Statement of Work

(SOW)

Linehaul Services

I. GENERAL INFORMATION

a. SCOPE OF WORK: The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary to perform Linehaul Services, as defined in this SOW.

b. SUMMARY OF WORK: Transport the following 36 pieces of equipment from Pease Air National Guard Base, Portsmouth NH to the Littleton National Guard Armory, Littleton NH. See attached equipment list for weights and dimensions.

1. Three (3) each - 20-foot containers,

2. Three (3) each - quadcon containers,

3. Twenty-one (21) each - vehicles,

4. Five (5) each - trailers

5. Four (4) each - generators

The US Government will provide equipment and assistance to load and unload equipment onto trucks for the contractor to transport between locations.

c. WORK LOCATION and :

a. Pickup equipment at Pease Air National Guard Base, 302 Newmarket St, Portsmouth NH 03801

b. Deliver equipment to Littleton National Guard Armory, 350 Meadow St, Littleton NH 03561

d. PERIOD OF PERFORMANCE: Between 30 April 2024 to 15 May 2024.

II. SPECIFIC TASKS

a. PRE-MOVEMENT MEETING: The contractor will attend a meeting to discuss the movement of equipment.

b. INSPECTION OF EQUIPMENT: The contractor is responsible for inspecting all vehicles and equipment prior to leaving Pease ANGB. The contractor will make note of and report any damage to the KO.

c. LOADING OF EQUIPMENT: The US Government will provide licensed personnel to utilize required forklifts to move equipment from storage area on Pease Air National Guard Base to the contractor provided truck, as well as licensed personnel to drive vehicles onto contractor provided truck.

d. TRANSPORTATION: The contractor will secure equipment and vehicles to contractor provided truck and transport all equipment from Pease Air National Guard Base to Littleton National Guard Armory.

e. UNLOADING OF EQUIPMENT: The US Government will provide licensed personnel to utilize required forklifts to move equipment from the contractor provided truck into storage area at National Guard Armory, as well as licensed personnel to drive vehicles off contractor provided truck.

f. ACCIDENT PROCEDURES: the Contractor shall immediately report accidents or incidents involving vehicles under this contract, including accidents with injuries, or accidents resulting in the damage or loss of U.S. Government property to the KO.

III. PERSONNEL

a. The Contractor shall furnish all properly licensed personnel to secure and transport cargo from Pease Air National Guard Base to Littleton National Guard Armory.

b. The US Government shall furnish properly licensed personnel to load equipment at Pease Air National Guard Base as well as to unload equipment at Littleton National Guard Armory.

IV. DEFINITIONS AND ACRYNOYMS

a. CONTRACTOR: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

b. DELIVERABLE. Anything that can be physically delivered and includes non-manufactured items such as meeting minutes or reports.

c. CONTRACTING OFFICER (KO): A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

d. PHYSICAL SECURITY: Actions that prevent the loss or damage of Government property.

e. QUALITY ASSURANCE: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

f. QUALITY CONTROL: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

g. SUBCONTRACTOR: One that enters into a contract with a prime contractor. The Government does not have privacy of contract with the subcontractor.

h. WORK DAY:

i. Schedule normal work by Contractor and Subcontractor personnel between the hours of 8:00 AM to 4:00 PM, Monday through Friday, excluding Federal holidays. If the Contractor desires to work during periods other than above, submit a written request (e-mail is acceptable) for each such occurrence to the Contracting Officer at least 3 working days in advance of the proposed event, so that the Government may make special inspection and/or security arrangements. The Contracting Officer may decline approval. Contractor may have to work outside the normal work schedule to complete delivery; when this occurs, contractor shall adjust the work schedule or pay overtime. There will be no change associated with the change in schedule.

ii. Access to Pease Air National Guard Base through the commercial gate from 0600-1400 M-F.

iii. Access Littleton National Guard Armory from 0800-1600 M-F.

iv. Any work at the Government site shall not take place on Federal holidays or weekends unless directed by the Contracting Officer (KO). However, if required, the KO may designate the Contractor to work during holidays and weekends.

v. There are eleven (11) Federal holidays set by law (USC Title 5 Section

6103) that The National Guard follows:

1. New Year’s Day: January 1st

2. Martin Luther King, Jr.’s Birthday: January 15th

3. President’s Day: February 19th

4. Memorial Day: May 27th

5. Juneteenth National Independence Day: June 19th

6. Independence Day: July 4th

7. Labor Day: September 2nd

8. Columbus Day: October 14th

9. Veteran’s Day: November 11th

10. Thanksgiving Day: November 28th

11. Christmas Day: December 25th

V. FACILITIES

a. GENERAL

i. All Contractor employees, including subcontractors, and subcontractors’ employees, suppliers, and suppliers’ employees shall be required to comply with the Installation Security Requirements regarding personnel, vehicle, and equipment security passes and access the jobsite. Nothing in the contract shall be construed in any way to limit the authority of the Commanding Officer to prescribe new, or to enforce existing security regulations governing the admission or exclusion of persons and the conduct of persons while on base, including but not limited to, the rights of search of all persons or vehicles on base.

ii. Contractor employees shall conduct themselves in a proper, efficient, courteous and businesslike manner. Remove from the site any individual whose continued employment is deemed by the Contracting Officer to be contrary to the public interest or inconsistent with the best interests of National Security.

iii. The Contractor is expected to become fully acquainted with, and strictly adhere to Readiness regulations affecting the performance of this Contract. Parts of the regulations pertaining to fire prevention, driving safety, restricted areas, sanitation, disposal of debris and pollution control may apply to this project.

b. COORDINATION

i. Coordinate with the Contracting Officer for specific security and access requirements.

