DEFENSE LOGISTICS AGENCY
CONTRACTING SERVICES OFFICE
8000 JEFFERSON DAVIS HIGHWAY
RICHMOND, VA 23297
LSJ No. DCSOR-18-26
Limited Source Justification
(1) Identification of the agency and contracting activity:
Requiring Activity: Defense Logistics Agency, Director, Defense Critical Infrastructure (DCI) (J31)
Contracting Activity: DLA Contracting Services Office – Richmond
(2) Nature and/or description of the action being approved:
Approval to solicit on a limited source basis under the authority of the Multiple Award Schedule Program.
(3) Description of the supplies or services required to meet the agency’s needs (including the estimated value):
The Director, J31, Defense Critical Infrastructure (DCI) has established a need for analytical and administrative support for the Mission Assurance Construct as set forth in the DoD Directive 3020.40, Mission Assurance. The proposed work includes supporting the Mission Assurance Director, Mission Assurance Officer, and DCI Manager in coordination and support of the DLA Mission Assurance Working Group; assisting in developing a DCI DLA Instruction to support DLA Mission Assurance;
developing DCI Training and Awareness Module to be placed in DLA’s Learning Management System;
and assisting in developing DLA DCI Implementation Plan.
It is anticipated the work will be added to existing contract SP4703-18-F-0015 because the proposed Mission Assurance Construct work is similar in scope to the work currently being performed under this contract. The awardee under contract SP4703-18-F-0015 is International Business Machine Corporation
(IBM).
The value of the additional work is for the period of July 17, 2018 – February 26, 2019.
Approved funding for the planned work has been provided by J31.
(4) Authority and supporting rational and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service:
The acquisition is conducted on a limited source basis pursuant to FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
The Mission Assurance Program manages the identification, prioritization, assessment, and risk management of Defense Critical Infrastructure (DCI) as a comprehensive program that includes the development of adaptive plans and procedures to mitigate risk, restore capabilities in the event of loss or degradation, support incident management, and protect DCI-related sensitive information. The program requirements are detailed under DoD Directive 3020.40, Mission Assurance (MA), and DoD Instruction 3020.45, Defense Critical Infrastructure Program (DCIP). The requirements under DoDD 3020.40 are currently being revised, with the final revisions expected to be released August 2018.
The technical nature of the MA/DCI program requires that contractors have specific knowledge of and experience in Mission Assurance and Defense Critical Infrastructure, specifically in accordance with DoDD 3020.40 and DoDI 3020.45. To that end, IBM is currently performing work similar in scope under contract SP4703-18-F-0015, and has provided MA and DCI assistance to DLA under other previous contracts. Thus, IBM possesses the requisite technical knowledge and experience to perform the Mission Assurance work at the required level of quality and within the timeframe needed.
(5) Determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d):
The Contracting Officer determined the cost to the Government fair and reasonable, and that the resulting task order modification represented the best value to the Government, by comparing proposed prices with the independent Government estimate and comparison of proposed prices with prices obtained through market research for the same or similar items.
(6) Description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted:
A synopsis was posted to GSA eBuy on June 19, 2018 to notify contractors of DLA’s intent to incorporate the Mission Assurance work into the existing contract. No contractors responded to the synopsis.
(7) Other facts supporting the use of other than full and open competition:
As the DoD Directive (DoDD) 3020.40, Mission Assurance (MA), and DoD Instruction (DoDI) 3020.45, Defense Critical Infrastructure Program Management, governing the MA/DCI programs are under review, the additional work incorporated through modification P00002 is subject to further revision during the modification period of performance. Therefore, the current action covers only approximately eight (8) months of MA support in order to allow time to evaluate the potential revisions to the directives and refine the requirement for a longer-term contract to begin in or around February 2019 all-the-while maintaining essential support by avoiding a lapse of coverage. IBM is currently providing services within the scope of the MA support functions and can immediately provide the necessary additional MA services during this interim period.
(8) Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
There is an on-going need for MA/DCI support services. Previous contracts have been competed on an unrestricted basis. Even though the current task order modification incorporates certain on-going, within scope work into current contract SP4703-18-F-0015, it is anticipated there will be additional or new work that needs to be accomplished as a result of the revisions to the governing directives. It is undetermined whether the finalized MA work will be within the scope of work on the existing contract once the amendments to the government documents are finalized, and the requirement has been refined by the program manager, it is anticipated that any future requirements will be competed on an unrestricted basis.
It is anticipated a new contract will be put in place in approximately February 2019 for support services in accordance with the most up to date MA/DCI program requirements. The anticipated February 2019 contract will include one base year and one option year so that the contract expiration date will coincide with the expiration of contract SP4703-18-F-0015 in February 2021. After both contracts are expired, it is anticipated that all MA/DCI support service requirements will be combined into one contract to provide the requiring activity with a single contract vehicle to cover all MA/DCI program requirements.
The anticipated 2021 action will be solicited on an unrestricted bases to allow for full and open competition.
