DEFENSE LOGISTICS AGENCY

DLA CONTRACTING SERVICES OFFICE -

PHILADELPHIA 700 ROBBINS AVENUE

PHILADELPHIA, PENNSYLVANIA 19111-5092

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

(FAR 16.505(a)(4) and FAR 16.505(b)(2))

Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using an exception to fair opportunity, pursuant to the authority cited herein.

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:

Requiring Activity:

DLA Information Operations (J62) 8725 John J. Kingman Road Fort Belvoir, Virginia 22060-6221 POC: Tara-Shea Newsome Phone: 703-681-2369 Email: Tara-Shea.Newsome@dla.mil

Contracting Activity:

DLA Contracting Service Office- Philadelphia 700 Robbins Avenue Philadelphia, Pennsylvania 19111-5092 POC: Valarie Palumbo Phone: 215-737-7055 Email: Valarie.Palumbo@dla.mil

2. NATURE AND DESCRIPTION OF THE ACTION BEING APPROVED:

Pursuant to FAR 16.505(a)(4) and FAR 16.505(b)(2), the action being approved is an exception to fair opportunity. This justification authorizes the use of other than full and open competition to add a Firm Fixed Price Optional CLIN for increased scope of development efforts on Task Order No. SP4709-18-F-0100 for FedMall Sustainment Support, which was awarded on a competitive basis to U.S. Information Technologies Corporation (USIT) on July 21, 2018. The task order was placed against USIT’s J6 Enterprise Technology Services (JETS) Indefinite-Delivery Indefinite-Quantity (IDIQ) contract, SP4709-17D-0030. The increased scope of development efforts is detailed in Section 3 below.

3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO

MEET THE AGENCY’S NEEDS/ESTIMATED DOLLAR AMOUNT:

Requirements discussions with the contractor and FedMall Stakeholders post contract award resulted in the need for additional development that was not envisioned at the time development funds were originally committed for competitive award of the task order cited above, back on April 25, 2018. Due to the lead-time required to get capital funds committed, the program office based the requirements for the award on the March Operational Requirements Committee (ORC) meeting outcome. Further discussions of these requirements with the Contractor, and the ORC meeting held August 2018 subsequent contract award, resulted in new derived requirements and additional capabilities related to Federal/DoD compliance, auditability of financial transactions, interoperability, system performance and added ordering capabilities based on current application, being identified. Specifically:

• Advanced Order Management

• National Stock Number (NSN) data quality and compliance

• Integration with additional business systems to include but not limited to Wide Area

Work Flow (WAWF), Past Performance Information Retrieval System (PPIRS), Purchase Card Online System (PCOLS, IBEX), and Clause Logic

• Funds Verification Approved DLMS Change (ADC) 1068B

• Federal Procurement Data System - Next Generation (FPDS-NG) version upgrades and error handling, file correction and resubmission

• Procurement Data Standard (PDS) version support and upgrades

• Usability to include but not limited to: Improved Search, Display prices in foreign currencies, enhanced communication between buyers and sellers

• User Account Management

• Supplier Catalog review and approval by Supplier Account Managers and KOs

• Agile development with concurrent testing

• Correct all compliance issues identified by Cybersecurity or security reviews

Period of Performance: Time of Award – July 20, 2019 The estimated dollar value for this requirement is $2,015,923.95.

4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY (SEE FAR

16.505(a)(4) and FAR 16.505(b)(2)) AND THE SUPPORTING RATIONALE, INCLUDING

A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF

THE EXCEPTION CITED:

Per FAR 16.505(a)(4) and FAR 16.505(b)(2)(i)(B) an exception to the fair opportunity process is justified because only one source is capable of providing the services required in the timeframes required and at the level of quality required because the services are unique and highly specialized. At this time, USIT is the best source capable of providing the required services to support the system through additional stages of development in order to meet mission requirements and timelines. The current task order supports sustainment and development services vice two separate actions, given the need for consistency in configuration management of the application and development techniques for managing versions of the application code.

DLA is required to address audit items and remediate the findings within assessments windows.

The new assessment window for some FedMall audit items begins in January 2019. There are also compliance updates related to FPDS-NG version upgrades in December 2018, which are mandatory in order to comply with reporting our transaction to GSA. It would not be feasible to compete the additional development on a separate acquisition, and the current contract scope allows for the same services.

Given the time it takes to solicit the requirement, evaluate the proposals received, and make an award, doing so would significantly delay stakeholder and compliance adherence schedules. In addition to the audit and compliance issues to be addressed, users will continue to experience inefficiencies by having to use additional systems to research their orders or complete orders offline, which are not auditable. DLA also will risk losing additional sales, which allow the agency to operate in times of government shutdown.

Additionally, the introduction of a different contractor would present cost, schedule, and performance risks, which would jeopardize the Government’s ability to meet immediate compliance deadlines. USIT has the requisite experience with the modules and business processes within FedMall as the previous vendor for DoD EMALL, FedMall’s legacy system.

This expertise and corporate knowledge of the customized utilities in FedMall will enable the vendor to meet DLA’s timelines for development for audit assessment and/or mandatory compliance updates. The additional onboarding time required for new system integration support would also put our delivery at risk given that the process takes 30-60 days to complete an entire team. Therefore, only USIT is capable of providing the immediate services required at the level of quality needed and within the necessary timeline.

5. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE:

Proposals will be analyzed in accordance with FAR 15.404-1 procedures. It is anticipated that the Government will use various price analysis techniques including, but not limited to (1) Comparison with competitive price lists in accordance with FAR 15.404-1(b)(2)(iv); (2) Comparison with Independent Government Cost Estimate (FAR 15.404-1(b)(2)(v)); and/or (3) Comparison of proposed prices obtained through market research for the same or similar items in order to obtain a fair and reasonable price in accordance with FAR 15.404-1(b)(2)(vi).

6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:

All facts are provided herein.

7. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE EXCEPTION TO

FAIR OPPORUNITY BEFORE ANY SUBSEQUENT ACQUISITION FOR THE

SUPPLIES OR SERVICES IS MADE:

This sole source action is only needed until such time as a new FedMall competitive acquisition is awarded to support future sustainment and development of the FedMall application. To that end, the PMO anticipates competing the current task order before all available options expire on October 20, 2020.
