DLAD 52.213-9005 Contractor Past Performance Evaluation – Automated Systems.
(a) Past performance systems:
(1) The Defense Logistics Agency (DLA) will evaluate a Contractor’s past performance, including, but not limited to, their record of conforming to
RFQ SP3300-14-Q-0073 Page 8 of 39 specifications, conformance to the standards of good workmanship, adherence to contract schedules, and commitment to customer satisfaction. DLA utilizes information from Past Performance Information Retrieval System – Statistical Reporting (PPIRS-SR) in evaluation of Contractor past performance.
(2) The PPIRS-SR is a web-enabled, Government-wide application that collects quantifiable delivery and quality Contractor past performance information from the Department of Defense (DoD) contracting activities. PPIRS-SR is used for EProcurement acquisitions.
(3) Definition:
“Classification(s),” as used in this provision, means the PPIRS-SR assessment of a Contractor’s delivery and quality performance on past DoD contracts, including
DLA.
(4) PPIRS-SR classifications:
(i) Specific information as to how PPIRS-SR determines delivery and quality classifications can be found in PPIRS Reference Material, specifically the “PPIRS-SR Evaluation Criteria” document on the PPIRS-SR Website at http://www.ppirs.gov/ppirsfiles/reference.htm.
(ii) Data sources for PPIRS-SR information can be found in the PPIRS-SR Reference Material, “PPIRS-SR Evaluation Criteria” document on the PPIRS-SR Website at http://www.ppirs.gov/ppirsfiles/reference.htm.
(iii) PPIRS-SR makes negative quality and delivery data reflected in the PPIRS- SR Classification available to Contractors for review and challenge. This is accomplished within the PPIRS-SR system.
(5) Evaluation using PPIRS-SR classifications.
(i) The Contracting Officer may consider the volume of business on which the FSC score is based as a measure of confidence in the score’s indication of performance risk. Contractors with no performance history for the particular FSC or any other FSC for the timeframe being rated will be evaluated neither favorably nor unfavorably Specifics as to how PPIRS-SR calculations are affected when there is no delivery or quality information provided by the source databased can be found in the PPIRS Reference Material, specifically the “PPIRS-SR Evaluation Criteria” document on the PPIRS-SR Website at http://www.ppirs.gov/ppirsfiles/reference.htm.
(ii) Classifications are calculated based upon three years of data.

RFQ SP3300-14-Q-0073 Page 9 of 39
(iii) In the case of a Contractor without a record of relevant past performance or for whom information on past performance is not available in the PPIRS-SR, the Contractor will be evaluated neither favorably nor unfavorably on past performance.
(iv) Contractor-caused discrepancies or delinquencies will be reflected in a Contractor's past performance assessment. Repair, replacement or reimbursement of quality and packaging defects will not provide relief of negative DLA performance data. Contractor-caused delivery extensions, regardless of consideration paid, will normally be reflected in the delivery score.
(6) The Contracting Officer may collect and analyze other information in addition to PPIRS-SR past performance information.
(End of Provision)
DLAD 52.233-9000 AGENCY PROTESTS
(a) Companies protesting this procurement may file a protest (1) with the contracting officer, (2) with the Government Accountability Office (GAO), or (3) pursuant to Executive Order Number 12979, with the Agency for a decision by the Activity’s Chief of the Contracting Office.
(b) Protests filed with the agency should clearly state that they are an "Agency Level Protest under Executive Order Number 12979."
(Note: Defense Logistics Agency (DLA) procedures for Agency Level Protests filed under Executive Order No. 12979 allow for a higher level decision on the initial protest than would occur with a protest to the contracting officer; this process is not an appellate review of a contracting officer's decision on a protest previously filed with the contracting officer). Absent a clear indication of the intent to file an agency level protest, protests will be presumed to be protests to the contracting officer.
(End of Provision)
DLAD 52.233-9001 DISPUTES: AGREEMENT TO USE ALTERNATIVE
DISPUTE RESOLUTION (ADR)
(a) The parties agree to negotiate with each other to try to resolve any disputes that may arise. If unassisted negotiations are unsuccessful, the parties will use alternative dispute resolution (ADR) techniques to try to resolve the dispute.

RFQ SP3300-14-Q-0073 Page 10 of 39
(b) Before either party determines ADR inappropriate, that party must discuss the use of ADR with the other party. The documentation rejecting ADR must be signed by an official authorized to bind the contractor (see Federal Acquisition Regulation (FAR) clause 52.233-1), or, for the Agency, by the contracting officer, and approved at a level above the contracting officer after consultation with the ADR Specialist and with legal. Contractor personnel are also encouraged to include the ADR Specialist in their discussions with the contracting officer before determining ADR to be inappropriate.
(c) The offeror should check here to opt out of this clause
[ ] Alternate wording may be negotiated with the contracting officer.

