J&A SP3300-22-F-0572 P00002
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:
DLA Distribution-J7, 5430 Mifflin Ave, Suite 3102A, New Cumberland, PA 17070-5008.
2. NATURE/DESCRIPTION OF ACTION/CONTRACT TYPE (INCLUDING ESTIMATED VALUE
AND PERIOD OF PERFORMANCE):
Request approval to issue a modification to Task Order SP3300-22-F-0572 for the extension of professional program management support services for the DLA Distribution Storage and Distribution (S&D) Business Development Office (BDO), New Cumberland, PA, under GSA OASIS contract GS00Q14OADU101. This action is a non-competitive performance period extension of an existing task order performed by Accenture Federal Services, LLC. The task order is being extended for a period of three (3) months, from 1 July 2023 through 30 September 2023. The extension increases the current task order amount from by to .
3. DESCRIPTION OF SUPPLIES/SERVICES:
DLA Distribution intends to extend professional program management support services under Task Order SP3300-22-F-0572 for an additional three (3) months in support of the Business Development Office (BDO) at New Cumberland, PA, in accordance with FAR 52.217-8 Option to Extend Services. The task order period of performance currently ends on 30 June 2023, and the extension will extend performance to 30 September 2023. The requirement covered by this option fulfill an existing need of the Government.
The DLA Distribution Storage and Distribution (S&D) Business Development Office (BDO), located at DLA Distribution, New Cumberland, PA has been established to pursue all Whole of Government (WoG) distribution work, as the DoD’s storage and distribution service provider. Successfully capturing WoG and new business requires analytical and process design as well as program management support. The work to be performed is in an office environment. The required services are commensurate with workload and/or available funding.
4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY:
Pursuant to the exception under FAR 16.505(b)(2)(i)(A), “the agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays”, only Accenture Federal Services, LLC, is capable of providing the services; award to any other source will result in unacceptable delays and cause disruption to the mission of the BDO.
Due to unanticipated issues with the new contract award, it has become necessary to modify existing Task Order SP3300-22-F-0572 to provide an extension of necessary services for a three (3) month period to provide DLA Distribution the time needed to resolve issues with the new contract award. The current professional support services requirement expires on 30 June 2023.
Accenture Federal Services, LLC, is a responsible source that currently understands the complex service requirements of the performance work statement. Accenture Federal Services, LLC, is the only source capable of realistically providing this requirement without a break in services. This proposed contract continuation action is for non-personal services whereby the current contractor, Accenture Federal Services, LLC, already possesses personnel with necessary clearances and expertise. Maintaining this staff will save the Government the cost of additional training and security clearances as well as time.

J&A SP3300-22-F-0572 P00002
To fulfill this immediate need through a competitive solicitation, an acquisition lead-time of 255+days, to include a 90-day transition period, would be required. Accenture Federal Services, LLC, has been performing the current effort and has the necessary management and expertise to continue to perform services and provide continuity until a contract awarded competitively can be put in place. Accordingly, the most effective course of action is to issue a modification to Task Order SP3300-22-F-0572 utilizing clause FAR 52.217-8.
Doing so will ensure continuation of these critical services while allowing adequate time for DLA Distribution to establish a competitive environment for these services.
6. SYNOPSIS ANNOUNCEMENT/POTENTIAL SOURCES:
On 12 June 2023, a notice of the Government’s intent to issue a sole source modification as required by FAR
5.201 and in accordance with procedures at FAR 6.302-1(d) was performed.
7. DETERMINATION OF FAIR AND REASONABLE COST:
To determine whether the contractor’s proposed price is fair and reasonable, the Contract Specialist and Contracting Officer reviewed the proposed price against current market pricing information for the same or similar services available. The price to the Government for the three (3) month extension is ; and is aligned with current contract costs. The costs associated with this three (3) month extension are a continuation of current Task Order SP3300-22-F-0572 pricing. The direct labor rates and indirect rates for the proposed extension of services reflects the same rates as previously accepted.
8. DESCRIPTION OF MARKET RESEARCH:
Based on present circumstances as outlined in the preceding paragraphs of this document, conducting market research to seek competition, or another method of acquiring these services, is not a meaningful action. The time it would take to perform the research, solicit, award, and mobilize a contractor for the interim period incorporated by modification (three-months) would cause unacceptable delays. However, the Contract Specialist performed an informal market survey to ensure that the prices for the extension are the best available prices in the current market. GSA Schedules for the same or similar labor categories were analyzed and compared to the pricing from Accenture Federal Services, LLC. The analysis determined that the price for the modification from Accenture Federal Services, LLC, is the best available price.
9. OTHER SUPPORTING FACTS:
N/A
10. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION:
This procurement action is for an extension modification of existing Task Order SP3300-22-F-0572, pursuant to FAR 52.217-8 entitled “Option to Extend Services (Nov 1999). Actions to increase future competition are being developed for the services required by this modification. A five (5) year IDIQ for the replacement contract was solicited as unrestricted full and open competition.
11. STATEMENT OF DELIVERY REQUIREMENTS:
The technical personnel and customer have provided a signed requirements justification showing that the service is still needed, and that funding has been provided for the effort. The period of performance for this effort shall be for a three (3) month period from 1 July 2023 through 30 September 2023.
