A&E Indefinite Delivery/Indefinite Quantity Western Regional Office
Statement of Work
Description of Services:
1) The contractor shall provide miscellaneous architectural and engineering services required with various repair and improvement projects on new and existing structures at the Federal Bureau of Prisons’ institutions within the Western Region, which encompass the states of Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, Utah, Washington and Wyoming. The following is a list of correctional facilities in, California: Atwater, Dublin, Herlong, Lompoc (2) Los Angeles, Mendota, Taft, Terminal Island, San Diego, and Victorville (3). Correctional facilities in the remaining states are as follows: Arizona: Phoenix, Safford, Tucson (2), Hawaii: Honolulu, Oregon: Sheridan, and Washington: Sea-Tac. Currently there are no Bureau of Prisons’ facilities in Alaska, Idaho, Montana, Nevada, Utah and Wyoming.
2) The Contractor shall provide A&E (Architectural and Engineering) services that fully cover all disciplines required for a complete job. Services shall include but not be limited to: Architectural, Civil engineering, Structural Engineering, Mechanical Engineering, Electrical Engineering, and all consultant work called for in Each Task Order. All Architects and Engineers performing work will have to be licensed in Arizona, California, Hawaii, Oregon and Washington States.
3) The Contractor shall provide A&E services to include but not be limited to: Studies, Master Planning, Environmental Assessments, Site investigation, Utility Studies, Project Programing, Design Concepts, Design, Construction Documents, Cost Estimates, Pre-Bid meetings at sites, Assistance in Bid Evaluation, Pre-construction conferences at Site, Construction Administration services, Submittal Review, Construction Contract Modification assistance, Site Visits during Construction, Project Close out services.
4) Miscellaneous professional review and recommendations: The government sometimes requires professional service that require a minimum of hours to perform, and are needed quickly to meet requirements of operating facilities that must function 24 hours a Day and 7 days a week. For these cases a Miscellaneous Task Order will be issued with a total number of not to exceed hours by profession (i.e, Architect, Mechanical Engineer, Electrical Engineer, Structural Engineer, etc.). Service orders will then be placed against this task order until the totals are reached or the government decides to close the miscellaneous task order.
In these cases the government will issue a miscellaneous services task order with up to but not to exceed number of hours for services needed. When miscellaneous professional service are required, service orders will be identified, discussed with the contractor, and hours will be issued for the contractor to perform the agreed upon work. These service orders will be billed against the Miscellaneous Services Task Order until the total hours are used up.
5) The Contractor will develop procedures, produce construction documents/work Statements, develop long- range master planning, and evaluate regulatory compliance for various activities as requested. The Contractor may be tasked with the development of these and other documents for use in design-bid-build projects. He may be tasked with providing assistance to the government in preparing Statements of Work, Estimates, assistance in reviewing proposals and submittals for the government related to design-build contracts performed by others. In this work he may be asked to act as governments consulting agent. The contractor will not be able to participate in any Design/Build contracts let by the Bureau of Prisons Western Regional Office during the life of this contract.
6) The Contractor shall develop construction specifications which promote full and open competition, in accordance with FAR 11.04. The development of design-type specifications shall be used to the maximum extent possible as sealed bidding will generally be used for the construction process. However, in the event the contractor is tasked with the development of a work statement for design-build projects, a performance-type specification will generally be required.
7) The place of acceptance for service shall be the Federal Bureau of Prisons, Western Regional Office, 7338 Shoreline Drive Stockton, California 95219
8) The Contractor is hereby informed that no construction contract can be awarded to the firm that designed the project, except as provided in FAR 36.209.
9) The following are general requirements of services applying to all Task Orders:
a) All work shall comply with the latest copies of the International Building Code, except where local codes are more stringent. Work shall also comply with NFPA, Federal Bureau of Prisons Technical Design Guidelines and ACA.
b) Work will also comply with relevant Environmental regulations, such as, hazardous waste management, air and water quality provisions, compliance with OSHA, NFPA, RCRA, CERCLA, TSCA, state and local requirements.
c) Coordinate with Federal, state and local regulatory agencies.
d) As part of the paperwork reduction act, unless specified in a particular task order all Drawings will be submitted in the latest edition of Auto-Cad and PDF format. Likewise Specifications and Reports shall be submitted in “Word” and PDF format unless specified otherwise in a particular task order.
e) Construction cost estimates shall be submitted in CSI format. They will be submitted in “PDF”.
f) For task orders that involve remodeling or new construction provide Pre and Post NFPA certification.
g) All final construction documents, shall be stamped with the licensed stamp and number of the architect or engineers that prepared them. The Architect or Engineers will be licensed in the state the construction work will be performed.
h) Recommendations per review of FBOP drawings, submittals, and construction contractor proposals.
i) Analysis, investigations, technical and regulatory reports, specifications, operating plans and permit applications as required. Including but not limited to, Environmental Assessments and Preliminary Assessments.
j) Coordination with federal, state and local regulatory agencies.
