Performance Work Statement

1. INTRODUCTION

The contractor shall provide all personnel, equipment, tools, materials, and supervision necessary to perform grounds maintenance services as defined in this Performance-Based Work Statement (PWS) at DRMO Polk, 2450 Magazine Rd, Fort Polk, LA 71459-0901. The contractor shall perform ground maintenance services on approximately 2.25 acres of property around DRMO Polk in a manner that will promote the growth of healthy grass, trees, shrubs, and plants and present a clean, neat and professional appearance.

2. DEFINITIONS

BRUSH: Weeds, grass, vines, vegetation, shrubs or saplings that have grown to a height greater than 8 inches.

CLEAR-CUT: To remove or cut brush.

DEBRIS: Leaves, grass cuttings, tree and shrubbery limbs, construction waste (excluding any waste generated by another Contractor) and similar waste material.

DRAWINGS (PLOT PLANS): Plot plans will designate areas and type of service.

EDGING: The cutting of overhanging vegetation away from the edges of a hard surface (curbs, sidewalks, driveways, etc) to include actual depth penetration of soil.

GRASS: Botanical, any plant of the Grameneae family which is characterized by narrow leaves with parallel veins; the leaves are composed of blade, sheath and ligule. The plants have jointed stems and fibrous roots and inconspicuous flowers usually arranged in spikelets.

GROUNDS: All land and water acreage on the installation. Precautions shall be taken to prevent scalping, uneven mowing, rutting by equipment, and damage to fence, buildings and property stored in the yard. The contractor shall repair or replace damage that occurs during mowing operations. All mowing equipment shall be properly adjusted. Grounds are grouped in the three categories:

(1) IMPROVED includes to the areas at the facility where the grass will be cut/mowed (mulched) between 2 and 3 inches high, side walks, parking lot and drive ways will be trimmed and edged. To include picking up all visible grass trimmings, fallen tree limbs, trash and other debris.

(2) SEMI-IMPROVED grounds that require mowing only, no trimming or edging performed except for along fences. Grass will be cut between 2 and 3 inches high as scheduled. Includes picking up all visible grass trimmings, fallen tree limbs, trash and other debris.

(3) UNIMPROVED grounds not include in the above categories (gravel area). Areas requiring very limited service. Grass will be cut between 2 and 4 inches high as scheduled. Requires mowing only, no trimming, edging or pruning performed, except for along fences. Includes picking up all fallen limbs from trees, trash and other debris.

QUALITY ASSURANCE (QA): Actions taken by the Government to inspect or check goods or services to determine that they meet the requirements of the contract.

TRIMMING GRASS/WEEDS: The cutting of grass and weeds in areas that are inaccessible to mowers due to obstacles.

TURF: A surface layer of soil containing a dense growth of grass and its matted roots.

WEED: Any plant growing where it is not desired. Plants such as, but not limited to: clover, dandelions, purslane, chickweed, plantain, knot weed, black medic, and volunteer trees are also considered weeds. Grass is plant, rock, and shrub beds, cracks in sidewalks, streets, and parking lots is also a weed.

3.SPECIFIC TASKS

GENERAL INFORMATION: Contractor shall take precautions to prevent scalping, uneven mowing or cutting by equipment. The contractor shall repair damaged government facilities, government owned property and equipment. The contractor shall control grass and / or weeds growing in the paved areas through cracks, holes, around the scales, scrap bins, buildings, railroad tracks, etc.

GRASS/VEGETATION MOWING: Contractor shall perform this service where specified in the plot plans. Areas will be cut to a uniform height between 2 to 3 inches during each service.

Grass clippings shall be removed or may be mulched if the lawn maintains a neat appearance and no clippings are visible. Grass clippings shall be disposed of properly. Fence lines will be maintained at the mowing cycle frequency on both sides of the fence. The outside of the fence will be maintained to a distance of 20 feet outside the fence line.

MOWING CYCLES: Mowing, weeding, trimming, edging, and policing of all areas which have been mowed shall constitute a mowing cycle. All mowing, weeding, trimming, edging and policing shall be done as one operation, to be fully completed before acceptance by the Contracting Officer.

The term “Mowing of areas” shall include trimming by Contractor around fire hydrants, expansion joints in sidewalks and curbs, between sidewalks and curbs and between cracks in the paved areas, electrical poles, fence lines, along fences on both sides, parking lot and other areas supporting vegetation. All grass, weeds, vines, etc will be removed from the fences (both sides) and railroad tracks.

Clippings deposited on driveways, sidewalks and adjacent streets as a result of the mowing, trimming and edging operations shall be cleared promptly after completing the above operations.

LAWN EDGING: The Contractor shall edge around areas as part of every mowing operation including lawns where they adjoin sidewalks, curbs, paved roadways, and between Warehouse A and B.

POLICING: The Contractor shall pick up and dispose of trash, litter, and debris as part of each mowing operation. The trash, litter and debris will be disposed of properly.

4. MOWING CYCLE FREQUENCY

The cycle frequency will be to complete a set number of cycles during contract period. The cycles will be completed as needed as determined by the COR. The COR will determine when a cycle is needed and contact the contractor by phone and request the service. The contractor is then required to complete the cycle within 5 workdays of the date of request. The COR also has the option to develop a schedule of cycles to be completed within a time period, i.e., 2 weeks during the months of April through August. The schedule of service will be provided to the contractor after contract award. Mowing will begin no earlier than 7:00 A.M. on the work day and completed no later than 2:30 P.M. on the same day, and if not finished that day will return on the following work day to complete the task. No work shall be done on weekends or holidays unless approved by the Contracting Officer’s Representative.

