Harris HF Radio Systems – Site Surveys

DEFENSE LOGISTICS AGENCY

DLA CONTRACTING SERVICES OFFICE - PHILADELPHIA

700 ROBBINS AVENUE

PHILADELPHIA, PENNSYLVANIA 19111-5092

JUSTIFICATION FOR OTHER THAN FULL AND

OPEN COMPETITION (OTFAOC)

Federal Acquisition Regulation (FAR) Part 6 Justification & Approval (J&A), Supporting Procurements under FAR Part 12, and FAR Part 15

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requesting Agency:

Defense Logistics Agency (DLA) Installation Operations at Battle Creek 74 N. Washington Ave.

Battle Creek, MI 49037-3092 POC: Paul Goebel Ph: (296) 961-4404 Email: paul.goebel@dla.mil

Contracting Activity:

DLA Contracting Service Office Philadelphia

700 Robbins Avenue Philadelphia, PA 19111

2. NATURE/DESCRIPTION OF ACTION(S):

This justification is for the sole source acquisition of two (2) site surveys from Harris Corporation. These surveys will lead to an installation, reinstallation, relocation, or a purchase of a Harris antenna and cabling, calibrating of antennas on Harris AN/PRC- 150C high frequency radio, and optimizing the DLA HF Radio system at the DLA Houston, TX. and DLA Battle Creek, MI locations by Harris Corporation. Only Harris Corp personnel can perform radio maintenance on Harris radios. The proposed procurement action will result in the award of a Firm Fixed price contract.

3. DESCRIPTION OF SUPPLIES/SERVICES:

Defense Logistics Agency (DLA) has a requirement to obtain Harris Corporation services to perform a site survey at two (2) DLA locations. These surveys will lead to an installation, reinstallation, relocation, or purchase of a Harris antenna and cabling, calibrating of antenna on Harris AN/PRC-150C high frequency radio, and optimizing the DLA HF Radio system. This survey will determine the scope of services that will be needed, and this information will be used to outline an antenna purchase, cable/antenna installation, relocation, and calibration of the agency Harris HF Radio system.

The period of performance will be for 12 months from the date of award. The estimated cost of this requirement is $16,228.00 and services are detailed below:

Item#:

DLA Battle Creek 0001 – Survey location for antenna removal/storage and reinstallation

DLA Houston 0001 – Survey location for antenna installation 0002 – Survey location for cabling installation 0003 – Recommendation’s for antenna type

4. IDENTIFICATION OF STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1 “Only One Responsible Source and no other supplies or services will satisfy agency requirements”. Harris HF Radio Antennas is a sole source product of Harris Corporation. No other firm can provide these services due to proprietary nature and sole distribution point. Use of this brand name description in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product of another company.

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

The proposed source is Harris Corporation, RF Communications Division (Harris), 1680 University Ave., Rochester, NY 14610. Harris is the only source capable of meeting the Government’s requirements. Harris is the developer, sole manufacturer, and configuration manager of the AN/PRC-150 radio system. Therefore, only Harris Corp technicians are authorized to perform a site survey to determine the scope of installation, reinstallation, and maintenance of the required equipment. There are no authorized resellers available to perform these services. Harris Corporation is the sole provider of Harris services is exclusively owned and propriety of Harris Corporation.

6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES:

Harris Corporation is the sole designer and producer of Harris equipment and maintenance, Market research was conducted, details of which are included in the market research section of this document. The requirement will be synopsized to solicit resellers, if any, for Harris HF radio site survey. All responsible parties will be given an opportunity to submit an offer.

7. DETERMINATION OF FAIR AND REASONABLE COST:

As the Contracting Officer, I hereby determine the pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404- 1(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404- 1(a)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR 15.404-1(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).

8. MARKET RESEARCH:

Harris Corporation is the only source that will satisfy Government requirements. Open market research was conducted through the NASA SEWP website on previous site survey requirement with three other companies besides Harris Corp responding with their cost estimates to perform generic site surveys; Tribalco LLC, Presidio Networked Solutions, and New Tech Solutions, Inc., but their offers would not satisfy the Government requirements and would have a negative impact on the warranty of Harris products in the current DLA infrastructure. Even though Harris Corp uses several distributors; Harris holds proprietary rights to their services and certifies their services. Harris engineers will ensure that Harris HF antennas are installed, calibrated and maintained according to Harris best practices. The third party vendor support would void the warranty and supplied technical support for Harris HF radio antennas and expose the mission to risks created by support from personnel that does not receive Harris certification and hence may not be in possession of current Harris training, and essential diagnostic and recommendation tools. Therefore, Harris Corp brand name is essential to the Government, and market research indicates the other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.

9. ANY OTHER SUPPORTING FACTS:

N/A

10. LISTING OF INTERESTED SOURCES:

Harris Corporation 1680 University Avenue Rochester, NY 14610 rhaskin@harris.com

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

DLA has and continues to exercise competition as often as possible and it is required to conduct ongoing reviews to keep abreast of new technology, both within the industry and the Government, as a continuing effort within DLA. Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure future full and open competition. Requirements will continue to be posted on FedBizOpps to ensure fair opportunity and no other providers are available.
