PERFORMANCE WORK STATEMENT (PWS)

DLA Disposition Services Continental United States (CONUS)

Material Handling Equipment (MHE) Maintenance

0. INTRODUCTION: DLA Disposition Services has the responsibility of disposing and reutilizing

Department of Defense (DoD) excess and surplus property generated by the military services. This is accomplished through reutilization to other DoD activities, transfer to other Federal agencies, donation to authorized state and local organizations, sale to the general public, or ultimate disposal through abandonment or destruction. The headquarters for DLA Disposition Services is located in Battle Creek, Michigan. DLA

Disposition Services is a primary Level Field Activity (PLFA) of the Defense Logistics Agency (DLA).

1. GENERAL: DLA Disposition Services requires preventative maintenance and repairs for MHE at all of its

CONUS locations and Alaska, to meet the requirements of their mission to support the warfighter. The

Contractor shall furnish all labor, equipment, tools, supplies, repair parts, oil, grease, filters, etc., to perform a timely and effective preventive maintenance (PM), and remedial service calls for repair service when required, for MHE located at DLA Disposition Services CONUS sites, with the sites organized by Disposition Services

Directorate West, Mid-America and East as per the Bid Schedule. Detailed site locations are available at http://www.dla.mil/DispositionServices/Contact/FindLocation.aspx, with a regional map also at Attachment 01.

Note the Attachment 01 Regional Map includes an in-process reorganization where most, but not necessarily all, MHE requiring service will be at the “Full Service Sites” depicted with a black square (which includes the four DSD Regional Office Sites). The DSD East Bid Schedule for purposes of this procurement consists of the

DSD Regions shown for both the Northeast and the Southeast regions.

2. SCOPE:

Technical Inspections (LTI) as needed. The contractor shall be required to perform load tests on all forklifts annually or as otherwise specified via its own line item coverage as well. A full-time covered space for repairs or PMs will not be provided to the contractor. In the event of inclement weather, a covered area can temporarily be made available to facilitate repair or PM Service on designated equipment. In no case will

Government real property (land, structures) be provided to the contractor. Electric power will be made available to the contractor for preventive and remedial repair services. The contractor shall comply with all applicable Federal, State and installation Fire, Safety, Security and Environmental Protection Regulations.

2.2 All repairs, preventative maintenance services, and remedial services shall be made in accordance with the

Original Equipment Manufacturer (OEM) manual. The contractor shall make available to the Contracting

Officer (KO) or Contracting Officer’s Representative (COR) the status of any or all repair work in progress upon request. The contractor shall be paid for the actual services provided; however, all repairs shall require advance Firm-Fixed-Price (FFP) quotes to be provided to the COR for determination of whether the repair is minor, major, or uneconomical and to ensure funding is available. The contractor will be required to comply with all applicable environmental protection regulations (see paragraph 21).

3.0 USE OF BIO-BASED MATERIALS

As a part of performing PM, the costs of the following items shall be included but are not limited to: Oil, grease/lubricants, fluids, anti-freeze, oil filters, air filters, fuel filters and fittings.

Preventative maintenance on equipment shall include PM on electric forklift batteries, to entail battery acid testing to ensure the electrodes are capable of proper performance in the cells, prevention of corrosion on the cables, check wear and tear of cables and connectors and upkeep of the outside areas of the battery itself.

Contractor shall compare equipment being serviced with the contract equipment included in the Bid Schedules to verify the equipment meets the CLIN being utilized, and notify the COR of any discrepancies prior to beginning PM performance. Safety Inspections shall be performed on all MHE equipment except for scooters and sweepers. Contractor shall perform load tests via its respective CLIN and stencil equipment with date of next inspection. Deficiencies or required repairs discovered during preventive maintenance procedures, but not a part of such preventive maintenance procedures, shall be repaired as discovered. Such repairs shall be considered unscheduled services, and billed as such, as defined in the following section (except the mobilization charge portion is not applicable if this service is accomplished within a scheduled PM visit). In addition, Scheduled Preventive Maintenance procedures shall not be used to make repairs at any time due to damage by fire, water, burglary, accident, abuse and acts of God. Such repairs shall also be considered Unscheduled

Service.

