-This amendment is being issued to answer contractor questions, see below.

1. Will the contractor have access to government provided MHE Master Driver training? Answer: No, the contract shall provide trained MHE operators.

2. Are US personnel required to attend a pre-depoloyment training such as CRC? No. U.S. Contracted personnel are not required to attend CRC.

3. Will US personnel be provided military PPE such as flak jackets, SAPI plates, helmet, etc.? Answer: As stated in III.2 the contractor shall also be responsible to provide their employees with Body Armor as required by host installation.

4. On Page 7, III.3.3.1 – “Contracted employees shall be trained and ready to perform at the start of contract award”. Should this instead say that contracted employees shall be trained and ready to perform at the end of the 30-day transition period? Answer: All personnel should be trained at the start of the contract.

The contract shall be under full performance at the end of the 30-day transition period.

5. On Page 16, II.13.1 – “The contractor must provide below the names and telephone numbers of the main and alternate points of contact, who for the purposes of this contract, shall be designated as the Contract Manager and Site Supervisors for each of the four disposition sites”. As there are only two sites listed in the solicitation (Bagram and Kandahar), should this say two disposition sites, instead of four? Answer: yes this section should state two rather than four; Bagram and Kandahar are the two main locations for DLA Disposition Services. However, as stated in the solicitation; “The Government shall have the capability to distribute the contracted employees among any current or future DLA Disposition Services operating location depending on mission needs. Current locations include Bagram and Kandahar. The movement of contractor personnel shall be coordinated with the supervisor and the COR(s). The Contractor shall be given advance notice of any requested move of personnel (5-day advance notice when possible).”

6. On Page 16, II.13.1 – “The contractor must provide below the names and telephone numbers of the main and alternate points of contact, who for the purposes of this contract, shall be designated as the Contract Manager and Site Supervisors for each of the four disposition sites”. This adds to a total of 5 management/supervisors. However, Attachment 2 – Bid Schedule has 8 “Material Management Supervisors” listed.

Please explain. Is it correct to assume that “Material Management Supervisors” includes Contract Manager and Site Supervisors? If so, should the number of “Material Management Supervisors” be 3 (1 Contract Manager and 2 Site Supervisors) instead of 8? Answer: The number of managers, and number of employees, for each labor category will be clearly listed on the funded task order.

7. In order to fully illustrate the depth and breadth of the capability of the contractor and any subcontractors, will the government consider permitting a maximum of four (4) past performance references?

Answer: The maximum allowed past performance references will remain in the solicitation unchanged.

8. Initially BAF and KAF are the Host Installations, what are requirements for body armor for each Installation. Answer: Each contracted employee is required to have body armor in possession and accessible, wear the body armor on base as designated, and must be worn when traveling.

9. Of the initial headcount of 154 contract services personnel how many are assigned to BAF with the remainder assigned to KAF? Answer: The revised initial worker estimate is 134 the estimated split will be 60 / 40 BAF to KAF. The exact number will be clearly listed on the funded task order.

10. The PWS makes reference to host installation regulations applicable to MHE. Please provide these regulations to offerors, or assure that such regulations have no impact on contract pricing unique to the installations. Answer: it is up to the contractor to contact the hoist installation to obtain all policies and procedures any MHE regulations.

11. Re: 3.18, pp 5/46, please provide examples of “new industrial operations”; Answer: Processes may change based on regulation or new machinery being introduced to a location.

12. Re 3.1.9 pp 6/46, is it correct to assume that as with the “Country” Contract Manager and is there to be a ”Country” Safety Manager who travels to all sites for inspections? Should travel costs be priced in our offer or will MILAIR or other Government transport and life support services be provided? Answer: All in theater travel will be through MIL Air. The safety personnel will be at each location.

13. Re: 3.2.1 pp 6/46 Security requirements? Please explain. Answer: The contractor is required to understand and follow the hoist installations security and medical requirements. The current policy can be obtained from the hoist installation badging office.

14. Re: 3.10.2 pp 9/46 KXS? Please clarify. Answer: KXS was entered in error. The sentence should read:

Within 30 days at existing work sites, and when starting new work site locations, the contractor shall create and display safety “story boards” with key safety messages calling out potential hazards in the main yards where workers operate.

