DEFENSE LOGISTICS AGENCY
DLA DISTRIBUTION
430 MIFFLIN AVENUE, SUITE 3102A
NEW CUMBERLAND, PENNSYLVANIA 17070-5008
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:
DLA Distribution-J7, 430 Mifflin Ave. Suite 3102A, New Cumberland, PA 17070.
2. NATURE/DESCRIPTION OF ACTION/CONTRACT TYPE (INCLUDING
ESTIMATED VALUE AND PERIOD OF PERFORMANCE):
This is a sole source action to be awarded as an increase in the ceiling price of Indefinite Delivery Indefinite Quantity (IDIQ) contract SP3300-14-D-5001 with URS Federal Services, Inc. The current DLA Distribution contract SP3300-14-D-5001 has a ceiling value of $35,000,000.00. The follow-on procurement is in process through the Navy; however, it will not be completed prior to the end of the current Task Order. The Navy has requested that DLA Distribution extend the period of performance for the last Task Order to enable it time to award and support transition services. To support this request, an increase of 15% (or $5,250,000.00) of the current ceiling value is required. The new ceiling price will be $40,250,000.
3. DESCRIPTION OF SUPPLIES/SERVICES:
The contractor is responsible for performing Hazardous Materials Management services as a Third Party Logistics (3PL) product provider with the responsibility for standardizing and lowering the cost of procurement, receipt, storage, issue, tracking, and reuse of Hazardous Materials (including compressed gases) for DLA HQ supporting the Marine Corps and Navy organizations located at Camp Shields, Camp Lester, Camp Foster, Camp Butler, Camp Kinser, Camp Courtney, Camp Hansen, Camp Schwab, Kadena AFB, and MCAS Futenma.
4. IDENTIFICATION OF STATUTORY AUTHORITY:
10 U.S.C. 2304(c)(1) Only One Responsible Source/Limited Number of Responsible Sources and No Other Supplies or Services Will Satisfy Agency Requirements (FAR 6.302-1).
5. DEMONSTRATION OF CONTRACTOR'S UNIQUE QUALIFICATIONS:
The Navy has requested DLA Distribution issue a task order to extend services to mitigate the potential for a lapse in service. Due to the anticipated short timeframe of extension, unique qualifications of personnel, number of in process tasks and material procurements, level of expertise, knowledge and familiarity with the HMMS system, it is determined that any other alternative would create unacceptable delays in performing these services for DLA. Disruption of services through a new procurement, instead of increasing the ceiling, would create substantial costs to the Government. Any gap in support of this mission may directly jeopardize the DLA http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/06.htm#P82_11000
Distribution mission and potentially prevent support to the warfighter. Therefore, full and open competition for this effort is not feasible.
6. SYNOPSIS ANNOUNCEMENT/POTENTIAL SOURCES:
A Justification & Approval (J&A) special notice will be posted to the Federal Business Opportunities’ website to notify the proposed sole source acquisition to increase the ceiling price. This information will be for informational purposes only.
7. DETERMINATION OF FAIR AND REASONABLE COST:
Increasing the ceiling price is the most advantageous method of fulfilling the Government’s need for uninterrupted Hazardous Materials Management services, price and other factors considered.
There has been no substantive change in the requirement for this type of service. The labor pricing for the extension are competitive with similar types of contracts and labor categories in the region. The rates and prices for this contract were competitively awarded. Therefore, the Contracting Officer determined the current hourly rates established in the contract are fair and reasonable.
8. DESCRIPTION OF MARKET RESEARCH:
The follow on procurement for these services is pending award. Additional market research will have no bearing on the increase to the contract ceiling price.
9. OTHER SUPPORTING FACTS:
Not applicable.
10. LISTING OF INTERESTED SOURCES:
Not applicable.
11. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION:
The Navy is already in the process of preparing the award of the follow-on contract. The follow on procurement is being solicited using competitive procedures. Due to a delay in the award process, it is recommended that the contract ceiling price be increased in order to allow the incumbent contractor to continue work and to prevent a lapse in essential services.
12. STATEMENT OF DELIVERY REQUIREMENTS:
Detailed task specifications and requirements for Contractor performance are provided via the issuance of individual task orders under this contract.
13. TOTAL ESTIMATED DOLLAR VALUE OF THE ACQUISITION(S) COVERED BY
THIS J&A.
The ceiling price will be increased from $35,000,000.00 to $40,250,000.00. As an Indefinite Delivery / Indefinite Quantity contract, full funding for this option period at the basic contract level is not required. The contract minimum was awarded with the issuance of task order 0001 in the base year. Task orders were issued during the Base Year, Option Years One, Two, Three, and Four. Funding is provided with the issuance of task orders and associated extensions.
The Acquisition Specialist for this acquisition is Julie M. Leasure, phone 717-770-4086.