20. REMEDIAL/ON-CALL/EMERGENCY REPAIR/LIMITED TECHNICAL INSPECTION (LTI) : The following services are considered unscheduled services and will be issued by call order. On-site labor shall be billed under its respective CLIN as applicable by zone (and respective option CLINs if exercised). Billable work hours begin and end upon arrival at, and departure from, the work site. Hours while traveling to and from the actual work site (e.g. not the installation gate) shall not be billable. The cost of repair parts is covered under its respective CLIN as applicable by zone (and respective option CLINs if exercised), and will be compensated for as required (see paragraph 26). The contractor shall coordinate with the Manufacturer’s representative on repairs of equipment and components under warranty at no additional charge to the Government. All repairs shall be done in accordance with the Original Equipment Manufacturer (OEM) standards. The mobilization

CLIN by zone (and respective option CLINs if exercised) represents the contractor’s round-trip mobilization charge as assigned to each unscheduled (non-PM related) repair/service trip. The usage of the applicable ROM

CLINs for on-site labor, repair parts, and mobilization charge will be as follows:

- If the Government can reasonably assess and define the required on-call repair, the COR will notify the contractor of the requirements of the service call, including anticipated parts, or forklifts to be load tested under the load test CLIN, and/or other necessary information such that the contractor can respond with a

Firm-Fixed-Price (FFP) quote for the service call, to consist of one round trip at the designated mobilization rate, the proposed fixed number of labor hours at the designated on-site labor rate, and the costs of all repair parts as applicable. The contractor’s FFP quote is required within two business days of the request by the COR. Upon COR approval of the FFP quote, specific arrangements will be coordinated for the service call, subject to the service itself beginning within three business days of

COR approval.

- If the Government can not reasonably assess and define the required on-call repair service, the parties will coordinate to arrange the use of one mobilization charge and one on-site labor hour, within three business days of COR notice, for the contractor to assess the repair requirements, subject to COR approval of the diagnosed repair need. Upon COR approval, the parties will follow the same on-call repair application as required above, including but not limited to the contractor’s FFP quote subject to

COR approval. If a subsequent service visit is required to accomplish the repair, then a second mobilization charge will be authorized within the FFP service. The subsequent service visit is required within three business days of approval of its FFP quote unless otherwise agreed to by the parties for longer lead-time parts or other justification (e.g. extreme weather). If the repair can be diagnosed, the

FFP quote agreed upon, and the repair completed within the single visit initially made for the assessment, only one mobilization charge is authorized.

- Within the FFP quote for the service call as per the above procedure, upon request of the COR or KO the contractor is to provide at least one additional published online price for any individual parts priced by the contractor at $500 or more.

- One each of this mobilization charge will be billable regardless of the duration of the service work time necessary, i.e. including a multiple work day service, unless two separate mobilization charges are authorized as per the above coverage, in the event of an assessment visit and a subsequent repair visit. Therefore, each non-

PM related service call will consist of a FFP total using 1) the repair parts CLIN, 2) the labor hour CLIN, and 3) the mobilization charge CLIN, from the period and applicable zone (base or option as applicable) in effect for the task order.

- The service call visits are at the agreed upon FFP amount as per the above coverage, unless modified per mutual agreement of the parties due to unforeseen additional repairs or other unanticipated needs that the

Government agrees they did not sufficiently identify under an action where the Government defined the on-call service need, or the Government agrees that unanticipated repair needs exist that the contractor could not reasonably identify during their initial assessment.

20.1 Minor Repairs. Service calls, required to repair or replace unserviceable components, assemblies, sub-assemblies and electrical components, shall be performed on-site to minimize equipment downtime. Minor repairs shall have a maximum three (3) workday repair criteria, subject to the specifics above as to whether or not the repair can be accomplished without an additional visit for diagnosis. If the repair will take longer than three (3) workdays, the contractor shall be required to provide the COR a written justification for the delay and an estimated date of completion.

