MEMORANDUM FOR RECORD
SUBJECT: Sole Source Solicitation /Contract #SP330020P0167
REFERENCE: FAR 11.105, DFARS/ PGI 211.105 or FAR 13.106(b)(1)(i)
1. Identification of the Agency and Contracting Activity DLA Distribution, DLA Distribution J7 BLDG 430 Mifflin Ave New Cumberland PA 17070
2. Describe the contract action, to include the dollar value and the type of limited justification.
This is a Sole Source action to be awarded as a Firm-Fixed Price contract to San Joaquin County doing business as (d/b/a) County Administrator (CAGE 0PS07). DLA Distribution San Joaquin, California (DDJC) requires an annual renewal of network access to the County and State Law Enforcement Telecommunications Systems (CLETS). The estimated value of this requirement is (Not to Exceed).
Therefore, this acquisition is conducted under FAR Part 13, Simplified Acquisition Procedures. The contract will be for a base period of one (1) year beginning on 11 January 2020. The contract will have two (2), one year option periods of performance through 10 January 2023.
3. Description of the Supplies/Services
The California Law Enforcement Telecommunications System (CLETS) service contract is required to ensure persons entering the installation are properly vetted and meet entry requirements. The service contract will also enable DLA Distribution San Joaquin Police Department to enter lost/stolen property, towed vehicles, etc. into National Crime Information Center (NCIC) to facilitate recovery efforts.
4. Justification Rationale for Use of Sole Source
Restriction of sources for this acquisition is justified in accordance with FAR 13.106- 1(b)(1)(i). San Joaquin County is the only provider for this service connection for DLA Distribution San Joaquin, California (DDJC).

A unique and direct connection was established initially years ago at the time of the first request, directly through the county connection. There is no other authorized service for this Law Enforcement requirement. Additionally, CLETS regulations and laws are governed by the State of California and therefore, it is required to go through the local county for these service requests. Failure to use the CLETS for this service requirement will result in mission failure regarding the mission of vetting individuals for installation access.
5. Market Research and Interested Sources
A “Notice of Intent to Award a Sole Source Contract” was posted to the Government Point of Entry (GPE) on 06 January 2020.
No responses were received and no other sources have the system or capabilities to provide this service.
6. Determination
In accordance with FAR 13.106-1(b)(1)(i), soliciting from a single source for purchases not exceeding the Simplified Acquisition Threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., - urgency, exclusive licensing agreements, brand name, or industrial mobilization). Therefore, San Joaquin County is the Only One Responsible Source known that will satisfy Agency requirements for continued services.

8. Fair and Reasonable
Issuing a sole source contract to San Joaquin County is the most advantageous method of fulfilling the Government’s need for uninterrupted CLETS service, price and other factors considered. The proposed prices for all years remain steady. There has been no substantive change in the requirement for this type of service.
In order to determine the price fair and reasonable for CLIN 0001, Data Line (T-1) service access, the Contract Specialist compared the vendor’s price quote against the Independent Government Cost Estimate (IGCE). Additionally, vendor’s price for CLIN

8. Fair and Reasonable (continued):
0001 of than the rate of per month that is being paid on the current contract for the same service. The pricing on the current contract was determined fair and reasonable based on comparison of the vendor’s quote to the IGCE and a comparison to similar services offered.
In order to determine the price fair and reasonable for CLIN 0002, Law and Justice Access (previously known as Transactions for Communication Services), the Contract Specialist compared the vendor’s price quote to prices for the same service they are providing to other customers. San Joaquin County provided a contract for the same CLETS Law and Justice Access services they are providing for the city of Stockton, CA.
San Joaquin County’s quote of for 12 months of service for the DDJC is determined to be fair and reasonable when compared to San Joaquin County’s contract price of for 12 months of service for the city of Stockton, CA.