15. 3.1.4 pp 4/46 states Host Nation/ Base Draft Operations/Safety Manual 1910.178 shall be issued “if approved”. Will this add requirements that will impact offer pricing? Answer: No.

16. The contractor is exempt from import duties for contract related goods (PPE, Body Armor, etc.) and Tax on profits in accordance with the US- Afghanistan SOFA (Status of Forces Agreement) and U.S Embassy Diplomatic Notes? Answer: The contractor is responsible to research and understand all Tax issues effecting there company.

17. Section III 3.7 states that this is a time and materials contract and that the contractor will be paid for hours worked but will be required to staff the contract based on task order and not workload. Will the contractor be able to bill the government for 12 hours/day for each person on ground or is there a chance that not all personnel will be utilized each day? Answer: No. The contractor will be required to keep a daily log of the number of hours worked and labor category for each employee. The contractor will only be paid for hours worked on site. As stated the DRMO schedule is subject to change given the contingency environment.

18. Section III 3.7 states that currently there is one shift of 12.5 hours. If 24/7 operations become necessary, there will be three shifts. Should this change occur, will the contractors billable hours per person be affected? Can the contractor utilize two 12 hour shifts instead? Answer: No. The shifts are determined by the Government’s work schedule. The DRMO schedule is subject to change given the contingency environment.

19. Will the contractor be authorized to have it’s own vehicles on the bases? If so, will the contactor be provided government furnished fuel for those vehicles? Answer: Yes. The contractor will need to provide transportation within the base; the contract shall register any vehicles in accordance with hoist installation procedures. The Government will provide fuel at the base fill up locations. As checked in 5152.225-5908, Government Furnished Contractor Support; “Fuel Authorized”.

20. Instructions to offers states that there are only two volumes required, Past Performance and Price.

Other areas of the solicitation refer to a technical volume. Can you please confirm whether or not a technical volume is required? Answer: A technical volume is not required.

21. Page 3, III.2 The government states that Contractors are required to provide PPE and Body Armor for all employees/labor. Will the government allow the Contractor to obtain this equipment as GFE? Due to the significant amount of troop withdrawal, we believe there is significant amount of equipment of this type available as GFE. This would allow a significant cost savings to the government. Answer: The contractor is responsible to provide PPE and Body Armor. The PPE must meet all current safety guidance and regulations.

23. Are the costs of TCN’s considered part of the cost of personnel necessary to comply with FAR 52.219-14 Limitations on Subcontracting? If so, that would mean that TCN’s would have to be employees of the Prime contractor and cannot be hired through a vendor? Answer: At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.

24. Are employees (both TCN’s and Expats) required to attend the CRC? Answer: No

25. Are TCN’s provided LOA’s? Answer: All TCN employees will be required to have a valid LOA.

26. Please clarify work hours in table. For 12 month period the total listed in Attachment 2 is 4,380 hours per staff. Our calculation of a 12 hour a day 7 day work week for 52 weeks is 4,368 hours. Is Gov’t requiring all offeror’s to bid the 4,380 hours listed in Attachment-2 or should offeror’s adjust the hours bid to include R&R, or any other time off offeror’s provide their employees? Answer: The bid schedule list an estimate for hours. The number of workers for each job category will be listed on the funded task order. The contractor will be required to keep a daily log of the number of hours worked and labor category for each employee. The contractor will only be paid for hours worked on site. As stated the DRMO schedule is subject to change given the contingency environment.

(For example, 2% tax is requested for all projects at Afghanistan) Answer: See 252-229-7999 Taxes – Foreign Contracts in Afghanistan, located on Attachment 3 of the solicitation.

29. At PWS paragraph 7.0 pp13/46 it is stated the Government shall penalize contractor for sub-standard performance by making deductions from payments. Is it correct to characterize such deductions as “Liquidated Damages”? Is there an adjective as numerical scale by which such deductions are determined? If so, what is scale or other means of determining such deductions? Answer: There is no scale. The Government has the right to make deductions if the APLs / contract requirements are not being met. The contractor will be notified of any performance problems so they can correct any issues that are identified.

Should our offer reflect common practice or follow the solicitation? Answer: all employees shall be covered under Defense Base Act.

31. Question: Is the body Armor (Helmet/Chest Protector) to be purchased for all 154-160 personnel? Answer:

the contractor is responsible to provide all required body armor.
