DEFENSE LOGISTICS AGENCY
DLA CONTRACTING SERVICES OFFICE - PHILADELPHIA
700 ROBBINS AVENUE
PHILADELPHIA, PENNSYLVANIA 19111-5092
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using an exception to fair opportunity, pursuant to the authority cited herein.
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:
Agencies Requiring Activity:
DLA/J63 Client Support and Readiness 74 Washington Ave N, Battle Creek MI 49017
Contracting Activity:
DLA Contracting Service Office - Philadelphia 700 Robbins Avenue Philadelphia, PA 19111-5092
2. NATURE AND DESCRIPTION OF THE ACTION BEING APPROVED:
Pursuant FAR 16.505(b)(2)(i)(B), the action being approved is an exception to fair opportunity. This justification authorizes the use of other than full and open competition to award a Firm-Fixed Price task order to acquire Technology Refresh Surge Support for DLA users/customers. This service/support will be focused on the DLA users that are located in Susquehanna, PA; Warner Robins, GA; Cherry Point, NC; Aniston/Huntsville, AL; Norfolk, VA; Albany, GA; Richmond, VA; National Capital Region (NCR); and Barstow, CA. The acquisition will be a sole source award under the J6 Enterprise Technology Services (JETS) contract vehicle.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO
MEET THE AGENCY’S NEEDS/ESTIMATED DOLLAR AMOUNT:
The Agency has a requirement for a Technology Refresh Surge Support to all DLA users/customers at multiple site locations. The scope of this effort is to provide Windows 10 and Virtual Desktop Initiative (VDI) technology refresh surge support for users of DLA information systems. The required surge support is a 100% refresh of all information systems to include Zero Clients (VDI), Thin Clients (Windows 10 and VDI environment) and Thick Clients (Windows 10) on the Non-Classified Internet Protocol Routing Network (NIPRNET) for the users listed at the sites in section 2. This effort is necessary to achieve commonality of function and administration across the DLA network.
The period of performance of 3/2/2017 – 4/30/2017.
4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY (SEE FAR
16.505(a)(4) and FAR 16.505(b)(2)) AND THE SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S
UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION
REQUIRES USE OF THE EXCEPTION CITED:
Per FAR 16.505(b)(2)(i)(B), an exception to the fair opportunity process is justified because only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
The DoD CIO Memorandum and Deputy Secretary of Defense Memorandum followed by Task Order 16-0043 directed DoD agencies to complete a rapid deployment and transition of Microsoft Window 10 Secure Host Baseline. This will strengthen the cyber security posture while concurrently streamline the IT operational environment. With this guidance, the DLA J6 CIO mandated a deadline of April 30, 2017 as directed in the 2017 J6 Annual Operating Plan.
This new requirement of Windows 10 and VDI is required to ensure a secure DLA network.
Horizon Industries (Horizon) is knowledgeable of the DLA Windows 10 and VDI platforms and has knowledge of the DLA enterprise network as they hold contracts for End User Support in DLA HQ NCR, DLA Oklahoma City, and DLA Battle Creek facilities. Horizon also provides services to CONUS Distribution sites to include the sites listed in section 2.
Horizon Industries understands the Windows 10 and VDI development, testing and complexity of this initiative. With Horizon providing support to three of the larger DLA facilities and multiple Distribution sites, there is no other vendor that has the knowledge or capabilities to support this requirement in the timeline required to meet the mission.
Failure to award this action to Horizon Industries would cause a critical mission impact consisting of enterprise network vulnerabilities and information security concerns for the users at locations requiring this support. Having a multi-platform operating system (Windows 7, Windows 10 and VDI) creates a vulnerable network that is difficult to secure and manage.
VDI is the most secure platform but will not work for all customers. Windows 10, which is mandated by DISA, provides a more secure and manageable platform than Windows 7, which is coming to its end of life. Without converting these sites to the new Windows 10/VDI environment, there will exist a security vulnerability to the entire DLA information systems and enterprise network.
A vendor that is unfamiliar with the DLA network and infrastructure would need 30 to 45 days of standard transition lead-time before they could be at full performance status. Within this transition period, the Project Manager and Lead End User Support technician would meet with incumbent and government staff to get familiar with DLA Standard Operating Procedures, Network Topology, Network Security Measures and a detailed scope of the project along with staffing qualified Technicians with adequate DoD 8570 IAT-II credentials.
Horizon has this knowledge and can start this requirement with little to no lead time to support the April 30th, 2017 deadline and meet the DoD compliance requirement.
In other regions, DLA has modified existing contracts to handle the technology refresh surge support for Windows 10 and VDI migration. This acquisition is required to provide support for those locations where DLA could not modify existing contracts, the largest being the NCR. The current NCR contract is an 8(a) direct award and cannot be modified to add this requirement due to the cost ceiling . The Richmond site is at the end of its period of performance and is unable to fulfill this requirement within the short timeframe of two months. The rest of the sites refused to bid on a Surge modification
5. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable. The proposal will be analyzed in accordance with FAR 15.404-1 procedures. It is anticipated that the Government will use various price analysis techniques including, but not limited to (1) Comparison with competitive price lists in accordance with FAR 15.404-1(b)(2)(iv) and (2) Comparison of proposed prices obtained through market research for the same or similar items in order to obtain a fair and reasonable price in accordance with FAR 15.404-1(b)(2)(vi).
6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:
N/A
7. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE EXCEPTION
TO FAIR OPPORUNITY BEFORE ANY SUBSEQUENT ACQUISITION FOR
THE SUPPLIES OR SERVICES IS MADE:
DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government. As a continuing effort, DLA uses a variety of vendors, manufacturers and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition.
