4. The applicable statutory authority permitting Other than Full and Open Competition is 10

USC 2304(c)(l), as implemented by FAR 6.302-1 - Only One Responsible Source.

5. The use of this authority is necessary because Gentex Corporation (Cage Code 97427) is the only firm that manufactures these helmet/visor systems. These items have a proprietary Gentex design for which the Government does not possess complete unrestricted technical data. The Government does not have in its possession sufficient, accurate or legible data required to solicit under full and open competitive procedures. Only Gentex Corporation has the necessary design data to ensure that these items will meet the safety requirements of the Air Force and the Air Force is the only activity that can evaluate alternate proposals. At this time, there are no other known contractors that make a hel met/visor system that meets the safety or design requirements of the Air Force.

For this acquisition, DLA Troop Support is purchasing both the HGU-55/P Lightweight Helmet with Standard MBU-20/P Visor and the HGU-55/P Lightweight Helmet with High Speed MBU- 20/P Visor. The Gentex HGU-55/P Lightweight Helmet with MBU-20/P Visors was created to meet the challenging demands of a High-G Environment. The Standard Visors must successfully pass 450 knot equivalent air speed windblast testing and the High Speed Visors have special guides attached to each side of the visor and have different strap arrangements that attach the visor to the helmet. The High Speed MBU-20/P must successfully pass 600 knot equivalent air speed windblast testing.

6. The proposed procurement was synopsized in Federal Business Opportunities (FedBizOpps) on

November 3, 2014. A Sources Sought Notice was issued in FedBizOpps on October 21, 2014 with a response date of November 21, 2014. In addition, this justification will be made available for public inspection, along with the solicitation, in accordance with FAR 6.305(c).

7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on acceptable, contractor-submitted, ce1iified cost and pricing data.

8. Market research included the synopsis of the proposed procurement on November 3, 2014.

No new firms responded to the synopsis. A Sources Sought Notice was issued in FedBizOpps on October 21, 2014 with a response date of November 21, 2014. No firms responded to the Sources Sought Notice.

9. There are no additional facts supporting the use of other than full and open competition.

10. Only Gentex Corporation has expressed an interest in the subject requirement.

11. Should a contractor express an interest in supplying the required helmet systems or an alternative helmet system, they will be directed to the Air Force Engineering Support Activity for evaluation.
