1. Introduction
Purpose: The purpose of this project is to design and construct the rehabilitation and stabilization of the entrance road and parking area at the Kīlauea Point National Wildlife Refuge (Kīlauea NWR) to enhance visitor safety and access. These areas incurred significant damage from storms in 2020 and 2021, including erosion, asphalt damage, drainage and runoff issues, and damage to the main water line that services the refuge.
Background: The Refuge is located on the northern-most point of the island of Kauaʻi on a portion of the former Kīlauea volcanic vent atop a 180-foot ocean bluff. The mission of the Refuge is to protect and enhance migratory seabirds and threatened and endangered species and their habitats, as well as to facilitate wildlife-dependent recreation opportunities. The Refuge is also home to the historic Kīlauea Point Lighthouse. Unique wildlife viewing and interpretative opportunities for the lighthouse makes the Refuge one of the most visited in the nation.
Project Location & Access: The project is located at the Kīlauea Point National Wildlife Refuge, 3500 Kīlauea Road, Kīlauea, HI 96754. The Refuge is currently open to the public from Wednesday to Saturday 10:00AM - 4:00 PM. All access will be coordinated with the Refuge Project Leader or site representative with available Monday thru Friday from 7:30 AM to 4:30 PM (Local Time), excluding Federal Holidays.
Availability outside the dates/hours shall be coordinated with the FWS at least two business days in advance.
FAR Price Range: For general project order-of-magnitude only. The anticipated cost of future construction services will be between $1,800,000 and $2,400,000.
2. General Project Description
The Design Build (DB) Contractor shall provide all labor, equipment, materials, and supervision to plan, design, and construct a complete project that fulfills the programmatic needs identified by the USFWS;
is safe; well-integrated into the landscape; relatively easy and low cost to operate and maintain; that is of high quality, durability, and functionality.
This DB project includes the following Pre-Construction Services:
• Task 1A: Site Investigation, Scoping, Data Collection and Schematic Design
• Task 1B: Design Documents including Drawings, Specifications, Estimate, and Schedule
• Task 1C: Environmental Permitting Assistance
This Design-Build project includes the following Construction Services:
• Task 2A: Construction of the project in accordance with the drawings and specifications.
• Task 2B: Construction of waterline replacement in accordance with the drawings and specifications.
3. Schedule
All design and construction work in this Request for Proposal (RFP) shall be completed within 365 days of contract award.
Kīlauea Point National Wildlife Refuge Page | 2
The DB shall submit an initial milestone schedule 14 calendar days after notice of award of the project.
Milestones should include significant events typical to a Design Build Contract.
Seasonal/Bio Species Constraints:
Contractor must adhere to any minimization and avoidance measures for all threatened and endangered species that occur onsite, as specified within the section 7 consultation under the Endangered Species Act (i.e., nesting buffers, avoiding take of individuals, etc.). Any ground disturbing or heavy equipment work should be scheduled outside of the breeding season for Newell’s shearwater from mid-April until November, whenever possible since these species occur in the direct vicinity of the project area. Any vegetation clearing along the road to prepare for construction should be accomplished in late February/early March to avoid disturbing nesting threatened or endangered bird species.

6.7 Task 1C: Permitting
This task is for assistance preparing documentation required for permitting.
Preparation of review documents under the provisions of the National Environmental Policy Act (NEPA).
FWS has determined that there are no agency or departmental Categorical Exclusions (CE) that exist for this work. A focused and concise (10-35 pages) Environmental Assessment (EA) with public Involvement to the extent practicable needs to be developed. The No Action and Proposed Scope Action alternatives will be evaluated in the environmental review. The draft EA will be published and available to the public for comment for a 30-day period.
The Service believes that the project may qualify for a Finding of No Significant Impact (FONSI) following preparation of an Environmental Assessment (EA) that satisfies NEPA. If, following consultation with stakeholders and preparation of the documentation, a significant impact is identified such that a FONSI will not likely occur and an Environmental Impact Statement will be needed, the DB shall notify FWS with a plan of action.
The DB will develop environmental review documents for the No Action alternative and the Action alternative identified in this SOW. DB services for this task will include, but not be limited to:
• Task A – Public Notification & Pre-Assessment Consultation
Kīlauea Point National Wildlife Refuge Page | 8
• Task B – Conduct Resource Studies and Evaluate Likelihood of FONSI
• Task C – Develop DRAFT NEPA Documents

Develop a list of all potential interested parties. The list shall include Federal, State, Local, community and neighboring landowners.
Prepare a 1–2-page notice to the public and other stakeholders stating an EA will be prepared and available for public comment. The notice shall include:
• Preliminary purpose and need, description of the proposed action, challenges to project completion (social, economic, physical); utilize documents developed in Task 1A.
• The FWS proposed process including when, and where the public scoping meeting will be held.
• The name and address of the designated individual(s) from the DB who can answer questions about the proposed action.
• DB Email address for public to send comments.
The notice shall be submitted to the local newspapers and electronic letters sent to all potential interested parties.
After publication of the notice, a public comment period of 30 days will be open, affording agencies, organizations, and individuals an opportunity to offer up their concerns.
The DB will facilitate the comment reception process and at the conclusion of the public comment period, the comment responses will be summarized for inclusion in the draft NEPA documents.
Deliverables:
• Public Notice (.pdf)
• Electronic Letters to Interested Parties (.pdf)
• All written comments received (.pdf)
6.7.2 Task 1C.B – Conduct Resource Studies and Evaluate Likelihood of FONSI Conduct resource studies for the EA necessary to evaluate the potential environmental impacts and the likelihood of a FONSI. Unless specifically mentioned otherwise in this SOW, all resources studies will rely on existing information from previous environmental documents and will not require a field survey.
Deliverables: Draft reports of resource studies (.pdf)
Kīlauea Point National Wildlife Refuge Page | 9
6.7.3 Task 1C.C – Develop DRAFT NEPA Documents and Public Meeting Prepare a preliminary Draft EA for review. DB and FWS will concurrently review the document.
Comments will be incorporated and the Draft EA will be finalized. The Draft EA will be made available for public comment for a 30-day period. The DB will draft responses to comments to be reviewed by FWS before being sent to commentor.
Deliverables:
• Draft EA for Review (.pdf)
• All spoken and written comments received (.pdf)
• Summarization of comments into categories for responses
• Responses to all comments received
6.7.4 Task 1C.D – Develop FINAL NEPA Documents
Prepare a final EA for review. Incorporate all comments received from the Draft EA as appropriate into the final EA. The FWS will review and sign the final EA and the DB will make the final EA available to the public.
If the EA determines a FONSI, the A-E shall prepare the FONSI. If a significant impact is identified such that a FONSI will not likely occur and an Environmental Impact Statement will be needed, the A-E shall notify USFWS and provide an estimate for the preparation of the EIS.
Deliverables:
