About this file
This document is a Request for Special Procurement (SP) issued by the Oregon Department of Corrections (ODOC) for the purchase of wireless radio diagnostic equipment, specifically the Locus Diagnostics MX-3000, NX-200, NX-AFC-C, and extended warranties. The ODOC intends to procure this equipment as a sole source from Locus Diagnostics, LLC, the only known manufacturer of the desired technology. The SP covers a contract term from March 14, 2023 to March 14, 2033 with a total estimated cost of $650,000. The ODOC will issue a public notice regarding approval of the SP on the OregonBuys eProcurement system for seven calendar days, during which any affected party may protest. If no protests are received or sustained, the ODOC will proceed with issuing a contract to Locus Diagnostics, LLC.
The pricing provided in the document includes unit costs for the MX-3000 master unit, NX-200 remote receivers, and NX-AFC-C AFC meter options, as well as shipping and handling charges and extended warranty pricing for the second year. Payment terms are net 30 days, payable to Locus Diagnostics, LLC. The sole source justification is based on Locus Diagnostics, LLC being the only manufacturer of the DiagnostX, MX, NX, and PX series over-the-air radio analyzers, which are patented technologies.

Special Procurement S-29100-00006134 Locus Diagnostic Equipment Page 1 of 3
REQUEST FOR SPECIAL PROCUREMENT No. S-29100-0006134
PART A. Requesting Agency must complete Items 1 through 13.
1. Requesting Agency Name: Oregon Department of Corrections (ODOC)_______
2. Date of Request: Feb 10, 2023 3. Agency Number: 29100
4. Agency Contact Name: Nate Lowe 5. Phone: 503-559-9547
6. Type of Request: Class Special Procurement _X__ Contract-specific Special Procurement
7. Time Period Requested: From: 3/14/2023 To: 3/14/2033
8. Total Estimated Cost: $650,000.00
9. Title: Supplies and/or Services to be Acquired:
Wireless radio diagnostic equipment, specifically the Locus Diagnostics MX-3000, NX-200, NX-AFC-C and extended warranties.
10. Request, Background, Current Need, and Proposed Contracting Procedure:
a. Request:
The ODOC intends to purchase the Locus Diagnostic equipment whose functionality is only available from Locus Diagnostics – they are the sole source of the technology.
b. Background:
The mission of the Oregon Department of Corrections (ODOC) is to promote public safety by holding offenders accountable for their actions and reducing the risk of future criminal behavior. One of the tools that the department uses to full fill our mission is a modern P25 trunked radio system to provide critical communications 24/7 which is maintained by the Wireless Communications Unit (WCU) of ODOC. The radio system is a complex system of nearly four thousand portable and mobile radios that requires appropriate maintenance to comply with Federal Communications Commission (FCC) rules. Currently, the portable and mobile radios receive repairs only after they suffer from physical damage such as broken antennas or knobs. The physical repairs are made and then tested for compliance with FCC rules before it is returned to service. The reactive repair model of break-fix does not provide the opportunity to identify and service portable and mobile radios that are out of compliance with FCC rules, but do not have any physical damage. The FCC requires the radio licensee, ODOC WCU, to utilize a “…suitable procedure to determine that the carrier frequency…of each
Locus Diagnostic Equipment Page 2 of 3 transmitter…is in…tolerance…” and utilize a “…suitable procedure to determine that the modulation…of each transmitter…does not exceed limits…” as required by Title 47 Chapter I Subchapter D Part 90 Subpart I § 90.215.
The Locus USA DiagnostX over-the-air radio waveform analyzer system will be used to identify portable and mobile radios that need maintenance, in a near real time fashion, every time the portable and mobile transmitter is used. The data collected will be presented in a report summarizing the measurements which will identify the portable and mobile radios that need maintenance. By being proactive, instead of reactive, and focusing only on the equipment that needs maintenance, the WCU will save several man-years of time and more portable and mobile radios will remain in service and ready to be used by the department for critical communications.
c. Current Need:
To procure an instrument that has the ability for DOC to identify two-way radios in need of service by measuring the radio alignment and operating characteristics touch-free, over-the-air in real-time, without user intervention.
d. Proposed Contracting Procedure:
• As required by Oregon Administrative Rule (“OAR”) 125-247-0287, DOC will issue a public notice regarding approval of the SP on the OregonBuys eProcurement system for a period of seven (7) calendar days.
• The public notice will include provisions that any affected party may protest the approval of SP.
• DOC will respond to and resolve all protests, if any.
• If no protests to this SP are received or sustained, DOC will proceed with issuing a contract to Locus Diagnostic, LLC.
11. Justification for use of Special Procurement: Describe the circumstances that justify the use of a Special Procurement. Attach relevant documentation.
Locus Diagnostic, LLC is the only known manufacturer of the desired technology The supporting documentation is attached to this SP as Attachment A.
12. Findings to Satisfy the Required Standards: This proposed special procurement:
X (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:
Locus Diagnostic, LLC is the only manufacturer/supplier of the DiagnostX, MX, NX and PX series over-the-air radio analyzers and therefore will not affect competition.
and
Locus Diagnostic Equipment Page 3 of 3
X (b)(i) will result in substantial cost savings to the contracting agency or to the public because:
Locus Diagnostic, LLC is the sole proprietor of the needed instruments and therefore completing the procurement process would not provide different results; therefore the state has provided a cost savings by awarding directly to the vendor.
or
______ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:
13. Signature: The actual signature of the Agency Head or designee (e.g., Designated Procurement Officer) is not required on the Request if it is submitted through OregonBuys.
Agency may elect to attach a signed Request.
