STATEMENT OF WORK

Environmental and Social Performance Practice Group Advisor: Hazardous Waste Management Senior Advisor

A. Introduction

On January 23, 2003, the United States established the Millennium Challenge Corporation (MCC), an innovative foreign assistance program designed to reduce poverty by promoting sustainable economic growth. MCC, a U.S. government corporation, is based on the principle that aid is most effective in countries that promote good governance, economic freedom, and investments in people.

MCC recognizes that the pursuit of sustainable economic growth and a healthy environment are related. Economic growth that doesn’t adequately address the associated risks of environmental degradation can leave the poor particularly vulnerable. MCC’s Environmental and Social Performance (ESP) Practice Group works with partner countries to integrate internationally-accepted principles of environmental and social sustainability into the design and implementation of MCC funded programs. In collaboration with MCC, partner countries are striving to achieve sustainable economic development through their MCC-funded activities while at the same time minimizing environmental, health and safety, and social risks and enhancing environmental and social benefits.

B. Countries

Tunisia, Mongolia, Sierra Leone, Sri Lanka, Kosovo, and any other MCC eligible country, as required.

C. Scope and Objectives

MCC seeks a Hazardous Waste Management Senior Advisor (Advisor) to advise on hazardous waste management, health and safety, and environmental impacts and risks, associated with activities that are under development or implementation in Tunisia, Mongolia, Sierra Leone, Sri Lanka, Kosovo, or any other MCC eligible country, as required. The Advisor shall assist MCC’s efforts to integrate environmental and social sustainability, as well as best practice on hazardous waste management and health and safety management, into the design and implementation of MCC funded programs specifically focusing risks associated with occupational health and safety, waste management, and mitigation and management of hazardous materials.

2. Conduct health and safety risk assessments related to proposed MCC investments, with a focus on occupational health and safety, waste management, and hazardous materials mitigation and management. Risk assessments should consider risks to a variety of stakeholders, including MCC and MCA staff, consultants, contractors, and local communities;

3. Prepare institutional health and safety assessments, including:

a. Conducting gap analyses/review of health and safety systems and related organizational capacity;

b. Recommend measures for managing the gaps identified;

c. Conduct training needs assessments;

d. Prepare technical guidance to implement measures, including preparation of training materials, and delivering presentations and training sessions on health and safety, waste management, and hazardous materials management to a variety of stakeholders.

4. Carry out desk reviews to ensure that projects are on track to meet agreed-upon specifications, schedules, and budgets;

5. Assist in technical reviews of project-related documents including concept papers, feasibility studies, environmental, social, health and safety, waste, and hazardous materials impact assessments and management plans, consultant terms of reference, construction bidding documents, work plans, and performance monitoring plans to ensure compliance with the International Finance Corporation’s Performance Standards on Environmental and Social Sustainability;

6. Assist MCC in the development of or reviewing Terms of References for specific sector activities;

7. Provide appropriate guidance, tools, and assistance to help strengthen institutional capacity and policies to integrate internationally accepted principles of health and safety, waste management, hazardous materials management, and environmental and social sustainability and social equity into the design and implementation of MCC-funded projects;

8. Travel to MCC countries to provide oversight of health and safety, environment, and social performance on MCC investments, including visits to construction sites, and provide expert advice to MCC to improve performance of health and safety, waste management, hazardous materials, environmental, and social issues;

9. Maintain a productive, collaborative working relationship with key sector actors, donors, donors’ consultants, MCC and MCC’s partner countries.

Should the Advisor be expected to travel to an MCC partner country, a detailed scope of work shall be provided at least two weeks prior to travel and include specified deliverables. No additional tasks shall imply any additional costs to the Government beyond the amount allowed for in the initial call order; however, this call order may be amended to reflect additional costs associated with implementation planning and oversight requirements in additional countries.

Acceptance Criteria Deliverables shall be evaluated according to the following criteria:

Any changes in the terms of the SoW will be made in writing and approved by the Contracting Officer. No representation of the COR/PM shall serve as a basis for an alteration in the general scope of this SoW or of the terms and conditions of the SoW unless confirmed in writing by the Contracting Officer. The contractor must communicate with the Contracting Officer on all matters that pertain to the Contract terms. Proceeding with the work without proper contractual coverage could result in nonpayment for that work.
