assembly, which provides sound attenuation.

In summary, each helmet type is designed to meet the specific requirements for the type of aircraft on which it is used (fixed wing or rotary wing), along with impact protection, the type of aircraft communications equipment and capability to mount visors for glare protection or day or night operations. There are no other known helmet designs that meet the requirements necessary to operate the U.S. Navy and U.S. Marine Corps fixed wing or rotary wing aircraft.

6. The proposed procurement will be synopsized in Federal Business Opportunities (FedBizOpps) pending approval of the subject Justification & Approval. In addition, this justification will be made available for public inspection, along with the solicitation, in accordance with FAR 6.305(c).

7. As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on acceptable, contractor-submitted, certified cost and pricing data.

8. Market Research included the synopsis of the proposed procurement on January 13, 2017.

Gentex Corporation was the only firm to express an interest in this acquisition. A Sources Sought Notice (SSN) was issued in FedBizOpps on January 3, 2017 and closed on February 3, 2017 and no other firms expressed interest in the proposed acquisition. A search of the Internet also provided no other manufacturing sources for this type item other than Gentex Corp. The Warrior Protection & Readiness Coalition, comprised of leading tactical equipment, apparel, materials, and technology companies, was contacted and suggested contacting Revision Military, a leading manufacturer of Ground Troops Helmets. Revision Military representative stated that the manufacturing processm, aterials, and technical knowledge from Ground Troop to Flight Helmets is different, they do not manufacture Flight Helmets, and it would be a significant investment for them to move into that area with no guaranteed contract or financial return.

9. There are no additional facts supporting the use of other than full and open competition.

10. Only Gentex Corporation has expressed interest in the subject acquisition .

11. DLA Troop Support issued an SSN and no firm, other than Gentex Corporation, has expressed interest in this requirement or indicated that they can produce an alternate item.

In an effort to break out these sole source helmets for competition, the Executive Director, Troop Support Contracting and Acquisition Management sent a letter to the Aircrew Systems PMA202 Program Manager, Lexington Park, MD on February 5, 2018 to develop a technical data package to make this item fully competitive for future acquisitions. If no response is received from the Navy Engineering Support Activity (ESA) within 60-days of the date of the letter to the ESA, the Contracting Office will advise Clothing and Textile Supply Chain upper level management who will initiate a follow-up with the ESA. Should an agreed-upon timeline be established, follow-up with the ESA will be made every 30-days thereafter to ensure progress is being made. Lack of progress according to the established milestones or failure to provide milestones to the /

Contracting Office will k--cause to elevate the matter up to the Tr p Support Executive Director of Contracting and Acquisition Management for further action. A monthly progress report is to be furnished to the DLA Troop Support Competition Advocate.

12. As the Contracting Officer, I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
