STATEMENT OF WORK (December 22, 2021) Type of Service or Construction (NAICS 238190 Other Foundation, Structure, and Building Exterior Contractors) Sea Turtle Exclusion Structure for Tide Gates at San Diego Bay National Wildlife Refuge

PR Number: _______________

1. General:

1.1 The San Diego National Wildlife Refuge Complex (SDNWRC or Complex) 1080 Gunpowder Point Drive, Chula Vista California 91910-8222 requires the design and installation of a structure to exclude sea turtles and marine mammals from the existing tide gates for the salt evaporation ponds at the San Diego Bay National Wildlife Refuge (SDBNWR), South San Diego Bay Unit. Work will be done at or adjacent to the tide gates located along the perimeter road of the South San Diego Bay Unit and Pond 12 and the Otay River channel. Work site entry address is the South Bay Salt Works, 1470 Bay Blvd, Chula Vista, California 91911.

1.2 Purpose/End Application: The project is to design and install a turtle exclusion structure to prevent sea turtles and marine mammals from being incidentally entrained into the salt ponds. Structure would be built at or adjacent to the existing tide gates at Pond 12 and the Otay River that bring water into the salt evaporation pond system.

1.3 Contractor Qualifications: Contractor shall be licensed and have experience in metal fabrication and construction using concrete and metal in a marine and salt marsh environment.

2. Place of Performance and Period of Performance

2.1 Work will be performed at or adjacent to the tide gate site on the perimeter road of the salt evaporation ponds at San Diego Bay NWR; entry point is at South Bay Salt Works, 1470 Bay Boulevard, Chula Vista, California 91911-3941 (Figure 1). Work also may be performed at the Contractor’s site to fabricate the turtle exclusion structure , if needed.

2.2 Period of performance will start when the Notice to Proceed (NTP) is given to the Contractor by the Contracting Officer; the period of performance end date will be 180 days after the NTP. Limitations to the project include:

1. Breeding season limits: breeding birds may be on the perimeter road and site access may not be allowed between April 15 and September 15;

2. Wet weather may make the perimeter road not drivable and there are limited areas to turn equipment around;

3. Work will need to be done with tide cycles in mind since high tides may cover the tide gates making installation impossible until the tide falls.

2.3 Normal duty hours Monday thru Friday 8:00 a.m. - 4:30 p.m. In the event of emergencies, Contractor shall provide contact information.

2.4 Nonduty hours include week nights, weekends, and Government holidays (New Year’s Day, Martin Luther King Jr. Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, Christmas Day).

3. Scope

3.1 The design will consider safety of employees and permittees during the operation of the tide gates.See attached Figures 2-7 for an example of structure used to exclude manatees from culverts

This is a design/build project. TheThe Contractor shall:

1. Meet on site with refuge staff and Contracting Officer’s Representative (COR) to review the existing tide gates and goals of the project that is to create and install a structure that excludes sea turtles and marine mammals from the salt ponds.

2. Provide 30%, 60%, and 90% design shop drawings and final construction drawings of the turtle exclusion structure at or adjacent to the existing tide gate structure.

3. Once the design structure design is approved by the Refuge Manager and COR, and if necessary , review of the final design and construction drawings by our Division of Engineering, fabricate build and install the turtle exclusion structure.

4. Ensure turtle exclusion structure will not interfere with the safe operation and maintenance of the tide gates by salt works staff and use of the perimeter road by all permittees. .

5. Ensure turtle exclusion structure openings are no greater than 8 inches apart to prevent sea turtles and marine mammals from entering the gates.

6. Have the top of the exclusion structure at or above 9-feet (NAVD88) elevation so that turtles cannot swim over the structure at the highest of high tides.

67. Ensure the sea turtle exclusion structure is of sufficiently durable materials to withstand tidal and river flows, resist fouling by marine organisms, resist rust and other deterioration, and minimize maintenance with a goal of a . functional operational lifetime of 25 years without requiring significant repair or replacement of corroded sections of the overall structure.

78. Ensure the turtle exclusion structure is manufactured to allow easy removal of sessile marine organismmanufactured to allow easy removal of sessile marine organisms that may impede the openings’ functionality for water conveyance.

4. Deliverables and/or Delivery Schedule: (for extended list a bid schedule and/or use of line item detail on the PR is recommended)

4.1 Clearly state the deliverables required, the schedule for delivery, the quantities, schedule (for multiple items).

Contractor shall designprovide shop drawings (30%, 60%, 90% and final construction) and , build and install the turtle exclusion structure for the tide gates per section 3.1 by the end of the period of performance stated in section 2.2.

5. Data Management Plan (DMP) for Science Data Agency Reference.

5.1 Not applicable.

6. Government-Furnished Equipment (GFE) / Government-Furnished Information (GFI)

6.1 Not applicable.

7. Evaluation and Acceptance

7.1 The contractor will be evaluated as detailed herein. Government acceptance is contingent upon: [Either state generally or reference the table in 8.2 if used]. Evaluation and acceptance will be on the basis of the Contractor providing materials and services that meet the goals of providing a tide gate grating exclusion structure that is durable in a marine environment, and grates or openings no further apart than 8 inches to deter turtle entry.meeting the elements of section 3.1.

8. Quality Control/Quality Assurance:

8.1 Quality control and assurance will be to construction industry standards.

9. Technical Coordinator:

9.1 Identify the primary individual responsible for the final product or service. This individual is ordinarily the author of this document, the Program Manager, or other. Include the Name, title, address, phone number and email for each individual.
