Statement of Work Ballistic Plate Armor

U.S. Customs and Border Protection (CBP) Statement of Work (SOW) for DHS Strategically Sourced Ballistic Rifle Plate Armor

Version 1.0

1. BACKGROUND:

1.1 U.S. Customs and Border Protection (CBP) has identified a need for rigid, lightweight ballistic plate armor capable of defeating high velocity rifle threats in support of the mission of officers and agents in the various components of CBP. As such, this requirement is for the procurement of ballistic plate armor which offers National Institute of Justice (NIJ) certified ballistic protection in support of the mission of officers and agents within

CBP.

1.2 This contract shall be awarded and administered by U.S. Customs and

Border Protection (CBP).

1.3 This contract is for ballistic plates only; no carriers or other accessories are included.

1.4 Relevant components within DHS and outside of DHS may include but are not limited to the following listed in Table 1.4. This contract shall be awarded and administered by U.S. Customs and Border Protection (CBP).

2. SCOPE:

2.1 The intent of CBP is to contract for National Institute of Justice (NIJ) certified threat level III ballistic plates (NIJ Standard 0101.06) or NIJ RF 1/NIJ RF 2 (NIJ Standard 0101.07).

2.2 Specifically, three variations of plates shall be included, and will vary depending upon intended use and threat requirements.

2.2 All armor make/models must be certified by the NIJ’s Compliance Testing

Program and listed on the NIJ’s current Compliance Product List for either NIJ Standard 0101.06 or NIJ Standard 0101.07.

2.3 Front/Back ballistic plates and side plates shall be included.

2.8 All armor makes/models shall have a manufacturer’s ballistic warranty of

10 years. Warranty commences at date of acceptance by the Government.

3.0 APPLICABLE DOCUMENTS/STANDARDS:

4.0 TECHNICAL AND ADMINISTRATIVE REQUIREMENTS:

4.1 General Ballistic Requirements

4.1.1 The standard(s) for testing and performance of ballistic plates submitted for this solicitation shall be those established by the NIJ Standard-0101.06 or NIJ Standard-0101.07.

4.1.2 Ballistic plates shall meet either Option I or Option II listed below in Sections 4.3 through 4.8.

4.1.3 All ballistic plate make/models submitted for consideration shall be certified by the NIJ to have met the NIJ Ballistic Resistance of Body Armor standard for Threat Level III or NIJ RF 1 and NIJ RF 2 and be listed on the NIJ’s current Compliance Product List. The Government shall require vendors to provide an NIJ “Notice of Compliance” certification letter for all packages submitted for evaluation.

4.1.4 Ballistic plates shall remain certified as compliant throughout the life of the contract (including the warranty period which may extend beyond the period of performance of the contract).

4.1.5 The Government shall require vendors to provide complete NIJ

Compliance Test Reports for each make/model.

4.1.6 All additional ballistic testing for requirements described within the SOW, shall take place at an independent NIJ approved laboratory, and shall be at no cost to the Government. Data reports for this testing shall be provided to the Government.

4.1.7 All ballistic plates must be “stand alone”. “In conjunction with” plates are not acceptable.

4.1.8 With proposal submission, the vendor (if not the manufacturer) shall provide a letter from the manufacturer indicating it is an authorized distributor/retailer of the ballistic plates. Unauthorized distributors and retailers are unacceptable and will not be considered.

4.2 General Requirements

4.2.1 There are no separate requirements for front and back plates. They are interchangeable and herein shall be referred to singularly as “front/back” ballistic plates.

4.2.2 All additional testing for size, weight, and thickness requirements described within the SOW, shall take place at an independent NIJ approved laboratory, and shall be at no cost to the Government.

4.2.3 Front/Back ballistic plates shall be available in the following nominal sizes: 8” x 10”, 10” x 12”, and 11” x 14”. ESAPI plate shapes are not acceptable for the 8” x 10” and 10” x 12” but are acceptable for the 11” x 14” plate.

4.2.4 Side ballistic plates shall be available in the following nominal size:

6” x 6”.

4.2.5 Front/Back ballistic plates shall have a “Shooter Cut” to maximize coverage while still allowing for a more comfortable shooting position. Elongated or exaggerated “Swimmers Cut” is not acceptable. Chamfer width shall not exceed 3” and chamfer length (height) shall not exceed 4” on 10” x 12” plates. Chamfer radius shall be consistent between 10” x 12” and 8” x 10” plates.

4.2.6 Front/Back ballistic plates shall fit CBP’s current contracted soft armor Scalable System Base Carrier with minimal movement for each respective size.