20.2 The contractor shall be required to perform a LTI including load tests, inspection of all lifting devices, including cranes, hoists, slings, chains and lifting cables, whenever required, and replace said lifting devices, in accordance with OSHA 29 CFR on all forklifts annually using the designated Load Test CLIN as applicable by zone (and respective option CLINs if exercised). The Load Test CLIN includes any and all costs to conduct the load test including but not limited to test weights and service time. A mobilization charge is not authorized if these services are provided within a PM service visit or an on-call service visit for repairs.

20.3 Major Repairs. Major component repairs such as engine overhaul, power train repair, etc., shall require the Contractor to perform a LTI via its CLIN and provide a report with the name of the major component, cause of component breakdown, cost to repair and estimated time for repair prior to proceeding with the repair. The contractor shall submit a FFP quote per the above methodology within two (2) working days after request to the

COR to determine if repair is economically feasible on a particular piece of equipment. Prior to proceeding with any such repair, the COR will approve or disapprove such repair. The contractor will receive written approval from the COR prior to proceeding with the repairs, which are to be performed within 3 business days of COR approval.

20.4 If determined during a Remedial Service call that it is not cost effective to repair a particular piece of equipment, the COR or KO may request the contractor to perform a LTI via its CLIN to determine the equipment’s overall condition and serviceability. This inspection shall include but is not limited to: a thorough inspection of the equipment such as engine, transmission, other major components, controls, mast, cables, chains, hoses, electrical, air, and hydraulic systems to determined disposition of the equipment. The Contractor shall include a FFP quote using the above method, to return the equipment to an operating condition. The contractor shall complete this FFP quote within two (2) working days after the service call date. A DLA Form

1730 will be furnished by the Government if needed.

20.5 Upon request, the contractor shall perform a condition inspection on MHE located at the DLA Disposition

Services site(s) on the order to ensure that the overall structural, mechanical and electrical components are in compliance with OSHA standards currently in effect and in use by the DLA Disposition Services site(s). The safety inspection shall be performed on all MHE after major repairs or as otherwise determined by the KO or

COR, and use the above specified service call method using a FFP quote prior to the service.

21. ENVIRONMENTAL PROTECTION: The contractor shall comply with all applicable federal, state and local laws and regulations concerning environmental protection, pollution abatement and controls. If a contractor caused spill occurs at a DLA Disposition Services site in the performance of this contract, the contractor shall bear all costs of clean up as required by Environmental Laws and Regulations in force at the time of the spill.

22. CLEAN UP OF PREMISES: Upon completion of services, the contractor shall be required to clean-up the workspace and remove and dispose of any used fluids, parts and debris, from the military installation and DLA

Disposition Services site occupied land/facilities. This shall be required after each workday of on-site performance.

23. MHE AVAILABILITY AND RELEASE: The Government will make available to the contractor, equipment for preventive maintenance or repairs in accordance with the provisions for the schedule. The contractor upon receipt of any Government equipment shall assume the risk of and shall be responsible for any loss or damage thereto. Any equipment described herein to be removed from a DLA Disposition Services site shall have the prior approval of the KO or COR. The Contractor shall sign for receipt of any Government equipment moved from the Government installation. The necessary form, DRMS Form 1367, will be furnished by the Government.

24. GOVERNMENT FURNISHED FACILITIES: Workspace will be provided to permit the contractor to do on-site PM services and necessary repairs within the DLA Disposition Services site complex. Existing utilities will be furnished without charge to the contractor during normal Government working days, Monday through

Friday, except Federal holidays, within the normal business hours for the site(s) as per coordination with the

COR. The contractor shall assume the risk of and shall be responsible for any loss or damage thereto as a result of contractor performance. Welding in open areas shall not be performed without prior written approval of the

Military Installation’s Fire Department.

25. CONTRACTOR FURNISHED FACILITIES: The contractor shall perform all repairs, which are not feasible on-site in his/her facilities/shop. The contractor shall furnish materials, labor and transportation for all equipment that is repaired in contractor’s facilities. The contractor shall assume the risk of and shall be responsible for any loss or damage thereto as a result of contractor performance. Transportation shall be covered with all other required costs, using the FFP quote and subsequent repair authorization method above.

