SOURCE SELECTION INFORMATION
SEE FAR 2.101 AND 3.104
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY
DLA Distribution-J7, 430 Mifflin Ave. Suite 3102A, New Cumberland, PA 17070.
2. NATURE/DESCRIPTION OF ACTION/CONTRACT TYPE (INCLUDING
ESTIMATED VALUE AND PERIOD OF PERFORMANCE)
This is a sole source action to be awarded as a follow on of contract SP3300-15-C-0004 with Lakota Solutions, LLC. The contract will be awarded as Time and Material for Preventative Maintenance (PM) and Remedial Maintenance (RM) of Government owned Material Handling Euipment (MHE) located at DLA Distribution Red River, TX (DDRT). The contract will be awarded in accordance with FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (Citation: 10 U.S.C.
2304(c)(1))”. The ceiling price for SP3300-19-Q-5009 will be and the contract may be extended for up to six (6) months or through February 29, 2020.
3. DESCRIPTION OF SUPPLIES/SERVICES
The Contractor shall provide all equipment maintenance services as set forth in the Performance Work Statement (PWS). The Contractor shall provide all labor, equipment, tools, materials, replacement parts, transportation, transportation permits, and supervision necessary to perform the PM and RM on Government owned MHE at DDRT. Detailed task specifications and requirements for contractor performance are provided in the PWS. The Government may extend the period of performance for up to an additional six (6) month period.
4. IDENTIFICATION OF STATUTORY AUTHORITY
FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (Citation: 10 U.S.C. 2304(c)(1)).
5. DEMONSTRATION OF CONTRACTOR'S UNIQUE QUALIFICATIONS
Option Period Two for SP3300-15-C-0004 expired on August 31, 2018. The term of that contract was extended an additional six (6) months in accordance with FAR 52.217-8, “Option to Extend Services”. That extension will expire on February 28, 2019. A follow-on preventative and remedial maintenance for equipment is being sought through the use of an enterprise contract. The procurement package for the long-term solution is nearing completion. The procurement package has experienced delays relative to updates to current equipment listings, equipment metric data necessary to maximize competition, and incorporation of vendor feedback received in response to a Request for Information.
Therefore, an award of a contract to Lakota Solutions, LLC enables seamless mission support by the incumbent contractor while finalization of the enterprise contract is completed. Any other alternative would create unacceptable delays in performing these services for DLA and potentially compromise mission support. The disruption of services through a competitive procurement would create substantial costs to the Government. Therefore, full and open competition is not feasible.
6. SYNOPSIS ANNOUNCEMENT/POTENTIAL SOURCES
A Notice of Intent to Award a Sole Source Contract will be synopsized and posted to the Federal Business Opportunities’ website to provide notice of the proposed sole source acquisition in accordance with FAR 5.201, “Synopsis of Proposed Contract Actions - General”. This information will be for informational purposes only.
7. DETERMINATION OF FAIR AND REASONABLE COST
Issuing a sole source contract to Lakota Solutions, LLC is the most advantageous method of fulfilling the Government’s need for uninterrupted MHE maintenance support, price and other factors considered. The proposed prices for all years remained steady since the award of the previous contract. There has been no substantive change in the requirement for this type of service. The resulting contract is anticipated to be awarded at the same amount or at an amount within a range reasonably near to that of the expiring contract.
The expiring contract SP3300-15-C-0004 was awarded on the basis of competition and competition is anticipated for the follow-on enterprise solution. The enterprise solution will be advertised on the Government Point of Entry, the Federal Business Opportunities website, where offerors can submit proposals. Although the solicitation for the expiring contract received competitive proposals, award to another source for this procurement would result in a substantial duplication of cost to the government that is not expected to be recovered through competition in addition to creating unacceptable delays in fulfilling the agency’s requirements. Therefore, Lakota Solutions, LLC is the Only One Responsible Source known that will satisfy Agency requirements for continued services.
8. DESCRIPTION OF MARKET RESEARCH
An informal market analysis of prices was performed and revealed that the prices previously submitted by Lakota Solutions, LLC during the length of the expiring contract to be competitive with similar types of contracts and labor categories in the region. The market survey indicates the rates and prices for this option period and corresponding extension are competitive. Therefore, the Contracting Officer determined the current pricing for the material handling equipment preventative and remedial maintenance to be fair and reasonable.
9. OTHER SUPPORTING FACTS
Not applicable.
10. LISTING OF INTERESTED SOURCE
Not applicable.
11. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION
A follow-on enterprise contract is in process with industry feedback and equipment metrics currently being incorporated. The follow-on contract award date is anticipated in Fiscal Year 2019. Therefore, a sole source award is recommended for this procurement to prevent a lapse in mission essential services.
12. STATEMENT OF DELIVERY REQUIREMENTS
The period of performance extension is for a six (6) month base with a six (6) month option for a total of up to twelve (12) months. Detailed task specifications and requirements for contractor performance are provided in the PWS.
13. TOTAL ESTIMATED DOLLAR VALUE OF THE ACQUISITION(S) COVERED BY
THIS J&A
The maximum dollar value of this procurement is This amount includes a six
(6) month base period and a six (6) month option period of Preventative and Remedial Equipment Maintenance. Funding has been approved and will be provided with the issuance of the contract.