4.2.7 Front/Back ballistic plates shall have a multi-curve radius. Single curve radius is not acceptable.

4.2.8 Side plates shall have a single curve radius. A multi curve radius is not acceptable.

4.2.9 Ballistic plates shall have a protective sprayed on, polyurea outer coating. Fabric coating or covering of any kind is not acceptable.

4.2.10 Ballistic plates shall be serialized for internal control.

4.3 Ballistic Plate 1 Specific Requirements (OPTION I)

4.3.1 Ballistic plate shall be NIJ Level III, per the NIJ Standard-0101.06.

4.3.2 Ballistic plate shall be a front/back configuration.

4.3.3 Ballistic plate shall contain polyethylene fibers. The plate may also include additional ballistic material, such as aramid fiber or foam, provided it still meets weight and NIJ certifications.

4.3.4 Ballistic plate (10” x 12”) weight shall not exceed 2.60 pounds.

4.3.5 Ballistic plate thickness shall not exceed 1.20 inches. Thickness shall be calculated using the average of 6 separate measurements, taken at each corner, 2” from the edge. See Illustration 4.3.5

4.3.6 Ballistic plate shall have a V50 velocity at or above 3010 (ft/s)

4.3.7 Ballistic plate (10” x 12”) shall be able to defeat six shots of each of the following additional rounds using a modified NIJ test protocol performed at 0.0° obliquity and ambient range temperature. NIJ back face deformation requirements shall also apply.

4.4 Ballistic Plate 1 Specific Requirements (OPTION II)

4.4.1 Ballistic plate shall be NIJ RF 1, per the NIJ Standard-0101.07.

4.4.3 Ballistic plate shall contain polyethylene fibers. The plate may also

4.5.2 Ballistic Plate shall be a front/back configuration.

4.5.3 Ballistic plate shall contain polyethylene fibers with a ceramic layer.

The plate may also include additional ballistic material, such as aramid fiber or foam, provided it still meets weight and NIJ certifications.

4.5.4 Ballistic plate (10” x 12”) weight shall not exceed 4.30 pounds per plate.

4.5.5 Ballistic plate thickness shall not exceed 1.30 inches. Thickness

4.5.6 Ballistic plate shall have a V50 velocity at or above 3010 (ft/s).

4.5.7 Ballistic plate (10” x 12”) shall be able to defeat six shots of each of the following additional rounds using a modified NIJ test protocol performed at 0.0° obliquity and ambient range temperature. NIJ back face deformation requirements shall also apply.

4.6 Ballistic Plate 2 Specific Requirements (OPTION II)

4.6.1 Ballistic plate shall be NIJ RF 2, by the NIJ Standard-0101.07.

4.6.2 Ballistic Plate shall be a front/back configuration.

4.6.3 Ballistic plate shall contain polyethylene fibers with a ceramic layer.

The plate may also include additional ballistic material, such as aramid fiber or foam, provided it still meets weight and NIJ certifications.

4.6.4 Ballistic plate (10” x 12”) weight shall not exceed 4.30 pounds per

4.8 Ballistic Plate 3 Specific Requirements (OPTION II)

4.8.1 Ballistic plate shall be NIJ RF 1, by the NIJ Standard-0101.07.

4.9 Serialization

4.9.1 All plates shall be serialized.

4.9.2 Serialization errors shall be corrected at no expense to the

4.9.3 Serialization errors shall be corrected within seven business days after the agency representative notifies vendor, or the vendor receives the affected plate(s) in cases where the serial number needs to be physically changed.

4.9.4 Vendor will report via email to the agency representative when errors have been corrected. The email should state the old/erroneous serial number, the new/correct serial number, the name of the officer or agent assigned to the vest, and a description of the corrective action taken.

4.9.5 The Government shall be the final arbiter in deciding the correct serial number for a plate when errors occur.

4.10 Barcodes

4.10.1 Serial numbers shall be encrypted as barcodes on the NIJ certification labels.

4.10.2 Barcodes shall use Code 3 of 9 barcode symbology (also known as Code 39).

4.11 Warranties

4.11.1 All ballistic plates shall have a ten (10) year manufacturer’s ballistic warranty. Warranty period shall begin upon acceptance of the plates by the government. (Extended warranty coverage provided by resellers is not acceptable.)

4.11.2 The vendor shall provide a letter or certificate of warranty issued by the plate manufacturer (for each make/model) indicating a 10-year ballistic warranty.

4.11.3 Ballistic plate labels shall also indicate a 10-year warranty period.

4.11.4 Vendor shall be contacted by the Contracting Officer

Representative (COR), or an authorized representative of CBP, for all warranty work.