26. PARTS AND MATERIALS:

26.1 The contractor shall furnish replacement parts. Parts and Materials used by the Contractor in performance of this contract shall be new and conform to the original equipment manufacturer’s or re-manufacturer’s specifications unless approved by the COR. Rebuilt assemblies shall only be used with prior approval of the

COR when it is a standard industry practice and the rebuilt assembly or subassembly carries the same manufacturer’s or re-manufacturer’s warranty as a new assembly or subassembly. Any part removed shall be

Government property and shall be returned upon request of the COR unless the replacement part is predicated upon an exchange basis with the part being replaced. Contractor shall provide all repair parts and supplies necessary for preventive maintenance.

26.2 All Original Equipment Manufacturer (OEM) recommended replacement parts and materials may be examined when requested by the KO or COR prior to installation. The KO or COR will approve all parts and materials that are substituted for OEM replacement parts by the contractor prior to installation. No rebuilt parts shall be used without prior approval of the COR.

26.3 The Government will compensate for all parts and material furnished or used while performing

Unscheduled Service Calls and covered within the contractor’s FFP service call quote, unless the part or repair is due to the Contractor’s negligence. Replacement parts shall be itemized within the contractor’s FFP quote, citing the OEM part number or authorized substituted item, nomenclature, quantity and price; with the total amount for parts included on the subsequent invoice after repair. Parts or components damaged by the contractor shall be repaired or replaced at the expense of the contractor to the satisfaction of the COR.

26.4 A copy of the invoice for the on-call service shall be included in iRapt/WAWF inputs for payment verification.

26.5 All worn out or deteriorated parts recommended for replacement may, upon request, be physically examined by the KO or COR prior to actual replacement. All worn out or deteriorated parts shall be returned to the KO or COR, unless the replacement part is predicated upon an exchange basis with the part being replaced, or unless an acceptable monetary credit is provided to the Government by the Contractor.

26.6 All freight costs associated with the shipment of parts for unscheduled service calls will be reimbursed by the Government if included within the applicable FFP quote by the contractor. Freight costs shall be included with the cost of the parts or as separate items. In either case, the costs will be paid under the line items for

Repair Parts as per the coverage above. If other than normal expediency and mode of transportation, the

Contractor shall obtain the signature of the COR on the service/work order ticket approving such shipment. The

Contractor shall otherwise have the part shipped by the most cost effective method.

26.7 Due to the more variable PM needs required by CLINs 0025-0030 on each Bid Schedule (and respective option CLINs), these CLINs will be the sole exception to all PM costs otherwise being covered by the respective PM CLIN for all PM services. Required parts for PMs under only these CLINs will be subject to all allowable charges (part, freight, and materials handling) EXCEEDING $200.00, will be reimbursed under the repair parts CLIN by zone (or respective option CLINs if exercised). 34. DLA DISPOSITION SERVICES ENVIRONMENTAL MANAGEMENT SYSTEM (EMS): DLA

Disposition Services implemented EMS in accordance with ISO 14001:2004(E), DOD and DLA requirements at all DLA Disposition Services appropriate facilities. An EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes and resources for developing, implementing, achieving, reviewing and maintaining the environmental policy of an organization.

The DLA Disposition Services EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the

DLA Disposition Services mission. The DLA Disposition Services EMS program is explained in DRMS-I

6050.2, Environmental Management System (EMS) Core Instruction. Site supplements detail information required by EMS at a local level such as local, state and host environmental regulations as well as local emergency procedures and operating procedures unique to the location. Site supplements also contain information concerning the local interaction between the DLA Disposition Services tenant appropriate facility and the DOD/DLA host facility EMS program. Contractors and their personnel are required to be aware that each DLA Disposition Services appropriate facility has an EMS and to be aware of EMS policies to perform work and/or gain access to an installation. Each DLA Disposition Services appropriate facility maintains EMS awareness posters that identify the DLA Disposition Services Environmental Management Representative

(EMR) and Host facility EMR for specific guidance concerning an individual facilities’ EMS program.

Contractors may request current copies of EMS information identified in this paragraph by sending an e-mail request to DRMSEMR@dla.mil.