5. SECURITY REQUIREMENTS

Contractor Employees and property shall be subject to search and seizure upon entering, while on and when leaving Government property confines. Contract Employees may be denied entry or removed from Government property if it is determined that such presence may be contrary to good order, discipline or the security of the facility.

6. GOVERNMENT SURVEILLANCE

The government has the right to inspect all services called for by the contract at all times and places during the term of the contract. The Government shall perform inspection in a manner that will not unduly delay the work.

If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. The Government shall notify the Contractor of any deficiencies within 8 hours of discovery. The Contractor shall have 8 hours to correct the deficiencies. When the defects in services are not corrected by re-performance the Government may:

(b) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements and

(c) Reduce the contract price to reflect the reduced value of the services performed.

If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may: (a) By contract or otherwise, perform the services and the charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service or

(b) Terminate the contract for default.

7. POLICING GROUNDS

The pickup and disposal of litter, such as paper, bottles, cans, cardboard, plastic, rags, tree limbs, braches, twigs, broken glass, chunks of concrete, leaves, tumbleweeds, dead animals, paper and plastic hung on fences and under them, and other items identified by the QAE(s) as trash and other debris.

8. CONTRACTOR FURNISHED ITEMS AND SERVICES

The Contractor shall furnish everything required to perform this contract.

The Government shall not be liable for loss or damage to the Contractor’s or Contractor employee’s property, equipment, or materials or the Contractor’s privately owned possessions.

The Contractor shall use materials, tools, chemicals, equipment, supplies and etc that conform to the requirements listed in this contract.

The Contractor shall use his own tools and equipment of a designed type, size, rating and power for the intended use and shall be kept in a safe and operable condition at all times. No tools equipment and/or fuel shall be stored on government property.

9. CHEMICALS

Chemicals used in the performance of the work shall be purchased and issued to the Contractor’s employees in the original manufacturer’s containers. All such containers shall identify the type of chemical, instructions for use, dilution and any hazardous warnings.

Products used shall be components that are formulated to be chemically compatible.

Products shall be recommended by the manufacturer for their intended use and shall be compatible with other manufacture’s products used in conjunction with these products. They shall have been available in the market for commercial use for at least 2 years. Manufacturer’s published data will be the only acceptable evidence of materials meeting this requirement.

10. CLEAN-UP

All supplies, equipment and machines shall be kept out of traffic lanes or other areas where they might be hazardous and shall be secured at the end of each work period in a location off of government property.

11. GOVERNMENT INSPECTIONS

The Government reserves the right to inspect supplies, materials, equipment, and chemicals used to perform the requirements of this contract. The Government’s inspection will not constitute acceptance nor will it in any way replace the Contractor’s inspection system or otherwise relieve the Contractor of responsibility to furnish an acceptable item.

12. SPILL RESPONSIBILITY

The contractor is solely responsible for any and all spills or leaks during the performance of this contract, which occurs as a result of, or is contributed to by the actions of its agents, employees, or subcontractors. The contractor agrees to clean up such spills or leaks to the satisfaction of the Government in a manner that complies with applicable Federal, state, and local laws and regulations. The clean up shall be at no cost to the Government. The contractor shall report all such spills or leaks, regardless of their quantity, to the COR and CO immediately upon discovery. A written follow-up report shall be submitted to the COR and CO not later than twenty-four (24) hours after the initial telephonic report. The written report shall be in narrative form and as a minimum include the following:

(1) Description of item spilled (including identity, quantity, etc.).

(2) Whether amount spilled is EPA/state reportable, and if so, whether it was reported.

(3) Exact time and location of spill including a description of the area involved.

(4) Containment procedures initiated.

(5) Summary of any communications contractor has with press or Government officials other than the contracting officer.

(6) Description of clean-up procedures employed or to be employed at the site including disposal location of spill residue.

13. INVOICING: The contractor shall submit its invoice and be paid using the Wide Area Workflow (WAWF) payment system. The WAWF clause will be incorporated into the contract by full text for informational purposes. In order to prevent payment delays, it is extremely important that the contractor appropriately submit payment requests in WAWF using the information provided in DFARS clause 252.232-7006, WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS.

14. PERIOD OF PERFORMANCE

The period of performance shall be one calendar year starting on date of award. One (1) base year and four (4) option years.

15 DLA DISPOSITION SERVICES ENVIRONMENTAL MANAGEMENT SYSTEM (EMS): DLA Disposition Services implemented EMS in accordance with ISO 14001:2004(E), DOD and DLA requirements at all DLA Disposition Services appropriate facilities. An EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes and resources for developing, implementing, achieving, reviewing and maintaining the environmental policy of an organization. The DLA Disposition Services EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLA Disposition Services mission. The DLA Disposition Services EMS program is explained in DRMS-I 6050.2, Environmental Management System (EMS) Core Instruction. Site supplements detail information required by EMS at a local level such as local, state and host environmental regulations as well as local emergency procedures and operating procedures unique to the location. Site supplements also contain information concerning the local interaction between the DLA Disposition Services tenant appropriate facility and the DOD/DLA host facility EMS program. Contractors and their personnel are required to be aware that each DLA Disposition Services appropriate facility has an EMS and to be aware of EMS policies to perform work and/or gain access to an installation. Each DLA Disposition Services appropriate facility maintains EMS awareness posters that identify the DLA Disposition Services Environmental Management Representative (EMR) and Host facility EMR for specific guidance concerning an individual facilities’ EMS program. Contractors may request current copies of EMS information identified in this paragraph by sending an e-mail request to DRMSEMR@dla.mil.

16. CONTRACTOR MANPOWER REPORTING

The contractor shall report all contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Defense Logistics Agency via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2014.