4.11.5 The vendor shall provide a return authorization number for all warranty claims.

4.11.6 Vendor shall provide a primary point of contact, to include phone number and email address.

4.11.7 Vendor shall acknowledge receipt of warranty claims to the government appointed COR within two business days of being notified.

4.11.8 Warranty claims shall be remedied at no expense to the government except for shipping to the factory.

4.12 Shipping

4.12.1 All items are to be shipped FOB destination.

4.12.2 Shipping locations may be centralized, or may include locations throughout the CONUS, Alaska, Hawaii, US Virgin Islands, and Puerto Rico.

4.12.3 Specific delivery addresses shall be provided at the time of Delivery

Order issuance.

4.12.4 Orders containing 30 units or less shall be shipped via ground

(unless exempted by the COR). All other orders may be shipped via common carrier freight (palletized).

4.12.5 All shipments shall be trackable.

4.13 Delivery Schedule

4.13.1 The delivery schedule will be provided per each individual delivery order.

4.14 Reporting Requirements

4.14.1 Delivery schedule of reports

4.14.1.1 Report identified below in Section 4.14.2 shall be

provided to the Contracting Officer or the designated COR prior to vendor performance conferences. Additional reports shall also be made available anytime, at the request of the Contracting Officer or his/her designated representative.

4.14.1.2 Reports shall be provided in electronic format, with an accompanying hard copy presented (upon request).

4.14.2 Delivery Order (DO) Report

4.14.2.1 The Delivery Order Report shall include a line-item

summary of all delivery orders.

4.14.2.2 Each line in the report shall contain the following

information: the name of the purchasing agency/group;

delivery order (DO) number, DO Line number, unit cost, original quantity of DO, original value of DO, current total of units ordered, current amount of funding expended against the DO, current number of units remaining on the DO, and the current amount of funding remaining on the DO.

4.14.2.3 The Delivery Order Report shall be categorized by

agency, purchasing group, and any other subcategory as needed.

4.15 Production requirements

4.15.1 Government requires that the vendor maintain the capacity to manufacture or acquire the total number of units specified in each individual order.

4.16 Vendor performance meetings

4.16.1 Within 30 days of contract award, the vendor shall host a pre-production meeting.

4.16.2 CBP and the vendor shall meet once per year, commencing six months after production begins and continuing approximately every year thereafter. These performance conferences are to discuss contract issues, review the technical and financial status of the contract, discuss vendor and Government performance, and to resolve any problems or other issues as they may arise. Each year, the vendor may be required to host one of the performance conferences at its production facility, with all meeting locations (including virtual) at the discretion of the Government.

4.16.3 Government attendees may include the Contracting Officer and/or the Contract Specialist, the Contracting Officer’s Representative, as well as other attendees from the various DHS components and/or representatives from the DHS Weapons and Ammunition Commodity Council.

4.17 Security

4.17.1 All work under this SOW is UNCLASSIFIED but may require secure handling of information designated as for official use only (FOUO).

4.17.2 Vendor personnel who will perform work on the contract may be required to execute non-disclosure agreement (NDAs), which shall be delivered to the COR prior to commencing work in accordance with DHS policy for safeguarding FOUO information.

4.18 Special considerations

4.18.1 Invoicing/Payment

4.18.1.1 Vendor shall coordinate with each agency

representative to ensure proper distribution of invoices to insure timely payment.

4.18.1.2 Invoices shall be submitted in an electronic format.

PDF versions are preferable, but alternate formats will also be accepted. At a minimum, the following data elements shall be included on the invoice: vendor name and address, date of invoice, invoice number, sales order number (if applicable), delivery order number (DO Number), DO Line

Number, Contract Number, ballistic model number, component name, unit price, total quantity, and total dollar value.

4.18.1.3 Vendors shall take Government purchase card as a

payment if requested. If a Government purchase card is utilized, the vendor shall notify the Contracting Officer via email of the purchase including the total value of the transaction.

4.18.1.4 The vendor shall provide in writing to the Contracting

Officer and COR a dedicated Point of Contact (to include cell phone and e-mail address) and a back-up point of contact who will be “on-call” to resolve issues regarding both the contract and any delivery orders awarded against the contract.

4.18.1.5 For accountability purposes, the vendor shall provide an electronic list of serial numbers for each delivery order.

This shall be done in an excel format (see picture 4.18.1.5 below) provided to the vendor within 10 days of contract award, be in numerical order, and shall include additional information related to the order (to include vendor’s name, vendor’s address, delivery order number, invoice number, sales order number [if separate], make/model of ballistic plates, unit cost, quantity, and total cost.).
