4. THE AUTHORITY AND SUPPORTING RATIONALE (see 8.405-6(b) AND, IF

APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR’S

UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR

SERVICE:

The authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) and FAR 8.405-6(b). Brand name VMWare Software Licenses and Maintenance Support are essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet and cannot be modified to meet the Government’s needs. A brand name item, whether available on one or more contracts, is an item particular to one manufacturer and may be procured by brand name specification if essential to the Government’s requirements. The Brand Name Descriptions for this acquisition effort which is VMWare Software Licenses and Maintenance Support are considered to be essential in order for the Government to meet mission requirements and no other item can meet the Government’s needs.

DLA requires a suite of enterprise scalable information technology (IT) virtualization capabilities. VMware is the virtualization product used by the Defense Information Systems Agency (DISA) at their Defense Enterprise Computing Center (DECC) locations where most of DLA’s servers and mission critical applications are currently hosted. Implementing a standardized solution, using the same brand name specific VMware products, for the DLA’s remaining field site servers presents the lowest potential operational risk to our workforce, the warfighter and our customers; especially since these servers could be moving to DISA in the near future.

Over the past few years, while migrating most of its servers to DISA DECCs, the DLA invested over $5 million for VMware software licenses. The VMware products were installed, configured and tailored for use at the local data centers to virtualize the remaining servers. Now, due to growing requirements and the enterprise wide virtualization initiative, the DLA needs to purchase additional VMware software licenses to enhance and support the current DLA VMware virtualization solution. In order to keep the VMware software licenses current with the latest version, fixes, and patches as well as to obtain technical support, software maintenance is required for the new VMware software licenses. The software licenses and associated maintenance are proprietary to VMware and no other software OEM can provide such licenses and maintenance.

DLA has performed substantial technical research and system testing using several virtualization products. The results showed that only VMware satisfied all of the DLA’s virtualization requirements and that the use of non-VMware solutions would result in a non-standardized and non-integrated configuration consisting of multiple manufacturer products and product add-ons.

In the past, the DLA has experienced significant system administration, support, and interoperability problems with the implementation of non-standardized and non-integrated IT solutions. DLA seeks to reduce the associated operational risks by standardizing on a single virtualization product for the Agency in order to maintain compatibility with existing DLA and DISA solutions and achieve mission critical performance objectives.

DLA requires the procurement of maintenance support which is essential for this software.

Software maintenance support must be procured from an authorized VMWare maintenance provider. Software maintenance will provide DLA with the appropriate upgrades and patches throughout the maintenance period, but not having access to the upgrades and patches will put the agency at risk and in non-compliance with Joint Task Force-Global Network Operations (JTF-GNO) and DLA Computer Emergency Response Team (CERT) policy; DLA will not be able to respond to vulnerabilities and upgrade taskings and it will expose us to potential disconnect from the DoD network by DISA. Any maintenance support other than proprietary brand name VMWare would not be compatible. VMWare maintenance support is owned by VMWare and is available only through designated resellers.

5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION REPRESENTS

THE BEST VALUE CONSISTENT WITH 8.404(d):

A Request for Quote (RFQ) will be published to the GSA e-buy system and authorized resellers of VMWare Software Licenses and Maintenance Support will be provided an opportunity to submit proposals for this requirement. The Contracting Officer will evaluate all proposals received, determine that pricing for this effort is considered fair and reasonable, and award a task order to the firm who represents the best value consistent with FAR 8.404(d).

6. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AMONGST GSA

SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE

REASON MARKET RESEARCH WAS NOT CONDUCTED:

Market Research was conducted with VMWare Software Licenses and Maintenance Support resellers on GSA and in the open market. A review of the GSA FSSs did identify resellers of the VMWare Software Licenses and Maintenance Support .