Task Orders Information:
Individual task orders will be issued to the A&E defining the services needed and any associated service required. As projects are identified, individual requests for proposals (RFP) identifying the specifications/statement of work will be issues to the A&E. Procedures for award of individual Task Orders are in accordance with the FAR and contract documents. Each RFP may include:
1) Statement of Work
2) The time required to complete the services (period of performance)
3) Acceptance criteria, if any.
4) Reporting requirements and list of deliverables (submission requirements)
5) Proposal due date and time.
Task Order Procedures:
Upon receipt of the RFP, the A&E will be given the opportunity to visit the site in question (if work required) to develop a better understanding of the task order scope and aid in the preparation of their proposal. Each proposal response from the A&E shall include
1) A narrative description of procedures the A/E will follow to accomplish the task(s) along with a list of key personnel assigned to the task order.
2) A price proposal offering to perform the work at a firm-fixed price.
3) The A/E and any consultants detailed breakdown of the offered price, to include itemization for direct labor, materials, equipment, overhead, profit, bonding, and travel, if necessary.
4) Any additional information specifically requested in the proposal. The Government shall evaluate the proposal to ascertain that the A&E has a complete understanding of the task(s) required, will perform the task(s) effectively, and complete the project in an economical and efficient manner.
The Contracting Officer may request the A/E clarify his proposal, or justify the proposed labor hours or labor mix, or discuss any other items to assure that both parties have a complete understanding of the construction project.
Upon determination by the Government that the proposal is acceptable and the price is fair and reasonable, the Contracting Officer shall issue a task order awarding the project to the A/E.
Each task order shall include the following:
1) Description of work
2) The requestors name and location
3) Reporting requirements and list of deliverables
4) Completion time frame
5) Acceptance criteria
6) Awarded price to complete the requirements of the project
7) Appropriate funding information
Miscellaneous Service Task Order:
A miscellaneous Service Task Order is a Task Order that calls for the A&E to furnish up to a not to exceed total number of hours for particular professional services. This kind of task order is used to cover a number of small service orders until the total number of hours contracted for are reached in the Task order. The government reserves the right to close the task order before the total number of hours per discipline is reached. The hours called for will be by specific disciplines the A&E furnishes. The hourly rates for services will be per the A&E’s contract quoted rates. A miscellaneous services task order is for services that need to be performed quickly, don’t require more than a few hours each and that can be simply delineated. A miscellaneous service task order will be broken down into two areas, Office hours and Travel if required. Office hours will be billed at the hourly contract rate quoted by the contractor. Travel hours will be a not to exceed total figure and will be billed as follows:
1) Hours required for the travel services will be billed per the contract quoted hourly rates and will be based on a 8 hour day maximum.
2) Travel costs will be billed up to GSA travel rates for the particular location called for.
These include the Lodging rates, per diem, mileage rates, etc., published by GSA (general services administration)
Service Orders:
Each service order placed against the Miscellaneous Services Task Order will be in the form of a service order placed by the Contracting Officer. Service Orders cannot exceed the total hours or travel totals agreed to in the Miscellaneous Services Task Order by the Contracting Officer. The Regional Facilities Administrator will call the A&E and discuss the services required first. He will then write a Service Order if the A&E can provide the services required. Each Service order will contain.
1) A brief Statement of work.
2) The requestors name and location
3) The number of Office hours required by discipline and resulting cost.
4) The Travel cost including hours and GSA travel costs required for the work.
5) Reporting requirements.
6) The performance time for the Services.
7) A place for the Regional Facilities Administrator to sign and date the Service Order.
8) The Contracting Officer will issue the service order to the A&E for review and signature.
9) The A&E will sign and date the Service Order to indicate acceptance and a copy of the Service order will be returned to the Contracting Officer.
10) Once the Service Order has been signed by the Contracting Officer required services will start. Each Service Order will be billed separately to Miscellaneous Service Task Order.
