In accordance with FAR 7.503(e), projects provided by the Army for execution under this CA by USACE do not include any functions to be performed that are inherently governmental. This determination is made with the assessment that places emphasis on the degree to which conditions and facts restrict the discretionary authority, decision-making responsibility, or accountability of Government officials using Non-Federal Entity (NFE) services or work products.

In accordance with FAR 37.104, this CA shall not be used for performance of personal services.

These tasks provided by the customer for execution under this CA by USACE do not include functions to be performed that are personal services.

Any modifications to Cooperative Agreement activities as outlined by this SOW/PWS must be channeled through the Grants Officer’s Technical Representative (GOTR) and Grants Officer (GO) prior to NFE implementation.

NFE personnel shall also wear a distinctive NFE furnished security (ID) badge/lanyard readily identifying the individual as a NFE employee. The badge shall be worn in a conspicuous place at all times when performing work under the Cooperative Agreement including attendance at Government meetings and conferences that take place outside of the Government facility.

NFE personnel shall identify themselves as an NFE employee when answering or placing calls on a Government telephone and when leaving outgoing or incoming messages on voice mail.

The Government shall not exercise any supervision or control over the sub-NFEs performing the services herein. Such sub-NFEs shall be accountable solely to the NFE who, in turn is responsible to the Government.

The NFE will also identify data gaps in installation Golden Eagle data and determine/identify the best possible method for filling these data gaps with eagle monitoring methods, such as, but not limited to GPS trackers, cellphone backpacks, Unmanned Aerial Vehicles (UAV), visual, game cameras, remains found, and nest surveys or other innovative eagle monitoring methodology.

The information from this effort will be used to develop strategy to assist installations with compliance with BGEPA and BGEPA incidental take permits requirements.

The Bald and Golden Eagle Protection Act (16 U.S.C. 668-668c) and the specific reference to incidental take permits are noted here ‘In accordance with 50 C.F.R. §22, installations must obtain a permit from the USFWS if an activity may result in "take" of a bald or golden eagle as defined in the regulations’.

1.2.2. Common Access Card card for access to AFCEC and Access to E-Plan Application.

NFE will be required to obtain a Common Access Card (CAC) in order to access Air Force net to support AFCEC/CZTQ. An NFE who does not currently possess the required credentials and access to the Air Force server must coordinate with AFCECE to obtain the necessary CAC access credentials and network access.
