About this file

This is a Sources Sought Notice issued by the Department of Health and Human Services (DHHS), Office of Mission Acquisition Solution (OMAS), on behalf of the Office of the General Counsel (OGC), to identify qualified vendors capable of providing specialized legal recruiting services. The notice is for market research and acquisition planning purposes only and does not constitute a solicitation, request for proposals, or commitment to award a contract. The OGC seeks contractors to provide specialized legal recruiting and executive search services to identify, screen, and refer highly qualified attorney candidates for hard-to-fill positions supporting the Department's healthcare, public health, litigation, and regulatory missions. The anticipated contract will cover a base year with up to four option years and will utilize a performance-based, milestone-linked (contingent) fee structure tied to candidate referral and successful onboarding milestones rather than level-of-effort billing. All hiring decisions, candidate interviews, and employment offers will remain inherently governmental functions performed exclusively by OGC; the contractor's role is advisory, administrative, and coordinative.

Vendors responding must demonstrate minimum threshold capabilities including specialized legal recruiting experience for attorney positions in healthcare law, life sciences, healthcare regulatory law (Medicare, Medicaid, CHIP, drug pricing including the 340B program, Affordable Care Act), healthcare fraud and abuse (Anti-Kickback Statute, Stark Law, False Claims Act), HIPAA, health information technology, and complex federal healthcare litigation. Respondents must have at least two senior recruiters with minimum five years of experience placing attorneys in health law or related practice areas, the ability to source both active and passive candidates through professional networks and legal databases, capability to conduct preliminary screening and verify credentials including bar membership and disciplinary history, and compliance with federal privacy and data-handling requirements. The anticipated NAICS code is 561311 (Employment Placement Agencies). Capability statements not exceeding eight pages must be submitted electronically by July 31, 2026, at 10:00 a.m. Eastern Time to Azeb Mengistu at azeb.mengistu@hhs.gov and Patrick Hacker at Patrick.Hacker@hhs.gov, with the email subject line referencing Sources Sought Notice No. OMASOS347922. Responses must include the respondent's Unique Entity Identifier (UEI), business size status certification, and confirmation of active registration in the System for Award Management (SAM).

SOURCES SOUGHT NOTICE

Specialized Legal Recruiting Services

The Department of Health and Human Services (DHHS), Office of Mission Acquisition Solution

(OMAS), on behalf of the Office of the General Counsel (OGC), is issuing this Sources Sought

Notice to identify qualified vendors capable of providing Specialized Legal Recruiting Services.

1. Notice and Purpose

This is a Sources Sought Notice issued solely for market research and information-planning purposes in accordance with FAR Part 10. It does not constitute a solicitation, a request for proposals, a request for quotations, or an invitation for bids, and it is not to be construed as a commitment by the Government to issue a solicitation or ultimately award a contract. Responses to this notice are not offers and cannot be accepted by the Government to form a binding contract. The Government will not pay for any information provided in response to this notice or for any costs incurred in preparing a response.

The Office of the General Counsel (OGC), U.S. Department of Health and Human Services

(HHS), is conducting market research to identify potential sources capable of providing specialized legal recruiting and executive search services to identify, screen, and refer highly qualified attorney candidates for hard-to-fill positions supporting the Department’s healthcare, public health, litigation, and regulatory missions.

2. Background and Anticipated Scope

OGC anticipates a requirement for specialized legal recruiting services under which a contractor would perform market research, candidate sourcing and outreach (including passive candidates), preliminary qualification screening, credential and licensure verification, candidate presentation and referral, and interview and onboarding coordination support. The anticipated requirement contemplates a performance-based, milestone-linked payment structure. All hiring decisions, candidate interviews for selection, and offers of employment are inherently governmental functions that will be performed exclusively by OGC; the contractor role is advisory, administrative, and coordinative.

The anticipated period of performance is a base year with up to four (4) option years.

Recruitment support may be required for attorney positions at various grade levels, including attorney-advisor, supervisory attorney, deputy associate general counsel, assistant deputy associate general counsel, associate general counsel, and other attorney roles.

