Educational Services Forklift Operator Certification/Safety Training Class

STATEMENT OF WORK

Introduction:

The Bureau of Prisons, Federal Correctional Institution, Texarkana, Texas, intends to establish a Purchase Order Contract for the provision of Forklift Operator Certification/Safety Training Class. The forklift operator provider will provide services for the male adults in custody incarcerated at the Satellite Prison Camp (SPC) located at the Federal Correctional Institution in Texarkana, Texas. General information regarding the Federal Bureau of Prisons (BOP), its facilities, and referenced Program Statements can be located at www.bop.gov. The Government reserves the right to award without discussion and to award as a single award. Therefore, each initial quote should contain the quoter's best terms from a cost or price standpoint.

Place of Performance:

The services will be rendered off-site at a college or training facility. The services will be performed in a classroom/testing center setting and area to perform hands on skills testing.

Schedule:

The requirement for these services will consist of estimated 1 session for each Forklift Operator Certification class. Each session will be defined as one (10) hour in length session. Working hours will normally be between 8:00 am and 6:00 pm, Fridays on an as-needed basis. The supervisor of Education will be responsible for defining each group of adults in custody who make up each class session. The services, being professional in nature, will be provided in the method considered normal in the local community. The performance of these services will also be verified by the designated Contracting Officer's Representative (COR).

Due to the nature of the correctional setting, delays in the arrival of adults in custody may be expected. Such delays may include but are not limited to inclement weather, electrical or mechanical problems, or other security matters. When adults in custody enrolled in the session and are unable to report to the class site, the contractor will be paid for one (1) session.

Education and Experience:

The Forklift Operator Certification/Safety Training must be a comprehensive fork-lift training course covering Class I, IV, and V trucks. Classroom instruction will include seven specific areas of forklift training (fundamentals, balance and capacity, preoperational inspection, general rules of the road, safe load handling, techniques, refueling, battery charging and changing. Students will be able to demonstrate all safety requirements for forklift inspection. Students will receive a certificate of completion from the Department of Labor.

Health Requirements:

The contractor shall ensure that the Forklift Operator Certification/Safety Training instructor is free of infectious diseases. Any individual performing as an instructor under this contract who subsequently develops a medical condition which might reasonably be expected to place other workers, students, or the public at risk shall be immediately removed from activities requiring performance of invasive procedures and activities which might reasonably be expected to place other workers, students, or the public at risk. In any such case, the contractor shall be responsible, at no additional cost to the institution, for securing the services of any replacement personnel required for contract performance.

Description of Services/Duties:

The contractor will teach one, 10-hour course once an week off-site for adults in custody. The contractor will be responsible for class instruction and providing a certification of completion. There will be up to 12 classes available for adults in custody to participate in.

Estimated number of sessions (1-hour sessions): 7-12

Supplies:

All necessary supplies, books, and classroom materials that the contractor may routinely need will be provided by the Contractor. The Government will not supply any equipment for this program. The use of computers will be strictly monitored and must be in compliance with institutional policies regarding computer security.

Restrictions on Contract Workers:

The Contractor shall not supervise inmates, supervise Bureau of Prisons staff, participate in inmate accountability, requisition, sign for, or pick up supplies, formulate policy or procedures, or attend meetings, staff recalls, or staff functions.

Non-Personal Status:

Award of this contract will result in a contractual arrangement only. The service is a contractual arrangement and not a personnel appointment. Payment is based on an end product or the accomplishment of a specific result. The service does not constitute an employer/employee relationship. The Contractor will not be subject to Government supervision, except for security-related matters. However, Contractor performance shall be monitored. All duties outlined in this Statement of Work shall be performed in accordance with standards and methods generally accepted within the Contractor’s own field of expertise. The COR will periodically evaluate the Contractor’s performance. The contractor will be advised of unacceptable performance and will be responsible for correcting the deficiency. If this results in the contractor removing their employee, they will be required to provide a replacement candidate within 30 days.

Inmate Management:

The provision of services under this proposed contract will require frequent and unsupervised contact with inmates. The Contractor will not be responsible for the management of inmates except to ensure that those inmates involved in activities within the Contractor’s scope of work shall abide by all rules, in effect, to ensure the safety and wellbeing of all participants.

The Contractor shall be constantly aware of security and always maintain a professional relationship with the adults in custody. The Contractor shall not provide any items other than classroom materials to adults in custody/students.

Method of Performance:

The Contractor has sole responsibility and discretion for choosing and implementing the manner and method of performing tasks outlined in this Statement of Work as long as the requirements are met in accordance with the policies described above.

The Contractors performance will be evaluated in accordance with FAR Part 42.

Contract monitoring reports will be prepared by the COR and maintained in the contract file. The Government reserves the right to suspend, limit or revoke the Contractor’s privileges at the facility due to violations of security procedures.