SUBCONTRACTING PLAN (REQUIRED FROM LARGE BUSINESS ONLY)
A subcontracting plan shall be required upon notification and prior to contract award when the apparently successful offeror is “other than small”. (Reference:
FAR 19.708(b) and DFARS 219.708(b)(1)(A).)
The submission of a subcontracting plan is required within three business days following notification by the Contracting Officer or Acquisition Specialist and should address the broadest possible scope of small business participation. The apparent successful offeror (large business only) shall demonstrate its understanding and commitment to the utilization of small business concerns by addressing the following information in their subcontracting plan:
PROPOSED SUBCONTRACTING EFFORTS
The subcontracting plan is a submittal requirement under the solicitation and will be a factor in determining contractor responsibility. The solicitation contains FAR clause 52.219-9, “Small Business Subcontracting Plan”. In order to be determined responsible, the Subcontracting Plan described and required by the referenced clause (all 11 elements) must be submitted within the time specified by the Contracting Officer and shall demonstrate a commitment to providing subcontracting opportunities to small business. The plan shall be included and made a part of the contract award document.
A sample Subcontracting Plan format is attached to the solicitation and should be used for this purpose to the maximum extent possible. The sample Plan format requires the submission of subcontracting goals based on a percentage of subcontract value and as a percentage of total contract value.
The Contracting Officer's assessment of appropriate subcontracting goals for this acquisition, expressed as a percent of subcontract value, are as follows:
RFQ SP3300-14-Q-0073 Page 11 of 39
Small Disadvantaged Business Concerns (includes HBCU/MI)
5.0%
Women Owned Small Business Concerns
5.0%
HUB Zone Small Business Concerns 3.0% Service-Disabled Veteran-Owned Small Business Concerns / Veteran- Owned Small Business Concerns
3.0%
Small Business (DLA Enterprise Goal)
32.0%
The goals included in the offeror’s Subcontracting Plan may be higher, lower, or the same as the goals stated above, depending upon the offeror’s independent assessment. However, the offeror is encouraged to propose goals that are equivalent to, or greater than those recommended above.
The goals and dollars for each small business category as proposed by the contractor shall be clearly stated on the sample Plan format. Cage codes shall also be provided for the offeror and for each proposed small business subcontractor (reference sample format, page 4). In no case are “zero” goals acceptable. Statutory goals of 23 percent for Small Business overall; 5 percent for Small Disadvantaged Business; 5 percent for Women-Owned Small Business; 3% for HUBZone Small Business; and 3% for Service-Disabled Veteran-Owned Small Business should be considered minimum targets. Failure to submit a plan, which shows good faith effort to use Small Business, Small Disadvantaged Business, Woman-Owned, HUBZone, or Service-Disabled Veteran-Owned Small Business concerns will also be a factor in determining responsibility. Any successful offeror that is unable to comply with the requirement to submit a plan or to demonstrate a commitment to small business may be considered nonresponsible. This is a Contracting Officer judgement and determination.
The offeror is advised that a subcontracting proposal will not be rejected solely because the submitted Plan does not meet the recommended goals. If the offeror cannot meet some or all of the goals specified or subcontracting opportunities for small business are very limited for this acquisition, complete rationale/justification shall be provided on the last page of the subcontracting plan sample format. Use of the sample plan format attached to the solicitation is strongly recommended. Failure to use this format may be cause to reject the Subcontracting Plan as unacceptable.
The successful contractor must agree to submit, and ensure its subcontractors submit, the required subcontracting reports. Subcontracting Reports are to be submitted to the eSRS http://www.esrs.gov/) within 30 days after the close of each reporting period as indicated under paragraph 10 of the sample format. For http://www.esrs.gov/
RFQ SP3300-14-Q-0073 Page 12 of 39 purposes of eSRS reporting and in accordance with DFARS 252.219-7003, the successful prime contractor (if a large business) shall submit an electronic notification for each ISR report directly to the Contracting Officer at the procuring activity. The Contracting Officer will be identified on page 1 of the contract award document.
19. OFFER SUBMISSION INSTRUCTIONS–Quotes must include the following items. Submission of a quote that does not contain all items requested below may result in elimination from consideration for award.

RFQ SP3300-14-Q-0073 Page 13 of 39

Any offeror whose quote has been determined technically acceptable will then have its quote evaluated for the lowest price.
The following criteria shall be used to establish technical acceptability:

The Government is not limited to the information provided above, but reserves the right to independently seek past performance information through open market contacts, government systems, and other government agencies.
Information from Past Performance Information Retrieval System – Statistical Reporting (PPIRS-SR) will be utilized in evaluation of Contractor past performance in accordance with DLAD 52.213-9005 Contractor Past Performance Evaluation – Automated Systems.
Options – The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the base year. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