3. Minimum Capabilities

To assist the Government in assessing whether an interested firm is a viable potential source, respondents should demonstrate the ability to meet the following minimum threshold capabilities. These are stated as minimum capabilities for market research purposes only and are not evaluation or award criteria. Respondents are asked to describe, factually and specifically, their ability to perform each of the following:

● Provide specialized legal recruiting or executive search services for attorney positions, including for hard-to-fill or highly specialized roles.

● Demonstrate corporate experience recruiting attorneys in one or more of the following practice areas: health law; life sciences; healthcare regulatory law (including Medicare, Medicaid, and CHIP; drug pricing, including the 340B program; the Affordable Care

Act); healthcare fraud and abuse (Anti-Kickback Statute, Stark Law, False Claims Act);

HIPAA and health information governance; health information technology and digital health; and/or complex federal healthcare litigation.

● Utilize qualified recruiting personnel, including at least two (2) senior recruiters each possessing a minimum of five (5) years of experience placing attorneys in health law, life sciences, healthcare regulatory, or related legal practice areas.

● Source both active and passive candidates through established professional networks, legal associations, legal databases, and other recruitment channels, and maintain a candidate pipeline across multiple concurrent vacancies.

● Conduct preliminary candidate screening and verify candidate credentials, including active bar membership, licensure status and disciplinary history, educational credentials, and relevant employment history.

● Prepare and deliver complete candidate referral packages and written candidate assessments and provide recurring recruitment status reporting.

● Perform under a performance-based, milestone-linked (contingent) fee arrangement, in which payment is tied to candidate referral and successful onboarding milestones rather than level-of-effort billing.

● Safeguard candidate information and comply with applicable federal privacy and data-handling requirements, including protection of Personally Identifiable Information (PII).

● Perform primarily from a contractor facility with virtual coordination with OGC.

4. Requested Response Information

Interested firms that can meet the minimum capabilities described above are invited to submit a capability statement, not to exceed eight (8) pages, addressing the following:

a. Company information. Company name, address, point of contact (name, telephone, email), DUNS/UEI number, and CAGE code.

b. Business size and socioeconomic status. Business size under the applicable NAICS code (see

Section 5.0), and identification of any socioeconomic categories for which the firm is certified or self-certified (e.g., small business, 8(a), HUBZone, service-disabled veteran-owned small business, women-owned small business, economically disadvantaged women-owned small business).

c. Capability narrative. A description of the firm’s ability to meet each of the minimum capabilities in Section 3, with sufficient specificity to allow the Government to assess capability.

d. Relevant experience. Up to three (3) examples of relevant recruiting engagements (Federal, state, local, or commercial) performed within the last three (3) years, including a brief description of the work, the customer, period of performance, dollar value or fee structure, and a reference point of contact. Note: This information is requested for market research only and will not be scored or evaluated competitively.

e. Capacity. A description of the firm’s capacity to support multiple concurrent attorney recruitment actions, including staffing and pipeline capacity.

f. Contract vehicles. Identification of any Government-wide acquisition contracts, GSA

Schedules (including relevant SINs), or other contract vehicles under which the firm holds a contract that could be used to acquire these services.

g. Business arrangement feedback. Optional: comments on the feasibility of, or any concerns with, a performance-based, milestone-linked (contingent) fee structure for these services.

5. NAICS Code and Size Standard

The anticipated North American Industry Classification System (NAICS) code for this requirement is NAICS 561311, Employment Placement Agencies. Please indicate your business size and any other designations, e.g., small business category. Respondents should indicate their size status under this NAICS code and may comment if they believe a different NAICS code is more appropriate.

6. Closing Statement:

Responses to this Sources Sought Notice are requested for market research and acquisition planning purposes only. Information received will assist the Government in determining the appropriate acquisition strategy, including whether the requirement should be set aside for small business concerns.

Responses should include sufficient detail and supporting information to clearly demonstrate the respondent's relevant experience, technical capabilities, and capacity to perform the required services.

All responsible sources may submit a response, which will be considered if received by the specified due date.
