Questions/Answers
Question: We would like to request clarification on the Cancellation Policy stated in Section 5.15 Cancellations on pages 5-6 of the Performance Work Statement (PWS):
"If any extended standard requirement/task (session that is greater than 8 hours) is cancelled by the Government, the Government is responsible for payment of cancellation fees for any requirement/task cancelled less than 48 continuous hours before the scheduled start of the requirement/task (4 hour minimum paid for any requirement/task scheduled for 8 hours or more)"
Interpreting industry standard for cancellations with less than 48 hours' notice of assignments longer than 2 hours in duration is payment of the fully contracted assignment time. Payment of the 4-hour minimum for cancelled requirements scheduled for 8 hours or more is not in alignment with industry standards. Because interpreters expect to be paid for the full time they were originally contracted to provide services if the assignment is longer than 2 hours, payment of a 4-hour minimum for cancelled assignments longer than 4 hours would result in significant financial loss for Contractors.
Would the Government consider revising the cancellation policy for extended requirements/tasks cancelled with less than 48 hours' notice to include payment for the fully contracted assignment times, in order to align with industry standards?
Answer: PWS Section 5.15 Cancellations has been amended as follows.
Original Statement:
5.15 Cancellations: If any extended standard requirement/task (session that is greater than 8 hours) is cancelled by the Government, the Government is responsible for payment of cancellation fees for any requirement/task cancelled less than 48 continuous hours before the scheduled start of the requirement/task (4 hour minimum paid for any requirement/task scheduled for 8 hours or more)
Ex. 2 A week long training has been scheduled/assigned/confirmed to begin on Monday at 0800.
Contractor receives notice that the training with 2 interpreters assigned has cancelled the Friday prior at 1100. The contractor may invoice for 4 hours for each interpreter assigned for Monday and Tuesday of the training week. This equates to 16 total hours can be invoiced for the cancellation in lieu of the full 80 hours the assignment would have incurred.
Revised:
5.15 Cancellations: If any extended standard requirement/task (session that is greater than 2 hours) is cancelled by the Government, the Government is responsible for payment of the requirement/task cancelled that falls within the less than 48 continuous hour cancellation notification. Any time outside of the 48 continuous hour cancellation notification will not be billable.
Ex. 2 A week long training has been scheduled/assigned/confirmed to begin on Monday at 0800.
Contractor receives notice that the training with 2 interpreters assigned has cancelled the Friday prior at

1100. The contractor may invoice for 8 hours for each interpreter assigned for Monday and Tuesday of the training week. This equates to 32 total hours that can be invoiced for the cancellation. The remaining hours for Wednesday through Friday are non-billable hours as they fall outside of the 48 continuous hour cancellation notification