Task Order Invoices:
The contractor shall include the following information, as a minimum, on each invoice submitted for payment:
1) Contractor’s name, invoice number, task order #, and date;
2) Description, cost and quantity, or services actually rendered;
3) Payment terms;
4) Such other substantiating documentation as is required by the contract documents;
5) Name, where practical, title, phone number, and complete mailing address of the responsible official to whom payment may be sent;
6) The following certification shall be cited on each order/invoice submitted for payment “I certify that all records concerned with this invoice are current and complete as of the date of this invoice, and that all payments requested are for appropriate purposes and in accordance with the contract terms.”
Design Criteria:
1) All work required shall be performed in accordance with the International Building Code (IBC), current edition, NFPA 101 and NFPA 13 Life Safety Codes, latest editions.
2) All electrical work shall conform to the National Electrical Code (NEC), current edition.
3) All plumbing work shall conform to the National Plumbing Code, current edition.
4) All structural work shall conform to the seismic design requirements of the International Building Code (IBC) and UBC.
5) All environmental work shall conform to the current applicable EPA and /or state regulatory requirements.
6) The Government shall obtain full rights and privileges to use all documents prepared under this contract. The Government shall have unlimited rights in all drawings, designs, specifications, and other works developed in the performance of this contract; including the right to use same without any additional compensation.
All designs, drawings, specifications, and other works developed and submitted in accordance with contract shall become the property of the Government.
7) All documents prepared under this contract(s) are to reflect the actual minimum needs of the Government and the market available to satisfy such needs. All documents shall be developed in such a manner to promote full and open competition, consistent with the Federal Acquisition Regulation (FAR) Parts 6, 11, and 36.
8) Whenever possible, specifications should be written generically and references in specifications are to be widely recognized standards or promulgated by governments, industries, or technical societies.
9) If it is determined that listing manufacturers brand names is necessary for any required equipment items, product or material such listing shall include at least three (3) alternative sources and all known sources. Specifications must also clearly identify and describe the essential physical and functional characteristics of the equipment item, product or material which are considered necessary to satisfy the requirement and that will be used to evaluate proposed substitutions. When the A/E cannot identify the minimum three (3) possible alternative sources for a particular item, the A/E shall advise the Contracting Officer, documenting the specific requirements and the efforts taken to locate such sources, and make any recommendations regarding specifications. The Contracting Officer shall determine the appropriate and practicable method of specifying the item.
10) References in the specifications to equipment, material articles or patented processes by trade name, make or catalog number, shall be regarded as establishing a standard of quality and shall not be construed as limiting competition and this shall be so stated in the specifications.
11) The Government reserves the right to perform any portion of these services or similar services itself, or employ others to perform them.
12) The Government, at its option, may reproduce additional copies of drawings, reports, or other documents furnished under this contract. Otherwise, additional reproduction may be done on a reimbursable basis to the A/E.
13) All miscellaneous services required in connection with the services described herein, shall be evaluated on an “AS REQUIRED” basis, and costs established prior to the contractor beginning work. The costs of all travel in connection with services to be provided under contract(s) shall be agreed to by the A/E and the Government and established for each order prior to final approval and notice to proceed by the Contracting Officer. Compensation for travel expenses shall be based on actual costs and travel allowances of contract employees in accordance with FAR 31.205-46 and applicable Government travel regulations. Such transportation cost shall not be in an amount greater than the cost of coach class commercially scheduled air or ground travel by the most expeditious route, unless coach or ground travel space is not available. The Contracting Officer shall evaluate and approve all proposed travel costs.
Direct Labor Rates and Extended Labor Rates:
1) Labor rates to be utilized for this contract shall be as listed in Section B. Supplies or Services/Prices and Costs.
2) Labor rates proposed shall include all applicable overhead and profit proposed and allowed under the contract(s)
Definitions:
1) Contracting Officer (Co): An employee of the Federal Bureau of Prisons, designated as Contracting Officer, or their duly appointed successor, with the authority to enter into, administer, modify, and /or terminate contracts; and to make related determinations and findings; and to act with the authority to obligate funds on behalf of the Government. The Contracting Officer may designate authorized representatives to act for him/her, in which case, he/she shall notify, in writing, the affected parties specifying the limits of authority and responsibility so delegated.
2) Contracting Officer’s Representative (COR): An employee of the Federal Bureau of Prisons, designated by the Contracting Officer to be his/her authorized representative for a specific contract within the limits of the authority and responsibility so delegated, specified.
3) WRO: Federal Bureau of Prisons, Western Regional Office, Stockton, California.