ii. Access to Buildings/ Occupied Buildings: The Contractor may work in or around existing occupied buildings. The Contractor is responsible, via the Contracting Officer, to obtain access to building and facilities and arrange for them to be opened and closed. Do not enter the building(s) without prior approval of the Contracting Officer. Keep the existing buildings and their contents secure at all times. Provide temporary closures as required to maintain security. Contract personnel will not be permitted in security-regulated buildings or areas unless cleared by the Security Officer.

c. CONTRACTOR VEHICLES

i. All vehicles shall display a valid state license plate and safety inspection sticker, if applicable, and shall be maintained in good repair. The company name shall be displayed in a clearly visible manner and size on each Contractor vehicle used in the course of work. Registration and proof of insurance shall be kept in the vehicle, and drivers shall be properly licensed.

d. SECURITY REQUIREMNTS

i. All security requirements apply to all subcontractors and suppliers associated with this contract. Comply with the following:

1. All Contractor employees, including subcontractors, and subcontractors’ employees, suppliers, and suppliers’ employees shall be required to comply with the Installation Security Requirements regarding personnel, vehicle, and equipment security passes and access the jobsite. Nothing in the contract shall be construed in any way to limit the authority of the Commanding Officer to prescribe new, or to enforce existing security regulations governing the admission or exclusion of persons and the conduct of persons while on base, including but not limited to, the rights of search of all persons or vehicles on base.

2. Contractor Personnel: Provide the Contracting Officer the name(s) of the supervisory person(s) authorized to act for the Contractor. Provide, and update as required, a list of the key personnel for the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency.

3. Access to Buildings/ Occupied Buildings: The Contractor may work in or around existing occupied buildings. The Contractor is responsible, via the Contracting Officer, to obtain access to building and facilities and arrange for them to be opened and closed. Do not enter the building(s) without prior approval of the Contracting Officer. Keep the existing buildings and their contents secure at all times. Provide temporary closures as required to maintain security. Contract personnel will not be permitted in security-regulated buildings or areas unless cleared by the Security Officer.

4. The use of base roads will be subject to base regulations including speed limits, requirement to wear seat belts, prohibition on the use of hand-held telephones by drivers, and wear of protective equipment by motorcycle operators.

5. Contractor employees and representatives performing work under this contract are required to be either United States citizens or documented legal residents.

All Contractor employees shall obtain the required contractor identification.

Each employee shall wear the Government issued identification over the front of the outer clothing. Failure to obtain security and base access passes shall not be a cause for contract performance time extension. The Contractor shall immediately turn in all terminated employee’s badges to the issuing office.

6. Personnel will be issued appropriate identification badges when the Contractor submits, in writing, on a form prescribed by the Contacting Officer, a request for issuance of badges. Employees shall complete questionnaires and other forms as required for security. Allow 10 business days for background checks and processing. The list shall contain the following information:

1. Fill out Authorized release (vetting form) authorization (provided after contract award)

2. Fill out a Contractor Entry Pass Form

3. Complete AT Level I training indicated below

4. Send all complete documents to: Richard.C.Trafton.civ@army.mil

5. Rejected base passes will be sent back via email with corrections mailto:Richard.C.Trafton.civ@army.mil

6. Anti-Terrorism (AT) Level I Training: This standard language is for Contractor employees with an area of performance within a Government controlled installation, facility or area. All Contractor employees, to include subcontractor employees, requiring access to Government Installations, Facilities and Controlled Access areas shall complete AT Level I Awareness Training within seven (7) calendar days prior to start/notice to proceed date annotated on the contract. The Contractor should register their Contractor employees and subcontractors immediately to avoid a Contractor delay. Registration at a minimum is 48 hours.

a. Instructions for Anti-Terrorism (AT) Level I Training:

i. Training is available through the website http://jko.jten.mil

ii. Two (2) hour average to complete training

iii. Government sponsor: Will be provided after award

7. All security requirements apply to all subcontractors and suppliers associated with this contract. Comply with the following:

i. Do not publicly disclose any information concerning any aspect of the materials or services relating to this contract, without prior written approval of the Contracting Officer.

ii. Do not disclose or cause to be disseminated any information concerning the operations of the activity’s security or interrupt the continuity of its operations.

iii. Do not disclose any information to any person not entitled to receive it. Failure to safeguard any classified information that may come to the Contractor or any person under his control, may subject the Contractor, his agents or employees to criminal liability under 18 U.S.C., Sections 793 and 798.

iv. Direct to the Contracting Officer for resolution all inquiries, comments or complaints arising from any matter observed, experienced, or learned as a result of or in connection with the performance of this contract, the resolution of which may require the dissemination of official information.

v. Coordinate photography requirements with the Contracting Office. Some areas restrict or prohibit photographing Government property.

vi. Deviations from or violations of any of the provisions of this paragraph will, in addition to all other criminal and civil remedies provided by law, subject the Contractor to immediate termination for default and withdrawal of the Government’s acceptance and approval of employment of the individuals involved.

vii. Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office.

viii. Failure to comply with these requirements may result in withholding of final payment.

e. COMBATING TRAFFICKING IN PERSONS:

i. The United States Government has adopted a zero-tolerance policy regarding trafficking in persons. Contractors and contractor employees shall not engage in severe forms of trafficking in persons during the period of performance of the contract; procure commercial sex acts during the period of performance of the contract; or use forced labor in the performance of the contract. The Contractor shall notify its employees of the United States Government’s zero tolerance policy and the actions that will be taken against employees for violations of this policy. The contractor shall take appropriate action, up to and including termination, against employees or subcontractors that violate the US Government policy as described at FAR 22.17.

f. ORGANIZATIONAL CONFLICTS OF INTEREST:

i. The contractor and subcontractor personnel performing services under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent OCIs, as defined in FAR Subpart 9.5. The contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO. In the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may impose other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.
