STATEMENT OF WORK

TITLE: Commercial Safety Data Sheet Authoring Software

LAB REQUESTING SERVICE: Material Measurement Laboratory

I. BACKGROUND INFORMATION

The National Institute of Standards and Technology (NIST) supports accurate and compatible measurements by certifying and providing over 1300 Standard Reference Materials® with well-characterized composition or properties, or both. Industry, academia, and government use NIST SRMs to facilitate commerce and trade and to advance research and development. The United States Occupational Safety and Health Administration’s (OSHA) Hazard Communication Standard (HCS), 29 CFR 1910.1200, requires that manufacturers classify the hazards of the chemical products they produce. Additionally, manufacturers must provide information about the classified hazards of their chemical products to downstream users by developing and providing Safety Data Sheets (SDSs) and “shipped” container labels. The HCS provides specific requirements regarding the hazard classification process and the required content and format for SDSs and “shipped” container labels for “hazardous chemicals” (as defined in the HCS). The HCS chemical manufacturer requirements also apply to “laboratories” (as defined in OSHA 29 CFR 1910.1450, Occupational Exposure to Hazardous Chemicals in Laboratories) when the hazardous chemicals will be shipped from the laboratory workplace. The NIST’s Office of Reference Materials is responsible for producing Safety Data Sheets for hazardous chemical SRMs and samples shipped from NIST, with a projected demand of 600+ custom SDSs per year.

II. SCOPE OF WORK

The Vendor shall provide cloud-hosted software that creates a Draft SDS according to OSHA Hazard Communication Standard (HCS), 29 CFR 1910.1200, when a chemical composition is entered in the system using Chemical Abstracts Service (CAS) numbers and percentages for each of the components.

III. REQUIREMENTS

1. Cloud-hosted commercial software shall create a Draft SDS according to OSHA Hazard

Communication Standard (HCS), 29 CFR 1910.1200, when a chemical composition is entered in the system using Chemical Abstracts Service (CAS) numbers and percentages for each of the components.

o The Software shall automatically pull information from database(s) that contain relevant physical, chemical, and health information (data, end points, etc).

o The Software shall automatically calculate Acute Toxicity Estimates, based on the composition entered.

2. The software shall meet NIST IT security requirements or approval.

3. Data shall come from OSHA’s key and recommended sources of information related to health effects, physical and chemical properties, as outlined in OSHA Publication 3844 “Hazard Communication: Hazard Classification Guidance for Manufacturers, Importers, and Employers.”

4. The vendor shall provide operational training in the use of the software to four (4) NIST personnel within five (5) business days of installation of software.

5. The vendor shall provide a phone number for technical support throughout the period of performance.

6. The software shall allow for an unlimited number of authored SDS.

7. The software shall allow access to unlimited CAS numbers for organic/inorganic substances, alloys, coordination compounds, minerals, mixtures, polymers, salts, etc.

8. If a CAS number is not found in the software database, COR/SME will contact the vendor, who shall add it to their system within five (5) business days.

9. The software shall allow for up to two (2) concurrent users in the system.

10. The software shall allow users’ input on the classification before the draft is completed

11. The software shall address all required sections of the SDS, specific requirements are listed below:

o Allow the use of an SDS formatting template that includes the NIST logo, address, contact info, and free text entry for the “Recommended Use of This Material and Restrictions of Use” in Section 1 of the SDS.

o Display in Section 2 of the SDS the applicable OSHA mandatory label elements with the Hazard and Precautionary statements in list form and each with their corresponding United Nations GHS (Globally Harmonized System of Classification and Labelling of Chemicals) unique alphanumeric codification number.

o Produce an SDS that shows in Section 11, the data, findings, estimated acute toxicity, and rationale used to arrive at the classification shown in Section 2 of the SDS.

o List Exposure Limits from NIOSH, ACGIH, and OSHA in section 8 of the SDS o List Physical and Chemical properties as entered by the user or as calculated by the software in section 9 of SDS.

o Allow user input for Section 14 in the SDS o List regulatory information in section 15 of the SDS for CERCLA Sections 102a/103

(40 CFR 302.4); SARA Title III Section 302 (40 CFR 355.30); SARA Title III Section 304 (40 CFR 355.40); SARA Title III Section 313 (40 CFR 372.65); OSHA Process Safety (29 CFR 1910.119); SARA Title III Sections 311/312 Hazardous Categories (40 CFR 370.21); California Proposition 65; U.S. TSCA Inventory; and TSCA 12(b), Export Notification o List the sources of data and/or its own name as a source, as well as a NIST-provided disclaimer in section 16 of the SDS.

o Produce the SDS in the following formats Rich Text Format (RTF) or HyperText Markup Language (HTML), and

IV. WARRANTY

The vendor shall warrant that the software will function as specified in the Statement of Work. Any errors in the output or software errors will be corrected within ten (10) business days. The warranty will commence upon government acceptance and be in effect for the entire period of performance.

V. PERIOD OF PERFORMANCE

The period of performance shall be 1 year base and 4 (1yr) option periods.
